Abstract

This research aims to answer the accusations of the Inkar as-Sunnah who rejectthe hadiths of the Prophet, either in whole or in part. This study used the libraryresearch method by tracing and examining the books of scholars, journal articles,youtube etc. There are two very basic doubts argued by munkiru as-Sunnah inaccording with this problem; namely first, the inauthenticity of hadith since it hadbeen only written after the Prophet Muhammad died, so that they only adhered tothe Qur’an as a source of Islamic teachings and second, the rejection of hadithĀhād for its poorness of trustworthy. These two doubts are answered, first by thefact that some of the Prophet's companions had written hadith since he still alive.Meanwhile, the following doubts are disputed by the validity of religious teachings,even though only conveyed by one or two men.

Abstract

The discourse on istinbāṭ al-aḥkām the derivation of Islamic legal rulings remains central to understanding how Islamic law maintains its relevance across time and context. This study explores istinbāṭ al-aḥkām as a dynamic epistemological framework within classical jurisprudence, focusing on how the four major Sunni jurists Abū Ḥanīfah, Mālik ibn Anas, Muḥammad ibn Idrīs al-Syāfi‘ī, and Aḥmad ibn Ḥanbal constructed distinct yet complementary methodologies in applying revelation to social realities. Employing a qualitative library-based approach, the research analyzes primary classical sources such as al-Risālah and al-Muwaṭṭa’, alongside modern interpretations by Kamali, Auda, and Aziz, through a comparative-descriptive method. Data were collected through textual documentation and analyzed through content and comparative synthesis to identify the distinctive reasoning patterns of each imam. The findings reveal that the four imams shared common sources of law al-Qur’ān, al-Sunnah, ijmā‘, and qiyās but diverged in methodological emphasis: Abū Ḥanīfah through rational-analogical reasoning (istiḥsān), Mālik through communal practice and maṣlaḥah, al-Syāfi‘ī through linguistic textualism, and Aḥmad through transmitted authenticity. This diversity demonstrates that istinbāṭ al-aḥkām functions as a plural yet unified system of reasoning, balancing revelation, reason, and context. The study concludes that methodological plurality in uṣūl al-fiqh strengthens, rather than fragments, Islamic jurisprudence, ensuring its adaptability and ethical coherence across changing times and conditions.

Abstract

Penelitian ini mengkaji hubungan integral antara fikih, ushul fikih, dan fatwa dalam sistem hukum Islam. Fokus utama penelitian adalah menganalisis bagaimana ketiga elemen ini saling berinteraksi dan melengkapi dalam pembentukan dan penerapan hukum Islam. Fikih, sebagai pemahaman praktis terhadap hukum-hukum syariah, berfungsi sebagai panduan dalam kehidupan sehari-hari umat Islam, mencakup aspek ibadah dan muamalah. Ushul fikih berperan sebagai metodologi dan kerangka teoretis yang menyediakan prinsip-prinsip dan kaidah dalam penetapan hukum Islam, memungkinkan para ulama untuk menafsirkan teks-teks agama secara sistematis. Sementara itu, fatwa bertindak sebagai instrumen responsif yang memungkinkan adaptasi hukum Islam terhadap permasalahan kontemporer. Penelitian ini menggunakan berbagai sumber primer dari kitab-kitab klasik seperti Al-Mustasfa karya Al-Ghazali, Al-Umm karya Imam Syafi'i, dan Fatawa Ibn Taymiyyah, untuk menunjukkan bagaimana hubungan ketiga elemen ini telah berkembang dalam tradisi keilmuan Islam. Hasil penelitian menunjukkan bahwa ushul fikih memberikan metodologi yang menjadi dasar bagi penetapan hukum fikih, sedangkan fatwa merupakan aplikasi praktis dari prinsip-prinsip syariah yang dirumuskan berdasarkan kaidah ushul fikih. Hubungan yang saling terkait ini memungkinkan hukum Islam untuk tetap relevan dalam menghadapi berbagai tantangan zaman, sambil tetap mempertahankan fondasi doktrinalnya yang kokoh.

Abstract

This study examines the historical development of Fiqh and Usul Fiqh as essential branches of Islamic knowledge for establishing Islamic law. Understanding the history of these sciences is crucial to preventing misunderstandings in legal rulings and fostering tolerance in differing opinions. The research employs a qualitative method with a literature review approach, analyzing books, journals, and online sources related to the evolution of Fiqh and Usul Fiqh. The discussion reveals that the development of these sciences can be divided into three main phases. The formative phase (7th to 10th centuries CE) was marked by the application of laws based on the Qur’an, Sunnah, and systematically organized ijtihad by the Prophet, his companions, and the tabi’in. The stagnation phase (10th to 20th centuries CE) saw a decline due to the dominance of taqlid and sectarian fanaticism, although reformist scholars like Ibn Taymiyyah sought to revive the spirit of ijtihad. The developmental phase (post-establishment of national Islamic states) was characterized by the revival of Islamic law through purification movements, legal codifications such as the Majallah al-Ahkam al-‘Adillah, and the adaptation of Fiqh texts to modern contexts. This study concludes that the historical development of Fiqh and Usul Fiqh reflects the dynamic nature of Islamic law, which is adaptable to changing times through cycles of innovation, stagnation, and revival. Understanding this history is essential to maintaining the relevance of Islamic law in addressing modern challenges.

Abstract

Ta'arudh adillah or conflict between shar'i propositions is one of the fundamental problems in ushul fiqh that requires special attention. The resolution of ta'arudh adillah is crucial to ensure that arguments that appear to be contradictory can be compromised or chosen one of them appropriately, thus maintaining the continuity of understanding Islamic law. This research uses a qualitative approach by analyzing various classical literature by scholars in ushul fiqh. The descriptive-analytical method is applied to explain the concept of ta'arudh adillah, identify the causes of conflict, and evaluate the methods of resolution used by the scholars. The study shows that ta'arudh adillah can be caused by various factors, such as differences in text interpretation, the historical context of the argument, or the level of strength of the argument. The scholars used various methods of resolution, such as tarjih (choosing the stronger argument), nasakh (canceling the previous argument), and jama' (compromising arguments that appear to be contradictory). A deep understanding of the method of resolving ta'arudh adillah can help in applying Islamic law consistently and relevantly. This research makes a significant contribution to the understanding of this concept and its relevance in the modern context.
