Abstract

Penelitian ini mengkaji konsep kafa’ah dalam membina keluarga harmonis dari perspektif maslahah dalam pernikahan. Kafa’ah menekankan pentingnya kesetaraan dan keseimbangan antara suami istri dalam berbagai aspek seperti agama, nasab, status sosial, dan ekonomi. Kesetaraan ini adalah landasan penting untuk memastikan kelayakan pasangan dalam menjalani kehidupan berumah tangga dan berkontribusi pada keharmonisan keluarga. Penelitian ini bersifat kualitatif deskriptif dan menggunakan pendekatan studi kepustakaan untuk mengkaji konsep kafa’ah dalam pernikahan berdasarkan perspektif maslahah. Sumber data utama berasal dari kitab-kitab klasik seperti al Fiqhi ’Ala Madzahib al-Arba’ah dan kitab-kitab kontemporer, sementara data sekunder diperoleh dari buku, artikel, dan jurnal yang relevan. Analisis data dilakukan menggunakan metode Miles dan Huberman yang meliputi kondensasi data, penyajian data, dan penarikan kesimpulan atau verifikasi. Uji keabsahan data menggunakan teknik triangulasi untuk memastikan validitas dan menghindari bias. Penelitian ini menyimpulkan bahwa pemahaman mendalam tentang kafa’ah dan maslahah sangatlah krusial untuk membina keluarga yang harmonis dan bahagia. Dari perspektif maslahah, prinsip tersebut dapat disesuaikan dengan konteks dan kebutuhan masyarakat untuk menjaga kesejahteraan keluarga dengan memperhatikan lima kebutuhan dasar; agama, jiwa, akal, keturunan, dan harta. Penerapan prinsip-prinsip ini mendukung terciptanya keluarga yang harmonis dan sejahtera, dengan elemen-elemen penting seperti penghargaan, kasih sayang, komitmen, komunikasi positif, waktu bersama, kesejahteraan spiritual, dan kemampuan mengelola stres.

Abstract

This research aims to strengthen the role and function of the Children's Social Welfare Institution (LKSA) of the Orphanage in the care and education of children, especially orphans from underprivileged, abandoned and exposed to promiscuity. Relevant journal articles are compiled using Harzing's Publish or Perish and the selected articles are publications from 2022-2024. From the journal articles that have been collected, it is found that: (1) The institution provides caregiving, educational, business-related services and guidance for foster children, (2) Chairmen, administrators and caregivers act as motivators, advisors, facility providers and to achieve a prosperous future in a safe and supportive environment, children are helped to prepare themselves to face various challenges in their lives, (3) Facing obstacles such as the limited number of caregivers, financial constraints, and lack of experience of caregivers in caring for and fostering children who have diverse characters and backgrounds, (4) The proposed strategy includes strengthening cooperation between caregivers, foster children, and families/guardians, the implementation of targeted joint activities, (5) Support for entrepreneurship skills training, marketing practices for processed food products and sewing skills (6), mental health education and character education efforts through the internalization of religious and socio-religious moderation values. The implementation of this concrete step is in line with the Regulation of the Minister of Social Affairs of the Republic of Indonesia No. 15 of 2010 and No. 30 of 2011, with the aim of creating a safe and fair environment for children, as the next generation who need comprehensive protection.

Abstract

This study was motivated by the phenomenon of husbands prohibiting their wives from working outside the home, which still occurs in Santan Tengah Village. The research aims to analyze the reasons behind husbands' restrictions on their wives' employment and to examine the practice from the perspectives of Islamic Law and Human Rights. This study employed an empirical normative legal approach using qualitative methods. Data were collected through interviews and documentation involving four married couples and analyzed using the perspectives of Islamic jurisprudence, particularly Fatawa al-Mar'ah al-Muslimah, Law Number 39 of 1999 on Human Rights, the Universal Declaration of Human Rights (UDHR), and the 1945 Constitution of the Republic of Indonesia. The findings reveal that husbands prohibit their wives from working due to concerns regarding childcare responsibilities, personal safety, workplace distance, and the preservation of family harmony. From the perspective of Islamic Law, such restrictions are considered permissible when intended to safeguard family welfare (maslahah) and comply with Islamic legal principles. However, from the Human Rights perspective, these restrictions may limit women's rights to employment, self-development, gender equality, and an improved standard of living. Therefore, the study demonstrates a difference between Islamic Law, which prioritizes family welfare, and Human Rights, which emphasize women's individual rights to work.
