Abstract

Hadirnya teknologi digital semakin memudahkan manusia dalam menciptakan konten kreatif secara tanpa batas, misalnya dalam mengabadikan karya-karya cipta yang berada di ruang publik dan kemudian dapat menggunakannya secara komersil ataupun non-komersil ke dalam platform ataupun media online. Hal tersebut menimbulkan permasalahan yakni bagaimana apabila karya cipta di ruang publik yang diabadikan dan diunggah ke dalam media-media online tersebut dikategorikan sebagai pelanggaran hak cipta. Dimana di beberapa negara, mengambil potret suatu karya cipta di ruang publik hanya dapat dilakukan di bawah ketentuan Freedom of Panorama. Tujuan dari penelitian ini yaitu diketahuinya sejauh mana UUHC dapat melindungi karya cipta yang ada di ruang publik, serta diketahuinya upaya pencegahan pelanggaran yang dilakukan oleh pemerintah dan penyedia platform terhadap karya cipta yang ada di ruang publik atas konten yang diunggah. Penelitian ini bersifat deskriptif analitis dengan menggunakan metode pendekatan yuridis normatif. Hasil penelitian menyatakan bahwa pada dasarnya UUHC belum mengatur mengenai Freedom of Panorama dan pelindungan karya cipta yang ada di ruang publik, serta upaya pencegahan pelanggaran yang dilakukan oleh pemerintah dan penyedia platform juga belum secara maksimal dalam memberikan pelindungan terhadap karya cipta yang ada di ruang publik atas konten yang diunggah.

Abstract

Kemunculan Covid-19 pada bulan Maret tahun 2020 di Indonesia membuat para inventor mengembangkan inovasi, salah satunya yaitu pembuatan vaksin Covid-19. Para inventor sudah selayaknya diberikan hak ekonomi atas pemanfaatan vaksinnya, terutama karena vaksin ini digunakan bagi kepentingan masyarakat luas. Mengacu pada dasar pemikiran tersebut, penelitian yang dilaksanakan oleh penulis bertujuan untuk menentukan status kepemilikan paten terhadap invensi vaksin Covid-19 dan mekanisme perlindungan hak ekonomi bagi pemegang paten atas vaksin Covid-19 agar tetap dapat terpenuhi berdasarkan Undang-Undang Nomor 13 Tahun 2016 tentang Paten. Penulis menggunakan metode deskrisptif-analitis dengan memakai pendekatan yuridis normatif serta menganalisis data dengan metode kualitatif. Pengumpulan data yang digunakan oleh penulis ialah mengumpulkan studi pustaka berupa data sekunder baik dari perundang-undangan, buku, maupun pustaka daring. Hasil penelitian menunjukkan bahwa berdasarkan Pasal 10 Undang-Undang Nomor 13 Tahun 2016 tentang Paten, invensi atas vaksin Covid-19 diberikan kepada inventor atau orang yang diberikan hak untuk mendapatkan paten tersebut dengan izin dari inventor. Pada hubungan pekerjaan, hak ekonomi akan diberikan kepada pihak yang memberikan pekerjaan sebagaimana tercantum dalam Pasal 12. Inventor dapat memperoleh imbalan yang wajar dengan ketentuan sebagaimana tercantum dalam Pasal 4 Peraturan Menteri Keuangan Republik Indonesia No.72/PMK.02/2015. Kata kunci: Covid-19, hak ekonomi, inventor, paten, vaksin Mechanism to Gain Economic Rights for Covid-19 Vaccine Patent Holders in Indonesia Abstract The emergence of Covid-19 on March 2020 in Indonesia made inventors develop several innovations, one of the inovation is Covid-19 vaccine. Inventors should be given economic righ over the use of vaccines, especially because these vaccines are used for the benefit of the public. Based on this background, this study aims to determine the status of patent ownership for the invention of Covid-19 vaccine and the mechanism for protecting patent holder’s economic right against the Covid-19 vaccine so that it can be fulfilled, based on Law Number 13 of 2016 concerning Patents. The author used descriptive-analytical method that use a normative juridical approach and analyzes data using qualitative methods. The accumulation of data used by the author is to collect literature studies in the form of secondary data from legislation, books, and online libraries. The results shows that based on Article 10 of Law Number 13 of 2016 concerning Patents, the invention of the Covid-19 Vaccine given to the inventor or to the person who is granted the right to obtain the patent with permission from the inventor. On the employment relation, economic right will be given to the party that giving the job as stated in Article 12. The inventor can get a reasonable reward with the provision as listed on Article 4 of Regulation of The Minister of Finance of The Republic of Indonesia No.72/PMK.02/2015. Abstract

