Abstract

Penelitian ini bertujuan untuk menginvestigasi pengaruh gaya kepemimpinan dan disiplin kerja terhadap kinerja karyawan di Batik Modifikasi Mulie.Id Jakarta. Persaingan bisnis yang intens dan perkembangan pesat dalam dunia bisnis menekankan pentingnya peran sumber daya manusia (SDM) dalam sebuah perusahaan. SDM dianggap sebagai kemampuan terpadu dari daya pikir dan daya fisik individu, menjadi aspek krusial yang mendukung kelancaran operasional dan pencapaian tujuan perusahaan. Kinerja karyawan dianggap krusial dalam menentukan maju mundurnya suatu perusahaan. Kinerja didefinisikan sebagai hasil kerja dalam kualitas dan kuantitas yang dicapai oleh karyawan sesuai dengan tanggung jawab yang diberikan. Faktor-faktor seperti disiplin kerja, gaya kepemimpinan, dan motivasi berperan penting dalam membentuk kinerja karyawan. Penelitian ini mengambil lokasi di Batik Modifikasi Mulie.Id, Jakarta, dan dilakukan pada periode Oktober 2022 hingga Januari 2023. Populasi penelitian melibatkan seluruh 30 karyawan di perusahaan tersebut. Metode pengambilan sampel menggunakan teknik sensus atau sampling total, melibatkan seluruh anggota populasi sebagai responden. Pengumpulan data dilakukan melalui wawancara dan angket. Analisis data dilakukan dengan metode kuantitatif, termasuk uji validitas, uji reliabilitas, regresi linier sederhana, analisis korelasi, koefisien determinasi, dan uji hipotesis. Hasil penelitian ini diharapkan dapat memberikan pemahaman yang lebih dalam tentang bagaimana gaya kepemimpinan dan disiplin kerja mempengaruhi kinerja karyawan di Batik Modifikasi Mulie.Id. Implikasi dari penelitian ini dapat membantu perusahaan dalam meningkatkan strategi manajemen sumber daya manusia, memperbaiki gaya kepemimpinan, dan memperkuat disiplin kerja untuk meningkatkan kinerja karyawan.

Abstract

The study purpose was This study aims to analyze the legal responsibility of notaries involved in price mark-up practices in land acquisition compensation, examining both juridical and practical aspects. This research employs a normative juridical approach, using statutory and doctrinal legal materials, combined with a case study analysis of land acquisition disputes involving notarial participation. Data were collected from laws, regulations, academic literature, and legal cases, then analyzed qualitatively to identify patterns of legal liability and compliance issues. Findings indicate that notaries who participate in price mark-up practices may be held civilly and administratively liable under the Notary Law, particularly when failing to act in accordance with their duties of accuracy, transparency, and legality. Case studies demonstrate that such practices often involve misrepresentation of land values, causing financial harm to landowners and potential conflicts with government acquisition standards. The research also highlights gaps in enforcement, emphasizing the need for stronger oversight and clearer procedural guidelines. Notaries bear significant legal responsibility in land acquisition compensation, and their involvement in price mark-up practices constitutes a breach of professional and legal duties. Ensuring strict adherence to notarial obligations is essential to protect public trust, prevent exploitation, and uphold the integrity of land acquisition processes in Indonesia.

Abstract

According to Law No. 5 of 1960 concerning Basic Agrarian Principles (known as UUPA), enacted on September 24, 1960, this law serves as the implementation of Article 33, Paragraph (3) of the 1945 Constitution of Indonesia. The UUPA lays the foundation for agrarian law reform to provide legal certainty for the public, thereby preventing land disputes. If certain requirements are not met, the National Land Agency will not issue a land ownership certificate. However, Indonesian citizens still have the right to obtain a legitimate land ownership certificate by gathering evidence and witnesses to strengthen their case, thus persuading the BPN to issue the certificate in accordance with the land and property they rightfully own.In practice, however, there are still many issues related to the National Land Agency reluctance to issue certificates due to various problems. The research questions addressed in this study are: What constitutes unauthorized acts by the National Land Agency in issuing certificates? And what is the legal certainty of land ownership certificates concerning court decisions on unauthorized acts by the National Land Agency? The theories used in this research include the theory of dispute resolution by Yahya Harahap and the theory of legal certainty by Jan Michael Otto.  The research method employed is a normative juridical approach, involving legal literature or secondary data, with sources including primary, secondary, and tertiary legal materials. The research approach used includes legislative, conceptual, analytical, and case study approaches. The technique for collecting legal materials involves identifying and inventorying positive legal rules, literature, books, journals, and other legal sources. The analysis of legal materials is conducted through systematic, grammatical interpretation, and analogical construction.  The results of the research indicate that the resolution of disputes involving unauthorized acts by the National Land Agency, specifically the refusal to issue land ownership certificates, is conducted through litigation by filing a lawsuit against the National Land Agency in the district court. The legal certainty for the original owner of the land ownership certificate, whose request for a new certificate was denied by the National Land Agency, is that they are entitled to a new certificate issuance if there is supporting evidence and witnesses proving the rightful ownership of the certificate. To secure this legal certainty, the original certificate owner must provide concrete evidence and witnesses affirming that the land indeed belongs to them, in accordance with the documents they possess, supporting their legitimate ownership of the land certificate
