Abstract

ABSTRACTWidespread human interaction in the world provides opportunities for marriage between different nations of citizenship. Intermarriage is not uncommon among nations raises a problem, in terms of one's country of origin where the country in which she gave birth or born adopts the same nationality, it will not cause problems. However, when the two countries concerned have different systems, they can lead to circumstances that cause a person holds the status double nationality (bipatride) or instead became stateless altogether (apatride).The issue of citizenship and non-citizenship, whether it concerns the procedure of obtaining and losing citizenship that is behind the author to do this research. This study aimed to analyze the concept of citizenship that apply in the constitutional system of the Republic of Indonesia and also to analyze the loss of citizenship based on Law No. 12 of 2006 on Citizenship of the Republic of Indonesia. To achieve this goal, this research is done by using normative legal research method with prescriptive model. The collected legal material will be studied comprehensively and analyzed deductively by systematic presentation.The results of research and discussion concluded that: First, the concept of citizenship in the constitutional system prevailing in Indonesia based on Law No. 12 of 2006 on Citizenship of the Republic of Indonesia has to clarify and reinforce the position and legal certainty for every citizen of Indonesia, which is in conformity with mandated in the provisions of Article 26 paragraph (1) and Article 6 paragraph (1) of the Constitution of the Republic of Indonesia Year 1945. Second, the loss of citizenship of the Republic of Indonesia based on Law No. 12 of 2006 on citizenship of the Republic of Indonesia may occur due to loss of citizenship by itself, Loss of citizenship with a request, and loss of citizenship due to a marriage. In addition, based on the analysis of jurisdiction over the events lose citizenship Arcandra Tahar and Gloria Natapradja Hamel, it can be concluded that in accordance with the legislation on citizenship of the Republic of Indonesia, materially Arcandra Tahar has no citizenship and against Gloria Natapradja Hamel is a juridicial as a foreign citizen.Keywords : Republic of Indonesia, Citizenship, Losing Citizenship

Abstract

The implementation of regional government requires supporting facilities and infrastructure for the smooth implementation. One of them is adequate transportation facilities. Therefore, the local government provides official vehicles for commitment and responsibility in giving attention and concern to duties of the state civil apparatus implementation. This study aims to formulate urgency of leasing operational service vehicles in the Keerom District Government. This study uses normative legal research as research method. The legal material obtained will describe and relate in such a way that it is presented in a more systematic writing to answer problems that have been formulated. Result shows the procurement of official vehicles was chosen through the rental process to minimize expenditure in the context of budget economy, effectiveness, and efficiency. Rental official vehicles in the Keerom Regency Government function as a support for regional government in achieving targets as its responsibility to provide welfare for community. Keywords: local government; operational service vehicles; rental

Abstract

The law should govern the dynamics of the nation and state life in an ideal country. For instance, Indonesia is a constitutional state that subjects to legal supervision based on the 1945 Constitution for state administration. Public policies are used as guidelines and references for actions, including financial management. However, regulations as the basis for regional financial management need to be adjusted to suit the dynamics in legal condition development and the community needs. Government Regulation Number 12 of 2019 is an improvement to Government Regulation Number 58 of 2005 on Regional Financial Management used as a reference in formulating regional financial management rules. This study examines the evaluation of the readiness to implement Government Regulation Number 12 of 2019 as the basis for regional financial management. The method used in this study is a normative legal research method. The legal materials source from primary and secondary legal material. The method in presenting this research result is deductive method. This study shows that financial management is a government responsibility in exercising regional power. The urgency of drafting a Regional Regulation on financial management is motivated by changes in legal dynamics and community needs for its management. Furthermore, there is a need for evaluation of the regulation improvement for effectiveness. In conclusion, the effectiveness and efficiency of regional financial management should be evaluated after Government Regulation Number 12 of 2019 is applied. The regulations need to be disseminated for the wider community response to be identified for evaluation of improvements and adjustments to its needs.