Brand is a sign in the form of pictures, names, words of letters, numbers, arrangement of colors, or combinations of those elements which have distinguishthing power and are used in goods or service trade activities. The terms in the brand, especially regarding the protection of famous brands, can actually be applied in the case of domain names. "There is a provision in the TRIPs that governs the issue of protection of this famous brand, and the public becomes bound by the provision because it has been ratified". The meaning is Article 16 (3) TRIPs (Trade Related Aspect of Intellectual Property Rights). Article 16 (3) states that Article 6 bis of the Paris Convention on Protection of Industrial Property Rights shall apply, mutatis mutandis to goods and services which are not similar to goods and services to which a trademark has been registered.

Abstract

Abstrak Dewasa ini pelaku usaha berlomba-lomba membangun sebuah brand. Alasannya adalah semakin positif citra sebuah brand di masyarakat maka brand tersebut akan mempengaruhi tingkat pembelian masyarakat terhadap brand tersebut. Brand menjadi salah satu faktor pertimbangan masyarakat untuk membeli suatu produk barang atau jasa. Umumnya masyarakat cenderung membeli produk yang masuk ke dalam tingkatan teratas dalam suatu survey brand. Membangun sebuah brand bukanlah usaha yang mudah, diperlukan usaha maupun modal yang tidak sedikit demi membangun citra yang kuat dalam masyarakat. Akan menjadi sangat tidak adil bila brand yang telah dibangun dengan susah payah ditiru oleh pelaku usaha yang tidak bertanggung jawab. Pelaku usaha membutuhkan sebuah perlindungan hukum atas brand yang telah dibangunnya agar terhindar dari perbuatan curang yang mengarah ke persaingan usaha curang. Pranata hukum merek dibuat untuk memberikan perlindungan atas suatu brand yang ditempelkan pada suatu barang atau jasa yang diperdagangkan. Pranata tersebut memberikan hak eksklusif bagi pemegang merek dalam menggunakan brand tersebut. Kata Kunci : Brand, Hukum, Merek, Perlindungan, dan Usaha.

Abstract

Cinematographic work is protected by law under the Copyright Law No. 28 of 2014 in Indonesia. The fundamental principle is that the Creator is entitled to fair remuneration for the use of their work, in line with the alter-ego concept that gives the highest position to the Creator. In contrast to Indonesia, Germany has clearly regulated the procedures for the collection, management, and distribution of remuneration through the Urheberrechtsgesetz and the Collective Management Organization (CMO) operating with authorization from the Creator. The research method used is juridical-normative with a descriptive analysis approach. This study applies a comparative legal approach, utilizing data from both conventional and online literary sources, as well as interviews. The research findings indicate that Indonesia does not yet have specific regulations to protect the economic rights of digital cinematography. The absence of a Collective Management Organization (CMO) leads to an imbalance in licensing agreements between the Creator and digital platforms as users of cinematographic works.

Abstract

Technological advancements in the Society 5.0 era have transformed the economic landscape, including taxation mechanisms. This study focuses on the role and responsibilities of digital platforms in tax imposition in Indonesia, governed by various regulations such as the Harmonized Tax Law (UU HPP) and Electronic Information and Transaction Law (UU ITE). The study finds that while digital platforms are central to the digital economy, existing regulations have not fully addressed the complexity of their operations, particularly in the context of taxation. Using a normative juridical approach, this research examines key challenges such as transaction anonymity, taxation disparities between conventional and digital companies, and tax avoidance by multinational digital platforms. On the other hand, the Indonesian government has initiated adaptation efforts by imposing Value-Added Tax (VAT) on digital trade, although its implementation still faces technical and administrative barriers. The study concludes that Indonesia's tax regulations need reforms to better accommodate the dynamics of the digital economy, including implementing fair and legally certain taxes for digital platforms. Recommendations include strengthening oversight, enhancing international collaboration, and utilizing technology to improve transparency and efficiency in the tax system. This research aims to contribute to the government, regulators, and business actors in creating an inclusive and sustainable digital economic ecosystem.

