Abstract

Construction contracts in Indonesia must meet the minimum regulatory points as mandated in Law No.2 of 2017 concerning Construction Services (UUJK 2/2017). The purpose of this regulation is to ensure that the structure of the construction service business in Indonesia guarantees equal rights and obligations between cooperating parties. The results of the preliminary study in UUJK 2/2017, did not find any form of supervision and sanctions for not fulfilling the minimum points so that it has the potential to cause insecurity of the parties' equality. This study aims to describe the efforts of the parties in drafting and the inclusion of minimum points in the contract. The method used is interviews with intermediate qualification contractors in Purbalingga and Banyumas Regencies (case study) and reviewing contract samples regarding the minimum points that must fulfill under UUJK 2/2017. The results showed that the efforts of the parties in drafting the terms of the contract were quite good with the contract drafting mechanism from service users. The service provider then observes and provides input in the form of corrections, deletions, or additional provisions and then negotiated with the service user to be decided together. The percentage of the inclusion of 16 points of the minimum contract provisions is 89.47% of the 19 contract samples. 2 regulatory points are not fulfilled as significant, namely related to building failure and environmental aspects with a percentage of 84.21%. The information obtained is supposed to provide an overview in applying the relevant regulations and theirderivatives. Keywords: construction contract; minimum contract provision; UUJK 2/2017

Abstract

Perkembangan praktik jaminan gadai telah menjadi bagian integral dari sejarah ekonomi dan keuangan global. Di Indonesia, praktik jaminan gadai diatur berdasarkan Ketentuan Hukum Perdata dan peraturan-peraturan turunannya, sementara di Australia, regulasi jaminan gadai terintegrasi dalam Personal Property Securities Act 2009 (PPSA) serta regulasi khusus di tingkat negara bagian. Perbandingan ini akan mengungkap persamaan dan perbedaan dalam penerapan praktik jaminan gadai antara kedua negara yang signifikan dalam regulasi, prosedur pendaftaran, prioritas klaim, dan perlindungan hukum bagi para pihak yang terlibat dalam transaksi jaminan gadai. Metode pendekatan komparatif digunakan untuk menganalisis kerangka hukum perdata yang mengatur praktik jaminan gadai di kedua negara tersebut, menyoroti evolusi dan adaptasi kedua sistem hukum terhadap perubahan zaman, ekonomi, serta teknologi. Penelitian ini menekankan pentingnya jaminan gadai dalam mendukung perekonomian, baik sebagai sumber keuangan sehari-hari di negara berkembang maupun sebagai bagian dari sistem keuangan yang lebih kompleks di negara maju. Peran jaminan gadai tidak hanya sebagai alat keuangan, tetapi juga sebagai instrumen untuk meningkatkan kepastian hukum dan mendorong pengembangan ekonomi di masing-masing konteks hukum. Pemahaman terhadap perbandingan praktik jaminan gadai antara Indonesia dan Australia tidak hanya memberikan wawasan tentang perbedaan sistem hukum perdata, tetapi juga implikasinya terhadap dinamika ekonomi global saat ini. Studi ini diharapkan dapat memberikan kontribusi dalam konteks akademik serta praktis, terutama bagi pihak yang terlibat dalam transaksi keuangan lintas batas di kedua negara tersebut, serta pentingnya melakukan upaya perbaikan dan mengembangkan kerangka regulasi yang mendukung keberlangsungan dan kemajuan ekonomi global serta.Kata Kunci: Perbandingan; Praktik Jaminan Gadai; Hukum Perdata.

Abstract

The development of transactions through crypto assets is one of the practices carried out in the digital business world. The existence of transactions through crypto assets makes the state regulate and supervise crypto assets. One of the legal policies carried out by the state is to supervise crypto asset transactions by the OJK institution. This study aims to answer two legal issues, namely the implications of regulating crypto asset supervision after the passing of the Law No. 4 of 2023 on Financial Sector Development and Strengthening (PPSK Law) and the orientation of crypto asset supervision after the passing of the PPSK Law from a law perspective as a tool of social engineering. This research is normative legal research by prioritizing conceptual and statutory approaches. The results of the study confirm that the implications of supervising crypto assets after that is to make the existence and position of CoFTRA as a supervisor of transactions using crypto assets increasingly lead to ambiguity because the authority regarding the supervision of crypto assets becomes the authority of the OJK. The orientation of oversight of crypto assets in the perspective of law as a social engineering can be seen that the substance of oversight of crypto assets by the OJK aims to carry out community engineering, namely in the form of future efforts so that the community can optimize crypto asset transactions to increase the strengthening of national finance and to give the public a sense of security for transactions crypto assets carried out, the state took the initiative to formulate oversight of crypto assets by OJK because OJK is considered the right and appropriate institution in efforts to regulate and supervise crypto asset transactions.
