Abstract

bagai tuntutan baru di dalam masyarakat. Salah satunya, keinginan untuk mereformasi segenap produk dan pelaksanaan hukum yang selama ini dianggap selalu berpihak kepada penguasa. Dalam perjalanannya, tuntutan tersebut mulai terakomodasikan. Setidaknya, munculnya pemerintahan baru, yang dianggap memiliki legitimasi yang kuat memberikan secercah harapan bahwa supremasi hukum akan ditegakkan dan berkuasa di negeri ini. Tuntutan dan harapan tersebut dipandang tidak berlebihan. Selain memegang legitimasi, pemerintahan baru ini pun dibekali panduan, sebagai arah penentuan kebijakan di bidang hukum. Panduan yang dituangkan dalam sepuluh butir arah kebijakan hukum ini terangkum menjadi satu bersama arah kebijakan bidang lainnya dalam suatu rumusan Garis-garis Besar Haluan Negara (GBHN). Dengan demikian, sepanjang lima tahun jalannya pemerintahan, masyarakat tinggal memantau segenap keberhasilan dari kinerja pemerintah baru ini.1

Abstract

Judicial review is one of the constitutional authorities of the Constitutional Court that plays a central role in upholding constitutional supremacy, sustaining checks and balances, and strengthening constitutional democracy in Indonesia. This study examines the constitutional position and authority of judicial review exercised by the Constitutional Court within Indonesia's system of governance and assesses the implications of its judicial review decisions for the protection of citizens' constitutional rights within Indonesia's democratic system. The study employed normative legal research using statute, conceptual, and case approaches, drawing on primary, secondary, and tertiary legal materials analyzed qualitatively through a descriptive-analytical method. The findings show that the Constitutional Court holds a strategic position as guardian of the constitution, exercising authority to test statutes against the 1945 Constitution to ensure that legislative products remain consistent with the principles of the rule of law and constitutional democracy. This authority functions as an instrument of democratic oversight that restrains the misuse of legislative power and sustains institutional equilibrium. In addition, the Court's judicial review decisions carry significant implications for the protection of citizens' constitutional rights: through its authority to invalidate unconstitutional norms, the Court reinforces constitutional supremacy, increases the accountability of law-makers, and advances a constitutional democracy in which the constitution serves as the foundation of state power. Judicial review therefore functions not merely as a mechanism for testing legal norms but as a substantive instrument for strengthening democracy and protecting citizens' constitutional rights in Indonesia.

Abstract

Kejaksaan lembaga penegak hukum supremasi hukum, perlindungan kepentingan umum, penegakan hak asasi manusia dilakukan melalui fungsi penyidikan dan penuntutan. Bidang Perdata dan Tata Usaha Negara seperti yang diatur dalam pasal 30 Ayat (2) Undang-Undang No. 16 Tahun 2004 memiliki kuasa khusus untuk bertindak baik didalam maupun diluar pengadilan untuk dan atas nama Negara atau pemerintah baik didalam maupun diluar pengadilan yang merupakan tugas dari Jaksa Agung Muda Bidang Perdata dan Tata Usaha Negara. Pasal 24 Peraturan Presiden Republik Indonesia No. 38 Tahun 2010 tentang Organisasi dan Tata Kerja Kejaksaan Republik Indonesia disebutkan Jaksa Agung Muda Bidang Perdata dan Tata Usaha Negara adalah unsur pembantu pimpinan dalam pelaksanaan tugas dan wewenang Kejaksaan di bidang Perdata dan Tata Usaha Negara. Peraturan Presiden Republik Indonesia No. 38 Tahun 2010 dan peraturan Jaksa Agung Per-025/A/JA/11/2015 tentang petunjuk pelaksanaan Penegakan Hukum, Bantuan Hukum, Pertimbangan Hukum, Tindakan Hukum Lain dan Pelayanan Hukum di Bidang Perdata dan Tata Usaha Negara. Penelitian bersifat empiris. Jenis data yang digunakan adalah data primer yang terdiri dari wawancara dan data sekunder yang meliputi bahan hukum primer, sekunder dan tersier. Data yang terkumpul kemudian dianalisa melalui analisa deskriptif kualitatif dengan hasil bahwa Kejaksaan Negeri Sidoarjo telah berusaha semaksimal mungkin untuk pelaksanaan tugas nya dalam tahun 2019-2021 telah menangani berbagai penanganan perkara Perdata dan Tata Usaha Negara dibidang Perdata dan Tata Usaha Negara, dimana dibagi menjadi 2 kategori yaitu berupa Pendampingan Hukum dan juga bantuan hukum secara litigasi maupun non litigasi mewakili pihak-pihak (Pemerintah Daerah, BPJS, BUMD/N) untuk melakukan perlindungan maupun pemulihan hak.

Abstract

This research examine the application of the restorative justice approach in cases of assault within the jurisdiction of the Sidoarjo City Police. Assault not only causes physical harm but also significant psychological trauma for victims. However, the Indonesian criminal justice system tends to focus on punishing perpetrators and does not sufficiently prioritize victim recovery and social reconciliation. This study aims to analyze the role of the police in promoting the application of restorative justice and its impact on the restoration of the rights of assault victims. The research method used is an empirical legal approach with qualitative methods through literature review and interviews with Sidoarjo City Police investigators, victims, and offenders. The results of the study indicate that the Sidoarjo City Police implement restorative justice in cases of minor assault through a mediation process facilitated by investigators to reach a peaceful settlement. This approach has a positive impact on the psychological recovery of victims because victims are given a space to be heard and to be actively involved in the case resolution process. This study concludes that restorative justice is an important innovation in criminal justice system reform that requires support from stronger regulations as well as capacity building for law enforcement officials.

Abstract

This study aims to analyze law enforcement against affiliators involved in online gambling criminal acts under the Electronic Information and Transaction Law (ITE Law). Affiliators function as intermediaries between online gambling platforms and the public by exploiting social media to promote gambling activities on a large scale. This study also examines the obstacles encountered in the law enforcement process, including limited resources among law enforcement agencies, challenges posed by digital technology, and low levels of digital literacy within society, all of which contribute to high rates of public participation in online gambling. The method employed in this study is a normative juridical approach, involving the review of legislation, official documents, and relevant literature. Case analysis is also utilized to provide a concrete illustration of how the law is applied to online gambling affiliators. Based on the findings, Article 27 Paragraph 2 of the ITE Law serves as the primary legal basis for prosecuting affiliators who disseminate or facilitate access to gambling-related content. Nevertheless, obstacles such as limited digital forensic capabilities and difficulties in pursuing perpetrators across national borders remain the primary challenges in law enforcement. This study recommends strengthening the capacity of law enforcement agencies, particularly in the areas of digital technology and forensic investigation, as well as the need for cross-border cooperation to address international jurisdictional challenges. Through these measures, it is hoped that law enforcement against online gambling affiliators will become more effective and provide greater protection for the public from the adverse effects of online gambling.
