Abstract

In 2013, the Indonesian Constitutional Court ended the debate concerning the constitutional validity of the right to appeal against acquittal by the prosecutor. Such a question has a long history not only in the Indonesian judicial system. In their decision, the court concluded that the government should have the power to appeal against acquittal to the Supreme Court because of its supervisory function over the lower courts. However, the decision was not unanimous, and there was one dissenting opinion from justice Harjono, who is in favor of protecting the rights of the acquitted defendant. This article is trying to examine the decision and underlined the issue of two competing values, namely finality, and accuracy that was debated in the decision, even though the court did not explicitly mention it. In the end, this article finds that the court gives more importance to the accuracy of the conviction and less to their finality.

Abstract

Abstract Suppose we pay attention to Indonesian literature on criminal justice. In that case, the central thesis of most publications are that criminal justice administration is a single system, where actors as a sub-system work together for one clear goal, named justice. We develop a criminal justice model such as adversarial, inquisitorial, and integrated criminal justive systems based on this assumption. This article shows that the reality is not that simple. Through literature review, this article will show that criminal justice is a complex and multi-dimensional subject. The outcome of the system relies heavily on the actors and their interaction when processing a case. This framework has not been widely discussed in the Indonesian literature because of the limited approach to the study of criminal justice. In our study, we are obsessed with models and their comparisons. In the end, this article invites Indonesian academics to refresh our approach to studying criminal justice by expanding our framework in understanding criminal justice as a multi-dimensional subject. Without it, our academic discourse will not develop much. Abstrak Apabila kita melihat literatur hukum acara pidana kita, kita akan menemukan asumsi bahwa hukum acara pidana adalah suatu sistem yang tunggal, di mana para aparat penegak hukum sebagai sub-sistem bekerjasama untuk satu tujuan yang jelas, yaitu keadilan. Dari asumsi ini lahir istilah-istilah model acara pidana seperti adversarial, inquisitorial sampai integrated criminal justice system. Artikel ini menunjukkan bahwa realitanya tidak sesederhana itu. Melalui metode tinjauan literatur, artikel ini akan menunjukkan bahwa hukum acara pidana adalah disiplin ilmu yang kompleks dan multi-dimensional. Luaran dari proses acara pidana lebih banyak ditentukan oleh para aktor dan relasi kerja antar mereka. Kerangka berpikir inilah yang belum banyak dibahas oleh literatur kita karena keterbatasan pendekatan yang lebih banyak terobsesi dengan model dan komparasi model hukum acara pidana. Pada akhirnya, artikel ini mengajak para akademisi untuk menyegarkan pendekatan studi hukum acara pidana dengan jalan memperluas kerangka berpikir yang meletakkan disiplin ilmu acara pidana sebagai proses yang multi-dimensional. Tanpanya, disiplin ilmu hukum acara pidana tidak akan berkembang banyak.

Abstract

This article argues that the current narcotics law regime is a factor to blame for the cause of prison overcrowding and unnecessary deprivation of liberty and dignity for its violator with the help of criminal justice tools. Multi-layer category of drug users introduced by the current narcotics law is leaving too much discretion for the law enforcement agency to criminalize marijuana user. Data shows that in Jakarta and Surabaya court alone, all marijuana users are charged with multiple articles and leaving no room for them to escape from a draconian sentence. This paper questions the repressive enforcement used by the Indonesian apparatus specifically on marijuana because it leads to other issues bigger than the personal use of marijuana itself. In the end, this article is proposing the change of legislation in marijuana law while at the same time taking the nature of political conservatism in Indonesia into account.

