Abstract

Cryptocurrencies is generally used as means of payment and assets. Every country in the world has its own approach in regulating the use of cryptocurrencies. In Indonesia, the use of cryptocurrency as a means of payment is not justified. Meanwhile, its use as an asset is the subject of commodity futures trading whose mechanism is carried out by the existence of an agreement and its activities by Badan Pengawas Perdagangan Berjangka Komoditi (Bappebti). The potential for cryptocurrency growth in Indonesia can be maximized considering the advantages it offers, such as easy access, security, and financial inclusion that can help equalize access to quality formal financial services on time, smoothly, and safely at affordable costs according to the needs and abilities in improving people's welfare. In order to encourage the positive growth of cryptocurrencies in Indonesia, the government as the regulator must ensure the realization of cryptocurrencies that are safe, structured, and stable. Abstract

The transition of the land registration system from conventional methods to digital forms is a strategic step in the modernization of Indonesia's land administration. This policy is based on the Cipta Kerja Law and Minister of ATR/BPN Regulation No. 3 of 2023, which aims to improve efficiency, transparency, and legal certainty in land services. This study analyzes the challenges faced by practitioners, particularly Notaries and PPATs. Through a qualitative approach, the study identifies the main challenges, including inadequate updating of legal and physical data, limitations in technological infrastructure, low digital literacy among the public, and potential cybersecurity threats. Recommendations for improving the electronic land certification system include the need to refine the system and enhance human resource capacity, human resources, strengthening infrastructure and information technology, implementing blockchain technology to ensure data security, and conducting systematic socialization and digital literacy programs. This system transformation, if supported by a comprehensive risk mitigation strategy, has the potential to accelerate bureaucratic reform and improve the national investment climate.

Abstract

Penelitian ini membahas dampak hukum dari praktik merger dan akuisisi bank lintas negara di Indonesia dalam konteks liberalisasi dan integrasi perbankan. Sejak ratifikasi perjanjian GATT dan WTO pada 1994, liberalisasi perbankan telah membuka peluang bagi pengambilalihan bank oleh investor asing, yang memengaruhi struktur kepemilikan dan operasional bank. Penelitian ini menganalisis tantangan dan peluang terkait regulasi yang berlaku, seperti UU Perbankan dan peraturan pemerintah tentang penggabungan dan akuisisi perseroan. Meskipun ada tantangan dalam perbedaan regulasi antar negara dan potensi risiko monopoli, merger dan akuisisi lintas negara dapat meningkatkan efisiensi, memperkuat integrasi keuangan global, serta menarik investasi asing yang mendukung perekonomian Indonesia.
