Abstract

Penelitian ini bertujuan untuk menggambarkan kehidupan sosial ekonomi masyarakat di Nagari Koto Baru, Kecamatan Sungai Tarab, yang mayoritas berprofesi sebagai petani kayu manis. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kasus, melibatkan observasi langsung, wawancara, dan analisis data sekunder. Hasil penelitian menunjukkan bahwa kehidupan sosial masyarakat Nagari Koto Baru sangat dipengaruhi oleh aktivitas pertanian kayu manis. Petani kayu manis menjadi tulang punggung ekonomi masyarakat, menyediakan sumber pendapatan utama bagi sebagian besar penduduk. Namun, ada tantangan signifikan yang dihadapi, seperti fluktuasi harga kayu manis di pasar global dan perubahan iklim yang memengaruhi hasil panen. Dalam aspek sosial, kehidupan masyarakat Nagari Koto Baru gejolak, dengan kegiatan gotong-royong dan solidaritas tinggi dalam mengatasi masalah bersama. Namun, terdapat juga ketegangan terkait alokasi lahan dan sumber daya, yang dapat memengaruhi hubungan antarwarga. Penelitian ini memberikan wawasan mendalam tentang dinamika kehidupan sosial ekonomi masyarakat petani kayu manis di Nagari Koto Baru. Implikasi dari temuan ini dapat menjadi dasar untuk pengembangan kebijakan yang lebih baik dalam mendukung keberlanjutan ekonomi dan kesejahteraan masyarakat setempat, khususnya dalam menghadapi perubahan kondisi pasar dan lingkungan.

Abstract

Overhead cost claim disputes are a crucial issue in Indonesia’s construction industry. Therefore, this research aims to comprehensively analyze the legal aspects of overhead cost claims in construction contracts in Indonesia, encompassing the legal basis, types of claimable costs, legal conditions triggering claims, claim submission requirements, calculation methods, and dispute resolution mechanisms. A normative juridical method is employed to achieve this objective, using a statute, case, and conceptual approach. Data is sourced from statutory regulations, construction contract standards, jurisprudence, and legal literature and then analyzed qualitatively. Substantively, this research finds that the legal basis for overhead cost claims in Indonesia involves a complex interaction between Law Number 2 of 2017, Government Regulation Number 22 of 2020, the Civil Code, and contract standards such as FIDIC. Furthermore, overhead claims must be based on wanprestasi (breach of contract), force majeure, or variation orders and must meet the requirements of notification, documentation, accountable calculation, and causality. In terms of calculation, the accepted method must be by the principle of compensation. As for dispute resolution, it can be through mediation, conciliation, arbitration, or litigation, with the caveat that the selection of a mechanism depends on a case-by-case analysis. Overall, this research provides a comprehensive understanding of the legal aspects of overhead cost claims in construction contracts in Indonesia.

Abstract

This study examines the legal issues arising from the State Administrative Court’s overlapping jurisdiction over actions by Electricity SOE Directors that possess hybrid characteristics as both private and public entities. The core issue lies in the legal uncertainty surrounding the boundaries of the administrative court’s absolute competence in determining the business discretion of Directors in national strategic projects. Such actions are frequently drawn into the realm of administrative disputes through the expansion of the meaning of the State Administrative Decision. This study aims to analyze the legal standing of SOE Directors, dissect the dialectics between the BJR doctrine and the General Principles of Good Administration in land acquisition and permitting, and formulate norm reconstruction through internal procedural standardization. The research method employed is normative legal research, using the statute and conceptual approaches through prescriptive analysis of nine primary legal instruments and twenty-eight secondary legal materials. The results indicate that integrating BJR into the General Principles of Good Administration is imperative to protect managerial discretion from excessive judicial intervention. A crucial finding in this study emphasizes that the identification of the source of power, whether contractual or regulatory, is the key to determining the qualification of a decision as a private legal act to activate the exception in Article 2 point a of Law Number 9 of 2004. The implications of this study recommend standardizing SOE internal procedures in line with Supreme Court Circular Number 2 of 2019. This is essential to ensure that disputes arising from a breach of contract by the authority remain within the exclusive competence of the civil court. This effort is undertaken to achieve legal certainty in accelerating national energy infrastructure.
