Abstract

Humans cannot live alone because they are social beings, which means they need other living things. in order to fulfill his life well and also healthy in body. So then since birth humans have been referred to as social beings. This research contains efforts to fulfill the rights of children victims of divorce from both parents which is intended to find out how to fulfill children's rights after a divorce. The research methodology used in this study is a normative juridical approach that is doctrinal or doctrinal, using bibliography or document study. The results of the research All couples definitely want a harmonious and eternal household life. However, when there are many problems that arise in the household, not a few couples choose to end their household by divorce. Divorce that occurs will raise several problems, especially if the couple has become parents.

Abstract

Abstrak Anak angkat seringkali tidak mendapat pemenuhan hak-haknya, terutama hak atas harta warisan orang tua angkatnya. Di Indonesia, seringkali terjadi sengketa waris karena anak angkat dianggap tidak berhak menjadi ahli waris dan terdapat ahli waris testamentair. Hal ini seperti yang terjadi dalam perkara Nomor 27/Pdt.G/2019/PN.Plk. Dalam perkara ini, Pasal 832 KUHPerdata disimpangi oleh Pasal 12 Ayat (1) Staatsblad Nomor 129 Tahun 1917 tentang Pengangkatan Anak, sehingga anak angkat yang telah diangkat secara sah turut mendapat bagian atas harta warisan orang tua angkatnya di samping adanya ahli waris testamentair. Tujuan dari penelitian ini untuk memahami kedudukan anak angkat dalam pembagian hak waris orang tua angkatnya menurut perspektif Kitab Undang-Undang Hukum Perdata. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian normatif atau doktrinal dengan mengangkat isu hukum yang seringkali terjadi dalam masyarakat, yaitu permasalahan sengketa dalam pembagian hak waris anak angkat. Hasil penelitian ini menunjukkan bahwa berdasarkan Kitab Undang-Undang Hukum Perdata, kedudukan anak angkat sama dengan kedudukan anak kandung terhadap warisan orang tuanya, sehingga anak angkat berhak mewaris harta warisan orang tua angkatnya secara ab intestato. Kata Kunci: Anak Angkat, Ahli waris, Hak Waris Abstract Adopted children often do not have their rights fulfilled, especially the rights to inheritance from their adoptive parents. In Indonesia, inheritance disputes often occur because adopted children are deemed not to have the right to be heirs and there are testamentary heirs. Likewise what happened in case Number 27/Pdt.G/2019/PN.Plk. In this case, Article 832 of the Civil Code is distorted with Article 12 Paragraph (1) of Staatsblad Number 129 of 1917 concerning Adoption, so that adopted children who are legally adopted also receive a share in the inheritance of their adoptive parents in addition. to the heirs of the will. The aim of this research is to understand the position of adopted children in the division of inheritance rights from their adoptive parents in terms of the Civil Code. The research method used in this research is a normative or doctrinal research method by raising legal issues that often occur in society, namely disputes regarding the distribution of inheritance rights for adopted children. The results of this research show that based on the Civil Code, the position of adopted children is the same as the position of biological children regarding their parents' inheritance, so that adopted children have the right to inherit their adoptive parents' inheritance ab intestato.
