Abstract

The disabilities people in Indonesia, interacting with their environment experienced many obstacles, especially in accessing public facilities. To eliminate all these obstacles, the Government of Indonesia pursues one way of doing so by fulfilling the right to accessibility to public facilities for PwDs. Such fulfillment efforts begin by ratifying the International Convention on Persons with Disabilities that govern the fulfillment of those rights. In addition, the effort taken also to give birth to the national legislation about persons with disabilities namely Law No. 8 of 2016. In the Act is regulated one of several rights, namely the right to accessibility. In this article we will describe the right accesibiltas which is part of human rights and the availability of legal guarantees in Indonesia on the right to accessibility for persons with disabilities in some legislation related to public facilities, namely the right to accessibility to building, spatial and region and transportation. The conclusions presented in this article are, firstly, the right to accessibility is an integral part of the concept of human rights. Secondly, the right to accessibility to public facilities for persons with disabilities is accommodated in several laws and regulations in Indonesia.

Abstract

This article discusses the "conception of adat law community rights as a human right. The purpose of writing this article is to know the conception of customary law community as a human right, with limited review of legislation relating to the topic.This article is important to publish, considering many issues that arise related to the rights of adat law community. Starting from the use of the term to the fulfillment of the rights of adat law community. As known that until now there has been no legislation that specifically regulates the rights of adat law community. In the highest regulation under Article 18 B paragraph 2 and Article 28 I paragraph 3 of the 1945 Constitution, the rights of adat law community are further regulated in several laws and regulations, so that it will be difficult to identify what rights should be met by countries for the fulfillment of the rights of adat law community.This article discusses some statutory legislation in Indonesia which is the foundation for accommodating customary law community rights which are human rights where the fulfillment must be done by the state.

Abstract

Kehidupan manusia pada dasarnya adalah dinamis, hal ini dapat dilihat dari perkembangan baik secara fisik maupun perkembangan sosial masyarakat, karena manusia merupakan makhluk hidup yang tidak dapat hidup sendiri sehingga mereka selalu bergantung pada orang lain. Adanya hukum merupakan sarana sebagai pengatur kehidupan masyarakat supaya dapat hidup aman dan tentram tanpa terganggu hak dan kewajibannya sebagai manusia. Perkembangan manusia juga diiringi dengan perkembangan zaman dan teknologi, terutama bidang teknologi informasi, yang menjadikan manusia memiliki ketergantungan pada dunia teknologi yakni media sosial dan internet. Sehingga masyarakat perlu waspada dan sadar akan efek negative terhadap kemajuan teknologi tersebut. Salah satu hal yang marak dewasa ini adalah tentang penggunaan media sosial dalam komunikasi. Program Pengabdian kepada Masyarakat yang kami laksanakan ini merupakan solusi dan memahamkan masyarakat dalam menyikapi media sosial dan peraturan hukum yang mengatur. Sehingga dengan adanya kegiatan ini, mereka lebih memahami bagaimana bersikap terhadap kemajuan teknologi tersebut. Manfaat yang didapat dari pelaksanaan kegiatan ini bahwa masyarakat Kelurahan Karang Harapan menyadari betul kebutuhan media sosial tetapi mereka baru menyadari bahwa bermedia sosial juga diperlukan etika untuk menghindarkan diri mereka dari hal-hal yang dapat merugikan diri mereka sendiri seperti pencemaran nama baik, terlebih pemahaman baru terhadap Undang-Undang Informasi dan Transaksi Elektronik.

Sehingga dengan adanya kegiatan ini, mereka lebih memahami bagaimana bersikap terhadap kemajuan teknologi tersebut. Manfaat yang didapat dari pelaksanaan kegiatan ini bahwa masyarakat Kelurahan Karang Harapan menyadari betul kebutuhan media sosial tetapi mereka baru menyadari bahwa bermedia sosial juga diperlukan etika untuk menghindarkan diri mereka dari hal-hal yang dapat merugikan diri mereka sendiri seperti pencemaran nama baik, terlebih pemahaman baru terhadap Undang-Undang Informasi dan Transaksi Elektronik.

