<![CDATA[Tujuan penelitian menganalisis alasan penggunaan kekerasan dengan senjata api oleh anggota Polri, dan bentuk pertanggung jawaban penggunaan kekerasan dengan senjata api oleh anggota Polri. Tipe penelitian ini adalah normatif. Hasil Penelitian penulis mendapatkan bahwa: 1). Penggunaan kekerasan dengan senjata api oleh anggota kepolisian, berdasarkan pada peraturan perundang-undangan yang dalam ketentuan tersebut memperbolehkan anggota kepolisian menerapkan konsep diskresi. Dimana konsep diskresi ini adalah hak yang melekat dalam kewenangan yang diberikan oleh setiap anggota polri. tentunya hak tersebut tetap memperhatikan hal-hal yang dapat mengancam keselamatan nyawa anggota polri. 2). Bentuk pertanggung jawaban penggunaan kekerasan dengan senjata api oleh Anggota Kepolisian, dengan menggunakan kekerasan dan senjata api yang tidak sesuai dengan prosedur merupakan tindakan pelanggaran Hak Asasi Manusia. Pelanggaran yang dilakukan oleh petugas penegak hukum berupa penggunaan senjata api yang tidak sesuai dengan prosedur, merusak integritas keseluruhan organisasi penegak hukum. The research objective to analyze the reasons for the use of force with firearms by members of the Police, and the forms of accountability for the use of violence with firearms by members of the Police. This type of research is normative. Research results the authors find that: 1). The use of force with firearms by members of the police, is based on laws and regulations which in this provision allow members of the police to apply the concept of discretion. Where the concept of discretion is the right inherent in the authority granted by each member of the Indonesian National Police. Of course, this right still pays attention to matters that can threaten the safety of the lives of members of the Indonesian National Police. 2). The form of accountability for the use of force with firearms by members of the Police, by using violence and firearms that are not in accordance with procedures is an act of violation of human rights.
