Abstract

Hubungan industrial Pancasila merupakan hubungan antara pemerintah, pengusaha dan pekerja yang didasarkan pada ideologi Pancasila, dengan ini selayaknya dalam pembentukan aturan yang mengenai ketenagakerjaan juga didasarkan pada Pancasila dan UUD 1945. Undang-Undang tersebut menggambarkan cita-cita hukum pekerja Indonesia yang sejalan dengan pembangunan nasional sistem ideologi Pancasila agar seluruh elemen baik pekerja, pengusaha merasakan kesejahteraan sebagaimana yang di cita-citakan seluruh masyarakat Indonesia. Karena tenaga kerja merupakan faktor yang paling kritis dalam sektor pembangunan nasional, maka sudah sepantasnya peraturan yang mengatur tentang tenaga kerja selalu di bahas dan menjadi sorotan baik pemegang kebijakan, akademisi dan para pekerja Indonesia. Bidang ketenagakerjaan masuk dalam salah satu pembahasan dalam Undang-Undang cipta kerja yang di gagas pada pemerintahan presiden Joko Widodo namun terdapat degradasi nilai kesejahteraan bagi pekerja di Indonesia, ada beberapa pergeseran muatan tentang Ketenagakerjaan, diantaranya mengenai Tenaga Kerja Asing (TKA), Perjanjian Kerja Waktu Tertentu (PKWT), alih daya (outsourcing), upah, dan sebagainya. Penelitian ini dilaksanakan di Kabupaten Brebes. Tujuan dari penelitian ini adalah untuk dapat di jadikan acuan para pemangku kebijakan sebagai bahan judicial review agar terwujud kesejahteraan bangsa.

Abstract

This study provides an overview of the state administrative law dispute surrounding the granting of clemency to Antasari Azhar, a prominent figure involved in a high-profile legal case. The controversy stems from the exercise of executive power and the application of clemency within the framework of state administrative law. Antasari Azhar, a former Indonesian Corruption Eradication Commission (KPK) chairman, was convicted in a notable corruption case. Subsequently, his request for clemency sparked debates, legal challenges, and concerns about the integrity of the administrative process. This study delves into the legal dimensions of Antasari Azhar’s clemency case, examining the constitutional and administrative law aspects involved. Key issues include the discretionary powers of the executive in granting clemency, the potential influence of political considerations, and the adherence to legal procedures during the decision-making process. The research aims to shed light on the broader implications of this case for the rule of law, the separation of powers, and the accountability of public officials. Through a comprehensive analysis of relevant legal frameworks, court decisions, and scholarly perspectives, this study seeks to contribute to the understanding of the complex interplay between executive powers and the legal principles governing clemency in the context of state administrative law. Furthermore, it addresses the implications of such disputes for the overall legal and political landscape, emphasizing the importance of transparency, due process, and accountability in the exercise of executive clemency.

Abstract

Cases of violations of ASN discipline are like an iceberg phenomenon, the number of cases that appear on the surface/reported doesn't seem that many, but of course there are still many uninformed cases, this is a concern in itself. Even though the rules contained in Government Regulation Number 53 of 2010 have been implemented concerning PNS/ASN Discipline, cases of disciplinary violations still occur. One of the reasons for the stipulation of PP No. 53 of 2010 concerning Discipline for Civil Servants as a substitute for PP no. 30 of 1980 concerning the discipline of Civil Servants due to the demands of society for improving the performance and service of civil servants in line with the implementation of bureaucratic reforms. In addition to PP No. 53 of 2010, the State Civil Service Agency (BKN) has also prepared a replacement for PP no. 10 of 1979 concerning the evaluation of the implementation of the work of civil servants, which so far is known as DP3, namely PP No. 46 of 2014.

Abstract

Trademarks play a crucial role in protecting the intellectual property rights of businesses and individuals. However, in rural and remote areas, awareness of trademark infringement and the legal mechanisms to prevent it may be limited. This study explores the use of Participatory Rural Appraisal (PRA) as an innovative approach to legal education in preventing trademark infringement, focusing on the case of Bandungan in Central Java, Indonesia. The research utilizes a mixed-methods approach, combining qualitative and quantitative data collection techniques. Through a series of workshops, surveys, and participatory activities, the study engages with the local community in Bandungan to assess their understanding of trademarks, identify potential infringement issues, and deliver legal education on trademark protection. The findings reveal that the PRA approach effectively enhances the community's awareness of trademark rights and the legal remedies available to prevent infringement. Participants actively participate in discussions, share their experiences, and collaboratively generate strategies to protect local businesses' intellectual property. Moreover, the study identifies specific challenges faced by the community in safeguarding trademarks, such as limited access to legal resources and awareness of the legal system. The research contributes to the field of legal education and rural development by highlighting the potential of PRA as a practical and community-driven method for raising awareness about trademark infringement prevention. It underscores the importance of tailoring legal education programs to the specific needs and contexts of rural communities, ultimately empowering them to protect their intellectual property rights and foster economic development.
