Abstract

Sebagaimana telah disebutkan dalam Pasal 5 Undang-undang Nomor 18 Tahun 2003 tentang Advokat bahwa advokat adalah penegak hukum. Namun prakteknya, sebatas dipergunakannya hak oleh tersangka dan diberikan oleh penyidik manakala terdapat peristiwa pidana yang diatur dalam Pasal 56 Kitab Undang-Undang Hukum Acara Pidana. Hal ini menjadikan limitasi atas profesi advokat yang merupakan salah satu pintu dalam memberikan akses terhadap keadilan bagi masyarakat khususnya dalam proses peradilan pidana. pembahasan dan analisis maka disimpulkan, pertama Eksistensi advokat sebagai penegak hukum dalam proses peradilan pidana ditinjau dari Pasal 56 Kitab Undang-Undang Hukum Acara Pidana terbatas pada ancaman pidana dalam suatu tindak pidana dan tergantung pada pemahaman hukum yang dimiliki penyidik dalam memberikan hak seutuhnya kepada tersangka sejak awal dimulainya proses pemeriksaan. Sehingga eksistensi advokat sebagai penegak hukum akan berpengaruh dalam proses peradilan yang dibatasi oleh bentuk tindak pidana dan ancaman pidana serta subjek pada setiap tingkatan pemeriksaan. Kedua, Implikasi Pasal 56 Kitab Undang-Undang Hukum Acara Pidana terhadap eksistensi advokat sebagai penegak hukum dalam proses peradilan pidana adalah terbatasinya peran advokat dalam proses peradilan, sehingga tidak dapat hadir pada setiap perkara pidana dan peran advokat tidak dilibatkan sejak awal dimulainya proses peradilan sehingga mengakibatkan tumbuhnya praktek bina jaringan guna mendapatkan peran dalam suatu proses peradilan pidana yang dapat mencederai makna officium nobile yang melekat pada diri seorang advokat.

Abstract

The research explores the resolution of customary criminal disputes in the context of the Baduy tribe, an ethnic group in Banten Province, Indonesia, with a focus on harmonization between local customary law and national criminal law. Through normative juridical methodology and analytical descriptive analysis, this study explores the mechanisms for resolving customary criminal disputes and their relationship with national criminal law. The results reveal the challenges in achieving harmony between traditional values and modern criminal law principles, as well as the implications for legal justice and human rights. The statutory approach and case approach help to comprehensively describe these dynamics, provide in-depth insight into the interaction between Baduy tribal customary law and Indonesian national criminal law and highlight the need for improved policies that are more inclusive and just.

Abstract

The advocate profession is called a law enforcer by the Advocate Law, but at the implementation level there are limitations, when the presence of an advocate is limited to an incapacitated person who is threatened with a sentence of more than 5 years (vide KUHAP). This has become ingrained into a misguided understanding among society. Ironically, there is an assumption that advocates can be used or vice versa. In fact, it is clear that at each level there is room for lawyers to enter, from the level of investigation, fingerprinting, prosecution to fact testing at trial by the court. This writing specification is in descriptive form using juridical analysis on the basis of highlighting logical strategies as the main work methodology. This scribble is made to recognize applicable ideas, rules and principles by utilizing literature and positive law. Foundation of the Law on Advocates and KUHAP. Arriving at the conclusion, namely that it is difficult for advocates to be accepted as law enforcers because there is no intimacy either with regulations or with fellow enforcement officers, so it is difficult to make out intimately in law enforcement in abstracto with law enforcement in concreto. Cynicism towards advocates as law enforcers is limited to rights in the form of granting power of attorney. His presence is not an obligation in every case, what is very important at the initial stage is the process of making light of the incident with evidence which is often met with the need to meet the prosecutor's P21 "needs" to be served in the form of a "menu" of charges for the judge to taste so he can determine the value of a dish.