Abstract

This study discusses the right to education policy for Persons With Disabilities (PwDs) In Border Area of Nunukan-Indonesia. This research aims to find out whether the legal regulation on human rights for with disabilities provided by the Indonesian government is appropriate or not and to find out whether the government of Nunukan District also provided some policies in handling a person with disabilities, in particular, their right to education. This research used a normative legal method, which complemented with field research. As a result, in order to fulfil human rights for PwDs, the Indonesian government was stipulated plenty of national laws, namely National Education System Law, the Protection of Children Law, and individually regulated by Law No. 8 of 2016 on Persons with Disabilities. Also, the most crucial factor is that the Nunukan District has not been set up the local regulation pertaining to PwDs. Only several policies are stipulated to overcome the right to education problems, but it does not enough to ensure the correct implementation of this right in the field.

Abstract

One form of contribution to the existence of a tertiary institution is the implementation of community service in the area where the college is located. A dynamic life makes people need regulation and needs solutions in solving problems. The solution offered in this service is using land for hydroponic plants carried out in the Ardi Mulyo Village and the use of household waste as fuel. The method used is the participation of the community and students because the concept of implementing PKM is community empowerment. The implementation results show that the activities carried out are very beneficial for the community because the concept used is to realize an independent village for living needs in the form of vegetables and the demand for substitutes for kerosene and gas through plastic bottles waste refining. The method used in implementing this PKM is participatory, namely the involvement of the community and students. This method is used because the PKM carried out by the team relates to empowerment. Hence, the role is to present and monitor for the sustainability of the programs that have been implemented. The results of the implementation of the activities show that the community is very enthusiastic about the activities carried out, this can be seen by the community's participation, and the programs implemented are also right on target and effective so that the independence of the village will be formed with straightforward program implementations.

Abstract

AbstractThe central investigation according to the title is “what steps can be taken by Indonesian government to solve this case?”. This article used normative legal method with statutes and case approaches. The conclusions are according to international law, the government of Saudi Arabian is can not be blamed, due to the provision of Article 36 of Vienna Convention of 1963 should be framed with Mandatory Consular Notification agreement between Indonesia and Saudi Arabian. So as the protection based on respecting of human dignity will not violate the sovereignty of a state. IntisariInvestigasi utama dari judul yang diangkat adalah “langkah apa yang dapat ditemput oleh pemerintah Indonesia untuk menyudahi kasus tersebut?”, metode yang digunakan adalah metode penelitian hukum normatif dengan melakukan pendekatan terhadap aturan dan pendekatan kasus. Kesimpulan yang dihasilkan adalah pemerintah Arab Saudi tidak dapat dipersalahkan dikarenakan ketentuan Pasal 36 Konvensi Wina 1963 harus dilanjutkan dengan adanya perjanjian Mandatory Consular Notification antara Indonesia dan Arab Saudi, sehingga perlindungan pekerja migran yang berbasis pada perlindungan harkat dan martabat manusia tidak menciderai prinsip kedaulatan yang dimiliki oleh setiap negara.