Abstract

The development of human civilization has given birth to a creative economy that is developing simultaneously. Copyright is one type of Intellectual Property that is given to creators and other parties who have rights to their creations to utilize exclusivity both economically and morally. Indonesian laws and regulations have been able to adjust to economic developments. However, in its implementation there are still gaps in terms of the withdrawal of copyright royalties as objects of fiduciary guarantees. This study aims to determine and identify the optimization of regulations for the implementation of copyright royalties as fiduciary guarantees based on positive law in Indonesia. This study was conducted using a normative juridical approach method, by conducting research through literature as the main research material. Based on the research conducted, it was found that although regulations have regulated copyright to be used as objects of fiduciary guarantees, there needs to be optimization of regulations and collaboration between the government and related institutions along with the development of the creative industry era.

Abstract

Perkembangan teknologi digital yang pesat telah mendorong transformasi besar dalam kehidupan manusia, khususnya melalui penggunaan internet dan platform digital. Di satu sisi, hal ini memberikan dampak positif dalam aspek ekonomi dan komunikasi, namun di sisi lain juga menimbulkan ancaman terhadap keamanan siber (cybersecurity), termasuk dalam konteks pelindungan Hak Kekayaan Intelektual (HKI). Dalam penelitian ini, penulis mengkaji keterkaitan antara pelanggaran Hak Cipta dan aspek keamanan siber melalui studi kasus Putusan Mahkamah Agung Nomor 66 PK/Pdt.Sus-HKI/2023 terkait penggunaan lagu "SKJ88" secara komersial tanpa izin di platform digital oleh PT Elang Prima Retailindo. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan terhadap norma hukum, doktrin, serta teori yang relevan. Hasil analisis menunjukkan bahwa meskipun pengadilan mengabulkan sebagian gugatan, aspek pelanggaran terhadap Hak Moral pencipta tidak sepenuhnya dipertimbangkan dalam putusan tingkat Peninjauan Kembali. Padahal, Hak Moral merupakan hak yang melekat secara abadi pada pencipta dan telah diakui baik dalam hukum nasional maupun internasional. Penulis menekankan pentingnya pelindungan menyeluruh terhadap Hak Moral dan Hak Ekonomi pencipta, khususnya dalam era digital yang penuh dengan potensi pelanggaran melalui media daring. Penelitian ini juga menyoroti perlunya integrasi antara sistem hukum HKI dan strategi keamanan siber sebagai bentuk pelindungan terhadap karya cipta di ruang digital.

Abstract

The rapid advancement of digital technology has significantly heightened the risk of copyright infringement in streaming services, making the implementation of Digital Rights Management (DRM) an essential mechanism for protection. This study aims to analyze the effectiveness of DRM regulations in safeguarding copyrights on digital platforms in Indonesia and to propose measures to enhance their enforcement. The research employs a normative juridical approach, focusing on an in-depth examination of Indonesia’s Law No. 28 of 2014 on Copyright, alongside a comparative analysis of international cybersecurity regulations, particularly in the European Union (EU) and the United States (US), where DRM frameworks are more robust and extensively enforced. The findings of this study indicate that, first, while DRM is legally recognized in Indonesian regulations, its practical implementation remains vulnerable to cyberattacks and digital piracy. The existing legal framework remains general and lacks specificity in addressing the technical complexities of DRM protection for digital content. Second, comparative insights reveal that countries with more developed cybersecurity infrastructures, such as the EU and the US, provide more comprehensive protection through detailed legal frameworks and advanced technological measures that reinforce DRM enforcement. Based on these findings, this study recommends updating Indonesia’s DRM regulations, strengthening cybersecurity infrastructure by adopting international best practices, and enhancing global cooperation to combat digital piracy through cross-border networks. These measures are essential to fortifying copyright protection in Indonesia’s digital streaming landscape and ensuring a secure and sustainable digital economy.

Abstract

Intellectual Property (IP) plays a crucial role in fostering fair business competition. Trademarks as a element of IP serve as distinguishing identifiers that guarantee product quality. In addition, trademarks function as marketing tools in competitive markets and provide protection against bad faith actions by other parties. To obtain legal protection, a trademark must be registered in accordance with statutory requirements. A trademark application may be rejected if these requirements are not fulfilled. A common reason for rejection is the existence of substantial similarity to a previously registered mark or an earlier-filed application for similar goods and/or services. Therefore, clear and consistent standards for determining substantial similarity are essential to ensure legal certainty for applicants.
