Abstract

This research aims to find out what the law is for leaving congregational prayers without delay according to the perspective of the Syafii school of thought and the Hambali school of thought. The problems that researchers raise in this research are: First, what is the position of congregational prayer in Islam. Second, what is the law regarding leaving congregational prayers without delay according to the Syafii school of thought and the Hambali school of thought. This research is library research. This research uses a type of qualitative descriptive research (non-statistical), which focuses on the study of manuscripts and texts, using normative and comparative approach methods. The results of the research show that congregational prayer has an important position and role in Islam, congregational prayer can strengthen the bonds of brotherhood among Muslims. Apart from that, congregational prayer also has many virtues and wisdom, congregational prayer is twenty-five to twenty-seven degrees more important than praying alone. According to the Syafii school of thought, there are three opinions regarding the law of congregational prayer, some are of the opinion that it is sunnah muakadah, some are of the opinion that it is fardu kifayah and there are others that are of the opinion that the law is fardu ain, but the most valid in the Syafii school of thought is the law of fardu kifayah, while the Hambali school of thought is of the opinion that the law is fardu ain. The Syafii school of thought is of the opinion that it is not permissible to leave congregational prayers without a reason, and they are of the opinion that the prayer of someone who prays alone but in congregation is better. Meanwhile, the Hambali school of thought has different opinions regarding the law of leaving congregational prayers, the first opinion says the prayer is invalid while the second opinion says the prayer is valid but one is guilty of leaving the obligation, namely congregational prayer. It is hoped that the implications of this research will provide scientific insight and become a reference on the legal issue of leaving congregational prayers without delay.

Abstract

This research aims to determine the implementation of the rules of Laisa lī 'Irqin Ẓālim Ḥaqqun and the use of gasab land. This research uses descriptive qualitative (non-statistical) research methods in the form of library research to obtain the necessary data, namely based on phenomena that occur in society, using normative, philosophical and fiqh approaches. The results of the research show that the implementation of this rule shows that injustice does not result in the perpetrator being given the right to the injustice he has committed. So whoever seizes land and then grows crops or builds buildings in it, he has no right to own it by paying for it or leave it by paying something similar unless the owner of the land is happy with the planting or construction carried out by the usurper. It is hoped that the implications of this research will be able to provide benefits and provide additional knowledge for the community in particular and Muslims in general to be careful in using property that does not belong to them, especially using gasab land or land belonging to other people.

Abstract

The use of smartphones in the STIBA Makassar environment has the potential to cause students to tend to behave deviantly, especially in aspects of the Shari'a and its practice. With concerns about this potential, regulations limiting the use of smartphones have been established as an Islamic social control so that guidance in the STIBA Makassar environment can run as expected and be able to direct students to maintain their behavior in life. This research was conducted with the aim of analyzing the effectiveness of regulations limiting the use of smartphones in controlling student behavior at STIBA Makassar. This research uses primary data through questionnaires and a quantitative approach through descriptive statistics techniques and difference tests (paired sample t-test). The results of the research show that, in general, there has been a decrease in the frequency of smartphone use for deviant behavior. This can also be seen in the increase in the frequency level of "Never", which means that more and more students never use smartphones for deviant behavior again after the regulation was implemented. Statistically, the implemented Smartphone Use Restriction Regulations have proven to be significantly successful and effective in dealing with student behavior at STIBA Makassar.
