Abstract

The dynamic development of mandate as a contract that brings forth representation is disaccord with the definition and norm of lastgeving under Indonesian Civil Code. This research has a goal to unravel such issue by pointing out of that there is a need for repositioning in the form concept renewal for the definition and norm of mandate contract under Indonesian Civil Code that is line with our philosophical foundation (rechtsidee), which is Pancasila. Juridical normative methodology carries out of the repositioning by examining the principles, its own concept as a postivie law and meta juridical, and with the help of comparative law, lastgeving and volmacht can be clarified by compaing the two terms and its rules under Indonesian Civil Code and Dutch Law.

Abstract

Notaris dalam menjalankan jabatannya harus sangat menjunjung tinggi kehati-hatian agar meminimalisir terjadinya pelanggaran maupun konflik dikemudian hari. Kewenangan yang dimiliki Notaris sebagai pejabat publik diatur oleh Undang-undang Nomor 2 Tahun 2014 tentang Perubahan atas Undang-undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris. Produk yang dibuat oleh Notaris harus dibuat dengan tepat agar dapat dipercaya menjadi alat bukti yang sah jika suatu saat terdapat sengketa berkenaan dengan akta yang dibuat. Akta yang dibuat Notaris sering kali menimbulkan konflik bagi para pihaknya, untuk dalam memecahkannya para penyidik perlu untuk meminta Akta yang dibuat dan juga memeriksa Notaris terserbut. Notaris adalah jabatan yang memiliki tugas untuk menjaga rahasia dari setiap kliennya, sehingga tidak serta merta Akta yang dibuat dapat dibuka dan juga diperiksa oleh penyidik. Notaris memiliki Majelis Kehormatan Notaris yang dapat memeriksa terlebih dahulu dan memberikan keputusan diizinkan atau ditidaknya Akta tersebut diberikan salinannya serta Notaris tersebut dimintai keterangan.

Abstract

Development in Indonesia emphasizes the need for funds for productive projects, including foreign investments. However, limitations on share ownership have led to the practice of nominees in limited liability companies. This research analyzes the validity of nominee agreements and the synchronization of relevant regulations in Indonesia. The research method employed is descriptive analytics with a normative juridical approach. The findings indicate that the nominee practice, despite its common use, may violate regulations, particularly prohibitions on agreements declaring share ownership on behalf of others. In conclusion, this research highlights the complexity and challenges of regulating nominee practices within the existing regulatory framework in Indonesia.

Abstract

Notaries as public officials in carrying out their positions must comply with the Law on Notary Positions and the Notary Code of Ethics. The implementation of administrative sanctions against notaries who have violated their position is the authority of the Notary Supervisory Council and the Minister of Law and Human Rights. MPN in imposing sanctions on notaries cannot act arbitrarily. In the Decision of the State Administrative Court No. 235/G/2019/PTUN.KT, the MPN imposes sanctions for dishonorably dismissing a notary for violations in the form of signing a deed outside the Notary's office area, not providing a copy of the deed to the parties, and in carrying out his or her position not acting in a trustworthy, honest, thorough and effective manner. independent. In this case, the author examines whether the administration of administrative sanctions carried out by MPN is in accordance with the Law on Notary Positions and the Regulation of the Minister of Law and Human Rights concerning Procedures for Imposing Administrative Sanctions. This research is normative legal research which is known as research for academic purposes. namely the process of searching for legal rules, legal doctrines, and legal principles to answer the legal issues being discussed.
