Abstract

Pasal 65 UUHC mengatur bahwa pencatatan hak cipta logo tidak lagi bisa dilakukan apabila logo tersebut telah digunakan sebagai merek, tetapi banyak pencatatan hak cipta logo yang terdaftar sebagai merek berhasil dilakukan. Hal ini menimbulkan ketumpulan penerapan Pasal 65 UUHC. Penelitian ini bertujuan untuk memperoleh kepastian hukum penerapan dan eksistensi Pasal 65 UUHC. Penelitian ini dilakukan dengan metode yuridis normatif. Hasil penelitian ini menunjukan bermuara pada benturan prinsip deklaratif hak cipta dengan Pasal 65 UUHC. Di sisi lain, pada dasarnya Pasal 65 UUHC memisahkan pelindungan hak cipta logo dan merek, yang artinya apabila suatu logo telah terdaftar sebagai merek, rezim hukum merek lah yang berlaku. Oleh karena itu, pencatatan hak cipta logo yang telah terdaftar sebagai merek tidaklah memiliki kekuatan hukum. Untuk memberikan penguatan kepastian hukum, perlu dilakukan upaya memperjelas pengaturan tumpang tindih pelindungan ini dengan menghapus Pasal 65 UUHC, atau justru memperkuat dengan dengan mengubah frasa “digunakan sebagai merek” dengan “didaftarkan sebagai merek”, atau setidaknya dimaknai demikian. Selain itu, diperlukan juga upaya integrasi Pasal 65 UUHC dengan UUMIG, serta optimalisasi peran DJKI dan peningkatan kesadaran masyarakat adanya Pasal 65 UUHC tersebut. Kesimpulan Penelitian ini menemukan bahwa penerapan Pasal 65 UUHC inkonsisten karena masih banyak pencatatan yang berhasil dilakukan meskipun memenuhi unsur Pasal 65 UUHC.

Abstract

Cinematographic work is protected by law under the Copyright Law No. 28 of 2014 in Indonesia. The fundamental principle is that the Creator is entitled to fair remuneration for the use of their work, in line with the alter-ego concept that gives the highest position to the Creator. In contrast to Indonesia, Germany has clearly regulated the procedures for the collection, management, and distribution of remuneration through the Urheberrechtsgesetz and the Collective Management Organization (CMO) operating with authorization from the Creator. The research method used is juridical-normative with a descriptive analysis approach. This study applies a comparative legal approach, utilizing data from both conventional and online literary sources, as well as interviews. The research findings indicate that Indonesia does not yet have specific regulations to protect the economic rights of digital cinematography. The absence of a Collective Management Organization (CMO) leads to an imbalance in licensing agreements between the Creator and digital platforms as users of cinematographic works.

Abstract

In the context of a knowledge-based economy, intellectual property (IP) has emerged as a critical asset for business competitiveness, yet it remains inadequately recognized in Indonesia’s bankruptcy law. Trademarks, copyrights, and patents key components of IP are often excluded from the core bankruptcy estate due to legal ambiguity and the absence of standardized valuation and management procedures. This research aims to reconstruct Indonesian bankruptcy law to better integrate IP as a vital economic asset in insolvency proceedings. Utilizing a descriptive-analytical method with a juridical-normative approach, this study draws upon doctrinal sources and empirical data collected through interviews with legal practitioners and bankruptcy receivers. The findings reveal that current legal structures fail to reflect the real economic value of IP, resulting in underutilized assets and prolonged legal disputes, as exemplified by the Nyonya Meneer case. The study concludes that reform is urgently needed to incorporate IP into the bankruptcy framework, not only as an asset with immediate monetary value but also as a tool for post-bankruptcy recovery and sustainability. A revised legal framework would ensure equitable treatment for both creditors and debtors and align national insolvency policies with the evolving dynamics of global commerce and innovation.