Abstract

Perkembangan praktik jaminan gadai telah menjadi bagian integral dari sejarah ekonomi dan keuangan global. Di Indonesia, praktik jaminan gadai diatur berdasarkan Ketentuan Hukum Perdata dan peraturan-peraturan turunannya, sementara di Australia, regulasi jaminan gadai terintegrasi dalam Personal Property Securities Act 2009 (PPSA) serta regulasi khusus di tingkat negara bagian. Perbandingan ini akan mengungkap persamaan dan perbedaan dalam penerapan praktik jaminan gadai antara kedua negara yang signifikan dalam regulasi, prosedur pendaftaran, prioritas klaim, dan perlindungan hukum bagi para pihak yang terlibat dalam transaksi jaminan gadai. Metode pendekatan komparatif digunakan untuk menganalisis kerangka hukum perdata yang mengatur praktik jaminan gadai di kedua negara tersebut, menyoroti evolusi dan adaptasi kedua sistem hukum terhadap perubahan zaman, ekonomi, serta teknologi. Penelitian ini menekankan pentingnya jaminan gadai dalam mendukung perekonomian, baik sebagai sumber keuangan sehari-hari di negara berkembang maupun sebagai bagian dari sistem keuangan yang lebih kompleks di negara maju. Peran jaminan gadai tidak hanya sebagai alat keuangan, tetapi juga sebagai instrumen untuk meningkatkan kepastian hukum dan mendorong pengembangan ekonomi di masing-masing konteks hukum. Pemahaman terhadap perbandingan praktik jaminan gadai antara Indonesia dan Australia tidak hanya memberikan wawasan tentang perbedaan sistem hukum perdata, tetapi juga implikasinya terhadap dinamika ekonomi global saat ini. Studi ini diharapkan dapat memberikan kontribusi dalam konteks akademik serta praktis, terutama bagi pihak yang terlibat dalam transaksi keuangan lintas batas di kedua negara tersebut, serta pentingnya melakukan upaya perbaikan dan mengembangkan kerangka regulasi yang mendukung keberlangsungan dan kemajuan ekonomi global serta.Kata Kunci: Perbandingan; Praktik Jaminan Gadai; Hukum Perdata.

Abstract

Aceh is known for its culture, which is closely related to Islamic laws. Islamic law itself developed in Aceh since the beginning of the entry of Islam into the archipelago, which began with the kingdom of Samudera Pasai. Since then, Islamic law has become the basis for the norms and rules of law that apply to the land of Rencong, which ultimately affects the life of society in Aceh. This foundation has become the motto and philosophy of life of the Acehnese people in the westernmost province of Indonesia, namely “hadih madja, adat ngon syari'at lagee dzat ngon sifeut” which means that sharia law and adat are like substance and nature. The customs and culture of the Acehnese people are diverse and correspond to the ethnic sections of each region in Aceh. This diversity reflects the richness and ethnic diversity of the Acehnese population. Customary law, in line with the implementation of Islamic Law applied in Aceh, has transformed into a unifying and adhesive in the structure and parts of the life of the Acehnese community, which in turn can serve as capital in the development structure in Aceh. Therefore, the joints and values of Aceh's customs and culture must be preserved, empowered, and cared for in the frame of unity and unity of social life towards the end of Aceh's special autonomy in 2027. This study discusses the perspective and role of customary law in Aceh, the definition of adat and customary law in terms of terminology, and the history of the application of adat and customary law in Aceh.

Abstract

Penelitian ini bertujuan untuk menganalisis bagaimana implikasi Putusan Mahkamah Agung Nomor 46 P/HUM/2018 terhadap mantan narapidana dapat menjadi calon legislatif dalam penyelenggaraan Good Governance. Penelitian menunjukan bahwa demi mewujudkan suatu pemerintahan yang baik (good governance) di Indonesia berdasarkan konsep negara demokrasi yang senantiasa melibatkan rakyat, serta jaringan pembuatan suatu keputusan melibatkan banyak unit politik. Hasil Putusan MA Nomor 46 P/HUM/2018 merupakan norma baru yaitu pemulihan kembali hak-hak dan kebebasan orang yang telah menjalani hukuman dan tidak membatasi hak konstitusional dijamin Pasal 28 UUD NRI Tahun 1945, dan dalam Pasal 43 ayat (1) UU Nomor 39 Tahun 1999 tentang Hak Asasi Manusia Sebuah keniscayaan bahwa pencalonan anggota legislatif harus berasal dari figur yang bersih dan tidak pernah memiliki rekam jejak cacat dalam berintegritas. Namun pengaturan terhadap pembatasan hak politik seseorang harus berdasarkan undang-undang, bukan diatur dalam peraturan perundang-undangan di bawah undang-undang sebagaimana Peraturan Komisi Pemilihan Umum oleh Lembaga KPU.

Abstract

This research addresses the critical necessity of reassessing minimum wage policies with a spotlight on their effects on workers’ justice and welfare. Through the examination of existing policy trends and frameworks for setting wages, the study aims to advocate for a more equitable wage formula that strengthens the government’s role in safeguarding worker interests while ensuring business sustainability. A significant aspect of this investigation is the recent change in wage-setting authority brought about by Government Regulation No. 51 of 2023, which shifts wage-setting power back to a centralized position. Current legal wage policies are not benefiting workers sufficiently, calling for a comprehensive review to design a fair and effective wage framework. The results indicate that with the aim of fairness, the existing minimum wage structure does not guarantee adequate welfare for workers. The study also points out the constrained flexibility of the “alpha” parameter, limiting the wage negotiations between employers and unions to a narrow range of 0.1-0.3. By shedding light on the shortcomings of this policy, this research emphasizes the urgent need for a revised wage formula that genuinely reflects workers’ welfare, representing a shift towards reconciling economic goals with social equity within formal wage policies. An equitable wage should align with the value of the work performed, factoring in difficulty levels, responsibilities, and required skills, while not being below the regional minimum wage.
