Abstract

Artikel ini membahas tentang kemungkinan diberlakukannya kembali UUD 1945 yang asli di Indonesia, Artikel ini berargumentasi bahwa Politik Hukum atas perubahan suatu ketentuan hukum adalah sebuah keniscayaan mengikuti perkembangan kehidupan masyarakat yang menjadi kebutuhan sesuai kondisi kekinian, Setelah mengikuti dan merasakan hasil dari 4 (empat) kali amandemen, sejak Tahun 1999 sampai dengan Tahun 2002, memunculkan kebutuhan untuk melakukan perubahan terhadap Konstitusi kita UUD NRI 1945, gagasan demi gagasan muncul dari pemikiran untuk melakukan amandemen ulang atau kita kembali ke UUD 1945 yang asli

Abstract

One of the instruments in implementing local government is the DPRD which is a regional people's representative institution. The DPRD has a Legislative Function which is carried out with the Regional Head. The legislative function of the DPRD is the function of forming regional regulations with the regional head which must be guided by what has been stipulated in Law Number 23 of 2014 concerning the Establishment of Legislative Regulations. To carry out these functions DPRD members also have certain rights, one of which is the Right of Initiative as the right to submit draft regional regulations. Regional regulations are one of the important instruments in regional government where regional regulations regulate local content specific to regions that are not regulated in the law. In 2021 the Jombang Regency DPRD has high initiative rights. However, in 2022 - 2023 the use of the initiative rights of the Jombang Regency DPRD will decline drastically. The purpose of this study was to find out and analyze the implementation of the legislative function of the Jombang Regency DPRD. (1). What is the role of the legislative function of the Jombang district DPRD in 2022-2023, is there an initiative proposal from the DPRD? (2). What are the factors and obstacles in carrying out the legislative function of the proposed DPRD initiative? This research uses a library research type that examines various documents related to research. The method used by the author is a normative juridical writing method using a statute approach and a material approach using the DPRD's code of ethics. This research is limited by two research focuses, namely (1) what is the role of the legislative function of the Jombang Regency DPRD in 2022-2023, there are proposals for initiatives from the DPRD (2) what are the supporting and inhibiting factors in carrying out the legislative function of the DPRD initiative proposal? Furthermore, there are two legal materials used in this study, namely primary legal materials, secondary legal materials. The results of this study indicate that the formation of regional regulations includes four stages, consisting of; assessment stage, planning stage, discussion stage, and validation stage. From the results of the study it was also found that in the legislative function process the DPRD during 2022-2023 experienced a setback where the DPRD became increasingly passive. The right of initiative is reduced until it is not used at all. However, the process of implementing its legislative function has been carried out in accordance with the applicable laws and regulations. However, there are still obstacles that affect the legislative function of the DPRD, including inadequate human resources, delays in the process of establishing the RAPERDA, and lack of community involvement. Abstract

Zakat, infaq and shadaqah (ZIS) are official institutions in Islamic law which relate to the property rights of a person or legal entity which have the value of worship as well as social and humanitarian charities which are useful for the welfare of mankind, maintaining security and socio-economic balance, while improving human and societal development as a whole. In Law Number 38 of 1999 concerning zakat, Article 1 explains that zakat is property that must be set aside by a Muslim or an entity owned by a Muslim in accordance with religious provisions for given to those who are entitled to receive it. Zakat imposed on salaries received by civil servants (PNS) is a type of professional zakat because it is imposed on workers' income due to their profession. As for income that is subject to zakat on the salary received for civil servants (PNS) if it has reached the nisab (the minimum amount of assets to be subject to zakat), namely 2.5% or has fulfilled the time specified according to Islamic law. Even though implementation still experiences problems and obstacles due to a lack of awareness about zakat on salaries received by civil servants (PNS), the government is obliged to collect and manage zakat, infaq and Islamic alms in a professional, honest, trustworthy and transparent manner so that The potential for zakat, infaq and alms (ZIS) which is quite large in society can be explored optimally. By creating and establishing zakat amil institutions (LAZ) in each Department or Government Agency based on the applicable laws regarding zakat management, namely Law Number 38 of 1999, so that it can improve community welfare, especially in the socio-economic field. Utilization of professional zakat proceeds will be better if it is carried out productively and managed professionally, in addition to some of it being for consumptive purposes for mustahik, especially poor and destitute groups.

Abstract

Kasus perceraian meningkat setiap tahun di Kabupaten Jombang Jawa Timur. Penelitian ini bertujuan mengetahui permasalahan dan penyebab perceraian pada tahun 2024 di Pengadilan Agama Kabupaten Jombang Jawa Timur dengan menggunakan pendekatan kualitatif dan metode studi kasus. Teknik pengumpulan data pada penelitian ini yaitu wawancara, observasi, dan dokumentasi. Hasil penelitian menunjukkan terdapat dua faktor utama penyebab terbanyak yaitu faktor perselisihan dan pertengkaran terus-menerus serta faktor ekonomi. Faktor perselisihan dan pertengkaran terus-menerus disebabkan oleh pengabaiakan kewajiban rumah tangga, permasalahan finansial, KDRT, ketidakcocokan masalah seksual, timbul rasa curiga dan cemburu serta ketidakcocokan secara berlebihan, berkurangnya perasaan cinta, tidak ada toleransi antar pasangan, memiliki kekasih lain dan terdapat penyebab lain seperti perasaan tidak di hargai serta krisis kepercayaan pada pasangan. Sedangkan faktor ekonomi disebabkan oleh pengabaian kewajiban rumah tangga, judi, berkurangnya perasaan cinta pada pasangan, tidak ada toleransi antar pasangan serta penyebab lain seperti komunikasi yang buruk
