Abstract

ABSTRACT Mudharabah is one of the contracts in the sharia economy that is able to accommodate financing activities for micro business actors. In fact data from the OJK, Mudharabah contracts are still classified as minority contracts in Indonesian Islamic financial institutions. This is because the process is considered more risky and difficult so it is less strategic when applied to financial institutions. Interestingly, one of the BMT operating in Kuningan, West Java, BMT NU Sejahtera carries a financing product with this profit sharing contract. Using qualitative research methods, the authors examine the implementation of Mudharabah contracts in this BMT. From the results of the study it was found that in practice of the contract, there are still things that are not in accordance with sharia principles, such as fixed monthly installment payments, collateral requirements and if the customer suffers a loss, payments are still made even though only the principal. This discrepancy with the Shari'a is understood as an attempt by the BMT to minimize risk. Hopefully in the future, all of Islamic financial institutions and the community can both understand fiqh muamalah so that the practice of contracts in Islamic economics can be carried out purely according to the Shari'a.

Abstract

 The presence of the Indonesian Sharia Finance Master Plan 2019-2024 and the enactment of Law No. 33 of 2014 concerning Halal Product Guarantee is a regulation from the government related to strengthening the halal industry and guarantees the circulation of a variety of halal products, especially pharmaceutical products. Medicines that enter the body are punished just like food, so the halal and thayyyib aspects are a part that cannot be ignored. But the fact is that there are still substances and illicit media used to make medicines and only a few pharmaceutical products that have been halal certified by MUI. Therefore, as Muslims we must understand the importance of consuming halal medicines and also recognize prophet-style medicine (tibbun nabawi) as a form of implementing the halal lifestyle as well as endeavors in maintaining health.This study uses a qualitative method with literature study and interview approaches to get the information studied.Hadirnya Masterplan Keuangan Syariah Indonesia 2019-2024 dan mulai diberlakukannya Undang-Undang No. 33 Tahun 2014 tentang Jaminan Produk Halal merupakan regulasi dari pemerintah terkait penguatan industri halal dan penjaminan beredarnya beragam produk halal, terutama produk farmasi. Obat-obatan yang masuk ke dalam tubuh dihukumi sama seperti makanan, karenanya aspek kehalalan dan thayyyib-nya menjadi bagian yang tidak bisa diabaikan. Namun faktanya masih ada kandungan zat haram yang digunakan untuk membuat obat-obatan dan baru sedikit produk farmasi yang sudah tersertifikasi halal oleh MUI. Penelitian ini menggunakan metode kualitatif yang menunjukkan bahwa literasi obat halal yang masih rendah sehingga perlu lebih disosialisasikan dan mulai terbangunnya kesadaran masyarakat tentang keberadaan thibbun nabawi sebagai ikhtiar untuk mendapatkan kesembuhan dan kesehatan.