Abstract

The relation of international community currently emphasize that soveregnty princple could not more decide as the main principle in managing a territory of state, even though sovereignty is the main requirement for a state to enforce its law and to do cooperation among entities in international relations. In order to find out the exact interpretation of sovereginty principle, this article used qualitative method. This study find out that sovereignty is recognized as one of the principles in recognizing a state. This term has a political nuance, because the aspect of recognition itself is not a legal aspect but a political one. Moreover, in several cases, even though a country had proclaimed its sovereignty, there are still opportunities for a part of the territory to become independent or even to be acquired by other countries. Thus, it seems that the principle of sovereignty has a tendency as part of politics. However, the principle of sovereignty remains a legal principle based on the provisions of international law, where each country has exclusive rights in every part of its territory, namely in land, air and sea. Currently, the concept of international law has expanded to the politic of international law study, which numerous aspects of law enforcement mingle with a country's policies that are synonymous with political aspects. Additionally, that the current principle of sovereignty should be completed with another legal principle in international law. Abstrak Hubungan masyarakat internasional saat ini menekankan bahwa prinsip kedaulatan tidak dapat lagi diputuskan sebagai prinsip utama dalam pengelolaan suatu wilayah negara, padahal kedaulatan merupakan syarat utama bagi suatu negara untuk menegakkan hukumnya dan untuk melakukan kerjasama antar entitas dalam hubungan internasional. Untuk mengetahui interpretasi yang tepat dari prinsip kedaulatan, artikel ini menggunakan metode kualitatif. Studi ini menemukan bahwa kedaulatan diakui sebagai salah satu prinsip dalam pengakuan suatu negara. Istilah ini bernuansa politis, karena aspek pengakuan itu sendiri bukanlah aspek hukum melainkan aspek politik. Apalagi, dalam beberapa kasus, meski suatu negara telah memproklamasikan kedaulatannya, masih ada peluang bagi sebagian wilayahnya untuk merdeka atau bahkan diakuisisi oleh negara lain. Dengan demikian, nampaknya prinsip kedaulatan memiliki kecenderungan sebagai bagian dari politik. Namun asas kedaulatan tetap merupakan asas hukum berdasarkan ketentuan hukum internasional, dimana setiap negara memiliki hak eksklusif di setiap bagian wilayahnya, yaitu di darat, udara dan laut. Saat ini, konsep hukum internasional telah merambah ke politik kajian hukum internasional, dimana berbagai aspek penegakan hukum berbaur dengan kebijakan suatu negara yang identik dengan aspek politik. Oleh karena itu, disimpulkan bahwa asas kedaulatan yang berlaku saat ini harus dilengkapi dengan asas hukum lain dalam hukum internasional.

Abstract

The research problems are; first, how is local government authority within human rights fulfilment for person with disabilities? Second, how is legal policy on human rights for person with disabilities?. Third, how is law protection from local government related to education rights fulfiment for person with disabilities in North Kalimantan?. The method of this research uses normative method be equipped by field research. This research is important considering the obligation of state to  protect, to recognize and to fulfil of human rights for citizens in its region without discrimination particulary for person with disabilities in border area. Within an effort to implementation, Indonesia Government regulates some legal instrument of human rights, one of the newest is Law No 8 of 2016 on Person with Disabilities. North Kalimantan is youngest province in Indonesia, some local regulation on human rights has been regulated, but the human rights instrument particulary for person with disabilities has not been set up.  The research urgency becomes one of the goals to regulate the local government policy on education rights particularly the rights of person with disabilities in North Kalimantan Province, its expected to be a solution against regulation plan in Indonesia on fulfilment of human rights degree for person with disabilities especially education rights for them in North Kalimantan Province. The methodology of this paper is normative that equipped by field research. The conclussion of this paper is in regulation, authority, and legal protection.

Abstract

Climate action is the 13th Sustaianble development Goals (SDG’s) target, where countries around the world have agreed to fulfil it through concrete steps. Surely, these efforts will not be uniform among countries, including Indonesia as developing country. Well known the high costs of supporting climate actions is the biggest problem. However the challenge is even greater because Indonesia is the state with the highest gas emissions in Southeast Asia, even 3 to 4 times greater than other ASEAN member states. Therefore, it is urgent to provide recommendations for Indonesia regarding climate action models. This study used the socio-legal method. The results are: firstly, climate change has adverse effects in Indonesia, such as high levels of extreme poverty, vulnerability to food sources on which Indonesian people heavily depend, an increase in natural disasters, adverse impacts on coastal communities, and high deforestation rates. Secondly, for the effectiveness and efficiency of achieving climate action targets in Indonesia, one of the appropriate model or concept which suitable for Indonesia is a form of climate action model through synergy across aspects and sectoral, which are based on the Adaptation and Mitigation of Climate Change. This model can serve as a reference for developing countries worldwide.