Abstract

Asas praduga tidak bersalah merupakan asas yang paling dasar di dalam hukum acara pidana dimanapun. Asas ini mengandung paradoks karena di satu sisi, negara melalui aparatur penegak hukum diwajibkanuntuk mengumpulkan bukti-bukti untuk menetapkan seseorang sebagai tersangka, di sisi lain mempunyaikewajiban untuk tetap menganggapnya tidak bersalah. Abstract

This paper analyzes a practice of presenting suspects, which is a ritual that displays a suspect before the media. Until now, although it is frequently used by the police, there has been no attempt to examine such practices in Indonesia. In the criminal procedure scholarship, there is no standard term to describe it. This article will refer to such ritual as a presentation of suspects. This ritual has also been practiced around the world with different methods and has a long history, especially in the United States. This article discusses the presentation of suspects and question whether such a ritual is a violation of the fundamental rights of being presumed innocent until found guilty. Two issues will be examined to answer this question: The purported objectives for the practice and the accused’s right to be presumed innocent. The term innocence here is a presumptively innocent and not factually innocent. With that in mind, to some degree, this article realizes it would be permissible to deprive their liberty if it has a higher purpose.

Abstract

Legal researchers often conduct face-to-face interviews to answer research questions and achieve their objectives. However, many researchers fail to explain the relationship between research design, research questions, and the interview method used. Additionally, there is limited literature, both globally and nationally, that discusses the methods and functions of interviews in legal research, particularly within a doctrinal framework. This discussion is important because the interview methods in the doctrinal and socio-legal approaches have different characteristics. Drawing on the author's practical experience and literature review, this article aims to fill this gap by discussing the theoretical and practical dimensions of face-to-face interviews in legal research. The article places the role of interviews within doctrinal and socio-legal research frameworks in the theoretical discussion. In the practical discussion, the article discusses technical issues that need to be considered before, during, and after an interview, as well as the role of the researcher as part of the research process. Abstrak Seringkali, para peneliti hukum melakukan kegiatan wawancara untuk menjawab pertanyaan dan mencapai tujuan penelitiannya. Akan tetapi, banyak ditemukan dimana peneliti tidak menjelaskan hubungan antara desain penelitian, pertanyaan penelitian dengan metode wawancara yang dilakukan. Terlebih lagi, tidak banyak literatur baik global maupun nasional yang membahas metode dan fungsi wawancara dalam penelitian hukum secara spesifik khususnya dalam kerangka doktrinal. Padahal, metode wawancara dalam pendekatan penelitian hukum doktrinal dan sosio-legal memiliki karakteristik yang berbeda. Berangkat dari pengalaman praktis penulis dan tinjauan literatur, artikel ini hadir untuk mengisi kekosongan tersebut dengan melakukan pembahasan mengenai metode wawancara dalam penelitian hukum baik secara teoritis dan praktis. Di dalam pembahasan teoritis, artikel ini menempatkan peran, fungsi dan tujuan metode wawancara baik dalam kerangka penelitian hukum doktrinal dan sosio-legal. Selanjutnya, di dalam pembahasan praktis, artikel ini membahas hal-hal teknis yang perlu diperhatikan oleh peneliti sebelum melakukan wawancara, saat wawancara berlangsung, proses analisa data wawancara serta posisi peneliti sebagai bagian yang tidak terpisahkan dari penelitian itu sendiri.

Abstract

This article discusses legal and political issues related to marijuana in global literature and its influence in the Indonesian context. Moreover, this article also tries to predict the dynamics of the ongoing reform process related to Indonesian narcotic laws. To achieve such missions, mainly, this article summarizes the debate within marijuana literature and highlights its influence within the Indonesian context. The first part of this article discusses the legal and political dynamics of marijuana laws globally. Here, this article found that there is a paradigm shift toward marijuana use -- from a crime problem to a health problem. Subsequently, this article also analyzes whether such a paradigm shift might happen in Indonesia. In the end, this article found that such a paradigm shift will not likely occur in Indonesia because of several reasons. First, there is a tendency for Indonesian lawmakers to treat marijuana issues with the communitarianism principle. As a result, it makes the government act as a "moral guardian" for its citizens. This is because the use of marijuana is not only treated as a legal issue but also a moral one. The process of internalization of previous laws creates a negative moral stigma. As a consequence, a paradigm shift in the reform will face tough challenges. The recent criminal code (KUHAP nasional) also introduces the punitive drug law's logic. Lastly, the flexibility in interpreting the current regulations (2009) will create resistance to reform from the legal apparatus. Most likely, legal apparatus will not surrender their "comfort zone" due to the current law's flexibility that prioritizes punitive actions.
