Abstract

Narcotics abuse is a serious problem that affects society in various countries. This research focuses on identifying factors that contribute to the spread of narcotics in Simpang Dolok Village, a rural area in Batu Bara Regency. The research results highlight the importance of social and economic inequality, high levels of poverty, and the easy availability of narcotics in driving the spread of narcotics. Social factors, including peer pressure, also influence young people in this village to try narcotics. Apart from that, low public awareness about the dangers of narcotics, especially among the less educated, also supports the situation. Handling the problem of the spread of narcotics in Simpang Dolok Village requires a holistic approach that includes economic empowerment, stronger law enforcement, and better education programs about the risks of narcotics. Close cooperation between government, society, and other stakeholders is needed to overcome this problem. This research provides an in-depth understanding of the factors that influence the spread of narcotics at the village level, guiding more effective prevention and control efforts in Simpang Dolok Village and the surrounding area.

Abstract

Penelitian ini mengkaji penyelesaian kasus khalwat melalui mekanisme adat desa terhadap pelaku non-warga di Desa Kampung Baru, Aceh Singkil, dengan meninjau kesesuaiannya menurut hukum positif Aceh dan hukum Islam. Penelitian ini menggunakan metode yuridis normatif yang dipadukan dengan pendekatan sosiologis melalui studi lapangan dan wawancara dengan aparatur desa serta tokoh adat. Hasil penelitian menunjukkan bahwa praktik penyelesaian adat terhadap pelaku non-warga desa masih dilakukan meskipun secara normatif kewenangan peradilan adat desa dibatasi hanya terhadap penduduk setempat. Praktik tersebut dapat dikualifikasikan sebagai pelampauan kewenangan peradilan adat yang berdampak pada melemahnya asas kepastian hukum dan legalitas dalam penegakan hukum jinayat. Dari perspektif hukum Islam, mekanisme adat dapat dipahami sebagai bentuk ta‘zir dan ‘urf yang dibenarkan, namun penerapannya dalam kasus ini belum sepenuhnya mencerminkan tujuan maqashid al-syari’ah, khususnya dalam aspek pencegahan kemafsadatan dan perlindungan kehormatan. Oleh karena itu, penelitian ini menegaskan pentingnya penataan hubungan antara hukum adat dan hukum jinayat agar tercapai keseimbangan antara kepastian hukum, kemaslahatan, dan keadilan Substantif dalam penerapan syari’at Islam di Aceh.

Abstract

Public officials who commit corruption crimes constitute a systemic form of crime that has broad impacts on economic stability, public trust, and the effectiveness of governmental governance. Although the provisions under Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 have established strict sanctions, the predominantly retributive sentencing approach is considered insufficient to realize substantive justice, particularly in terms of state financial recovery and institutional reform. This study aims to reconstruct a sentencing model for public officials involved in corruption crimes based on Restorative Governance within the perspective of Ta‘zīr. The research employs a normative juridical method with statutory and conceptual approaches, alongside qualitative analysis of primary and secondary legal materials. The findings reveal that the Restorative Governance approach emphasizes the recovery of state losses, the strengthening of accountability, and governance system reforms, which are conceptually aligned with the principles of Ta‘zīr in Islamic criminal law that are flexible and oriented toward public benefit (maslahah). The novelty of this research lies in the integration of the concepts of Restorative Governance and Ta‘zīr in formulating a more adaptive and justice-oriented sentencing model for corruption crimes. This study recommends reforms in criminal law policy through strengthening restorative approaches within the sentencing system in order to enhance the effectiveness of combating corruption crimes.

