Abstract

ABSTRAK Pelaksanaan Pengabdian Progam Kemitraan Masyarakat (PKM) yang berjudul Sosialisasi Metode Rukyatul Hilal Dalam Penetapan Satu Syawal Terhadap IPNU-IPPNU Di Desa Pandanarum Kecamatan Sutojayan Kabupaten Blitar merupakan kegiatan pengabdian masyarakat yang bekerjasama dengan organisasi pelajar Nahdlatul Ulama Di Desa Pandanarum yaitu IPNU-IPPNU. Tujuan dari pengabdian kepada masyarakat ini untuk meningkatkan pengetahuan anggota IPNU-IPPNU dalam penggunaan metode rukytul hilal guna menetapkan satu syawal. Kegiatan pengabdian ini didasari oleh minimnya pengetahuan mitra terhadap pentinganya rukyatul hilal. Melalui program ini, tim pelaksana pengabdian kepada masyarakat memberikan solusi terhadap persoalan yang dihadapi mitra sebagai organisasi pelajar NU yakni IPNU-IPPNU ranting pandanrum untuk mempelopori pentingnya pengetahuan mengenai metode rukyatul hilal dalam penentuan awal bulan syawal. Target yang ingin dicapai adalah peningkatan pemahaman mitra terhadap pentingnya metode rukyatul hilal dalam penetapan awal bulan syawal. Metode yang digunakan untuk mencapai target tersebut adalah dengan observasi, menjalin kerjasama dengan mitra untuk menyelesaikan permasalahan yang dihadapi dengan meluangkan waktu dua minggu selama pelaksanaan program pengabdian, memberikan bimbingan teknis kepada mitra tentang pentingnya metode rukyatul hilal dalam penetapan satu syawal. Hasil pengabdian yang dilakukan menunjukkan bahwa solusi yang diberikan tim pelaksana terhadap permasalahan mitra dapat membuka pengetahuan untuk mensosialisasikan penggunaan metode rukyatul hilal dalam menetapkan satu syawal.

Abstract

This study examines the effectiveness of regulations preventing child marriage in the city of Surabaya after the enactment of Law No. 16 of 2019, which raised the minimum age for marriage to 19 years, but still allows for marriage dispensations through Article 7 paragraph (2). This normative loophole raises academic questions about how the law works in social reality and how preventive measures can be institutionalized. This study aims to assess the implementation of regional policies, particularly Perwali No. 32 of 2024, and to examine the practices of religious courts in deciding on marriage dispensations using Lawrence M. Friedman's Legal System Theory and the principle of Sadd al-Dzarīʿah as analytical tools. Empirical research methods were used through interviews, observations, documentation, and qualitative analysis of two cases of marriage dispensation that were rejected and granted. The results of the study show that the significant decrease in the number of marriage dispensations in Surabaya occurred due to the synergy of the legal structure (Religious Court, DP3APPKB, Ministry of Religious Affairs, RT/RW), legal substance through the Perwali which tightened procedures, and changes in the legal culture of society. The courts applied new standards that are more protective and based on maqāṣid al-syarī‘ah , making marriage dispensations an emergency mechanism rather than a legalization of child marriage. This study provides theoretical implications in the form of an integrative model between maqāṣid and the modern legal system, as well as practical implications in the form of recommendations to replicate the Surabaya model in other regions in an effort to protect children.

Abstract

This article analyzes the implementation of the RT Keren Program from the perspective of Islamic family law and its implications for the realization of sakinah families in Blitar City. The RT Keren Program is a local government innovation that promotes community participation based on the Rukun Tetangga (RT) in strengthening the social, economic, and spiritual resilience of families. This study aims to analyze how the implementation of this program affects the achievement of sakinah families for the community in Blitar City. This study uses a qualitative descriptive method, based on Edward's implementation theory and the indicators of sakinah families according to Yusuf Al-Qardawi. The results show that the RT Keren program has been implemented well but is not yet running optimally. This study emphasizes the integration between decentralization policies and the concept of sakinah families from an Islamic law perspective, which shows that the RT Keren program has a positive impact on the achievement of sakinah families at the local level. These findings recommend that the RT Keren model be used as a national prototype for strengthening Islamic value-based family welfare policies.
