Abstract

In this research, the influence of leadership style and motivation on the performance of PT employees. Parlindo has a goal, namely to determine the influence of leadership style and motivation on employee performance at PT. Parlindo. This type of research is associative research. The variables in this research are leadership style, motivation and employee performance. The population and sample in this study were 30 employees of PT. Parlindo. The data used is Primary Data. The data collection technique in this research is a questionnaire. The data analysis used is quantitative analysis. The research results show that it has a positive influence so that there is indeed an influence of leadership style and motivation on the performance of PT employees. Parlindo. Leadership style is very influential on employee motivation and performance, this is because leadership style is one of the main benchmarks that must be carried out and paid attention to by every leader in a company in order to be able to form an organizational structure for each employee well so that the methods and measures that can coordinated to maintain employee performance and can encourage employee motivation to achieve the same company goals as the responsibilities given to each employee. The research results show that the significant t value of the influence of the Leadership Style variable on employee performance is 0.066 using a t table with a real level of db = 30-2 = 28, so tcount is 1.916 > ttable 1.701, this means that Ho is rejected and Ha is accepted. Apart from that, the significant value of t has an influence on the motivation variable on employee performance of 0.036 using the t table with a real level of db = 30-2 = 28, so tcount is 2.213 > ttable 1.701, this means that Ho is rejected and Ha is accepted. It can be concluded that in one variable leadership style and motivation together have a positive and significant effect on the performance of PT employees. Parlindo.

Abstract

Penelitian ini berangkat dari polemik terjadinya pemotongan nisan salib di  kawasan Purbayan Kota Gede Yogyakarta. Dalam isu yang berkembang dimasyarakat, tindakan tersebut dianggap sebagai suatu perbuatan intoleran dalam beragama. Kemudian peneliti mengaitkan kasus tersebut dengan pluralisme hukum di Indonesia. Penelitian ini bertujuan untuk mengetahui konsep pluralisme hukum serta bagaimana pandangan para akademisi dalam menyikapi kasus pemotongan nisan salib tersebut. Peneliti mendapatkan data kualitatif dengan melakukan wawancara, menggunakan metode penelitian  deskriptif analistis dan pendekatan kasus (case approach). Hasilnya bahwa konsep pluralisme hukum berkembang beriringan dengan munculnya pluralisme sosial. Pada masyarakat yang plural akan muncul pula hukum yang plural. Sentralisasi hukum menjadi percuma karena cenderung asosial. Pluralisme hukum menunjukan sistem hukum yang beragam dan berlaku bersamaan atau berinteraksi dalam mengatur berbagai aktivitas dan hubungan manusia di suatu tempat. Para akademisi yang menjadi narasumber, terhadap kasus pemotongan nisan salib di kawasan Purbayan Kota Gede Yogyakarta memiliki pandangan tindakan memotong nisan salib merupakan suatu bentuk intoleran. Kasus pemotongan nisan salib tersebut sebagai suatu cerminan keterbatasan pengaturan hukum sentral (skala nasional) dalam masyarakat yang plural. Kasus tersebut merupakan pelanggaran atas toleransi beragama di masyarakat.

Abstract

Maraknya kasus kekerasan psikis terhadap perempuan menuntut reposisi paradigma efektivitas hukum, sehingga pemulihan substantif korban perlu dijadikan indikator utama keberhasilan penegakan hukum dalam perspektif viktimologi modern. Penelitian ini bertujuan menganalisis efektivitas implementasi Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual pada Unit Pelayanan Perempuan dan Anak Kota Bandung.  Penelitian ini menggunakan pendekatan socio-legal dengan metode yuridis empiris; data dikumpulkan melalui wawancara mendalam terhadap tujuh informan, observasi langsung, dan analisis dokumentasi. Temuan menunjukkan bahwa efektivitas hukum secara substantif masih terhambat oleh kendala struktural seperti keterbatasan kapasitas kelembagaan dan lemahnya koordinasi lintas sektor, serta hambatan kultural seperti langgengnya stigma sosial dan tindakan menyalahkan korban. Penelitian ini merekomendasikan reformasi kebijakan daerah melalui standarisasi sistem pelayanan terpadu antarinstansi dan alokasi anggaran khusus untuk pemulihan psikologis jangka panjang guna mewujudkan perlindungan korban yang holistik.

Abstract

The rapid expansion of artificial intelligence (AI) within criminal justice systems has transformed contemporary law enforcement from reactive adjudication toward predictive governance based on algorithmic surveillance, risk assessment, and data-driven policing. While predictive policing technologies are frequently promoted as instruments of efficiency and objectivity, their increasing use has generated profound concerns regarding algorithmic bias, procedural inequality, opacity in decision-making, and the erosion of fair trial guarantees. This article examines how the rise of algorithmic justice challenges the foundational principles of modern criminal procedure, particularly the presumption of innocence, transparency, equality before the law, and the right to defense. Using normative legal research with conceptual and comparative approaches, this study analyzes the development of predictive policing and AI governance in several jurisdictions, including the United States, China, the European Union, and Indonesia. The article argues that conventional fair trial doctrines are increasingly inadequate in responding to opaque and predictive systems of algorithmic governance because existing procedural safeguards were primarily designed for human decision-makers rather than automated computational systems. This study further demonstrates that AI-driven law enforcement not only reproduces structural discrimination embedded within historical criminal data, but also expands state surveillance capacities through technologically mediated forms of governance. As a theoretical contribution, this article proposes a reconstruction of fair trial principles through a framework of human-centered algorithmic governance emphasizing algorithmic transparency, explainability rights, meaningful human oversight, anti-discrimination safeguards, independent algorithmic auditing, and digital procedural rights. Ultimately, the article argues that the future legitimacy of criminal justice systems depends upon the ability of legal institutions to control algorithmic power while preserving constitutionalism, procedural justice, and fundamental human rights in the era of digital governance.