Abstract

This study aims to analyze abortion law in Indonesia through the perspectives of criminal justice and Islamic law, particularly following the enactment of Law Number 1 of 2023 concerning the Indonesian Criminal Code. The study examines the legal construction of abortion offences, the criminal regulation established under Indonesia’s new Criminal Code, and the extent to which these provisions correspond with Islamic legal principles and human rights considerations. This research employs a normative juridical method using statutory and conceptual approaches, supported by library research involving the analysis of primary legal materials, including legislation and Islamic legal sources, as well as secondary materials consisting of scholarly works and academic studies on abortion regulation. The findings demonstrate that Indonesian criminal justice maintains abortion as a prohibited act subject to criminal sanctions while providing limited legal exceptions for pregnancies resulting from rape or sexual violence and for medical emergencies. From the perspective of Islamic law, these exceptions may be accepted when they fulfil the principles of necessity and are consistent with the objectives of maqasid al-shari’ah, particularly the preservation of life (hifz al-nafs) and the preservation of progeny (hifz al-nasl). The study concludes that abortion regulation in Indonesia represents a legal reform effort aimed at balancing criminal responsibility, Islamic legal values, and human rights protection. This research contributes academically by enriching the discourse on abortion law reform and demonstrating how criminal justice and Islamic law interact in addressing reproductive issues within a contemporary legal system.

Abstract

Abstrak: Pencurian merupakan salah satu kejahatan yang paling sering terjadi dan berulang di wilayah hukum Pengadilan Negeri Medan. Fenomena residivisme, atau pengulangan tindak pidana oleh pelaku yang telah dihukum, menunjukkan bahwa sanksi pidana yang dijatuhkan belum sepenuhnya efektif dalam memberikan efek jera. Penelitian ini bertujuan untuk mengkaji kebijakan hakim dalam menjatuhkan hukuman kepada pelaku pencurian, khususnya residivis, dan untuk mengkaji relevansi dan efektivitas sanksi pidana dari perspektif hukum pidana Islam. Metode penelitian yang digunakan adalah normatif dan empiris. Pendekatan normatif dilakukan dengan menganalisis hukum dan peraturan yang berlaku, khususnya KUHP, dan sumber hukum Islam seperti Al-Quran dan Hadits. Pendekatan empiris dilakukan melalui studi kasus beberapa putusan pengadilan di Pengadilan Negeri Medan dan wawancara dengan petugas penegak hukum. Teknik analisis data yang digunakan adalah analisis kualitatif dan komparatif, membandingkan kebijakan hukuman dalam hukum positif dan hukum pidana Islam. Hasil penelitian menunjukkan bahwa kebijakan hukuman hakim terhadap pelaku pencurian masih berfokus pada hukuman konvensional, yaitu penjara, yang dalam banyak kasus tidak efektif dalam mencegah terulangnya kejahatan. Dari perspektif hukum pidana Islam, sanksi seperti hudud memiliki dimensi moral dan preventif yang lebih kuat, dengan persyaratan yang ketat dan prinsip-prinsip keadilan yang holistik. Penelitian ini merekomendasikan evaluasi terhadap kebijakan hukuman yang ada dan perlunya menciptakan ruang untuk integrasi nilai-nilai hukum pidana Islam ke dalam sistem peradilan pidana nasional.

Abstract

The Public Housing Savings Law (UU Tapera) requires self-employed workers earning at least the minimum wage to participate as Tapera members, even though their income is not connected to any employer. This obligation stands in contrast to the Consumer Protection Law (UUPK), which ensures that consumers have the right to freely select goods and/or services based on their individual preferences. As Tapera consumers, self-employed workers should therefore retain the freedom to determine the financing model and capital-accumulation scheme they prefer for obtaining residential housing. Additionally, the 1945 Constitution of the Republic of Indonesia (UUD 1945) guarantees every individual’s right to adequate housing. This article examines the compatibility of Article 7 paragraph (1) of the Public Housing Savings Law with Article 4 letter (b) of the Consumer Protection Law and Article 28H paragraph (1) of the 1945 Constitution. Using a normative juridical research method, the study analyzes primary, secondary, and tertiary legal materials on Tapera for self-employed workers from the perspectives of consumer protection and constitutional law. These materials are assessed to formulate scholarly insights presented in a constructive and argumentative manner. The study concludes that Article 7 paragraph (1) of the Public Housing Savings Law is inconsistent with the Consumer Protection Law and the constitutional guarantee of adequate housing. Accordingly, the article recommends clearly distinguishing the terms “workers” and “self-employed workers” in the law and regulating Tapera participation for self-employed workers on a voluntary basis.
