Abstract

Yayasan Daarul Muttaqiin bergerak di bidang sosial dan bidang pendidikan keagamaan. Seperti halnya dalam memfasilitasi pembangunan gedung dakwah dan pesantren yang mampu membuat formulasi kearah positif dengan strategi fundraising cara mempengaruhi donatur dalam lelang wakaf sehingga fundraising membutuhkan strategi yang baik dan relevan. Permasalahan wakaf sudah diatur dalam Hukum Islam dan juga didalam Undang˗undang 41 Tahun 2004 Tentang Wakaf. Dengan begitu lelang wakaf juga harus sesuai dengan ketentuan yang ada didalamya. Penelitian ini bertujuan untuk mendekripsikan strategi fundraising pada lelang wakaf di yayasan Daarul Muttaqiin yang ditinjau dari Hukum Islam dan Undang˗undang 41 Tahun 2004 Tentang Wakaf. Metode penelitian yang digunakan adalah penelitian hukum normatif dan penelitian ini termasuk ke dalam jenis penelitian deskriptif. Sumber data yang digunakan yaitu sumber data sekunder dan primer. Teknik pengumpulan data yang digunakan yaitu wawancara terhadap pengurus lelang wakaf di yayasan Daarul Muttaqiin, studi literatur dan dokumentasi. Hasil penelitian ini menunjukan analisis terhadap pelaksanaan Strategi Fundraising pada Lelang Wakaf di Yayasan Daarul Mutaqiin sah menurut hukum Islam karena memenuhi rukun dan syaratnya serta fungsi dan tujuan sesuai dengan Pasal 5, 9 dan 15 Undang˗undang 41 Tahun 2004 Tentang Wakaf. Adanya istilah strategi fundraising menggunakan lelang wakaf merupakan suatu strategi yang menarik agar masyarakat mengikuti program yayasan Daarul Muttaqiin. Kata Kunci: strategi, fundraising, lelang, wakaf The Daarul Muttaqiin Foundation is engaged in social and religious education. As is the case in facilitating the construction of da'wah buildings and Islamic boarding schools which are able to make formulations in a positive direction with fundraising strategies for how to influence donors in waqf auctions so that fundraising requires a good and relevant strategy. The issue of waqf has been regulated in Islamic Law and also in Law 41 of 2004 concerning Waqf. That way the waqf auction must also be in accordance with the provisions contained therein. This study aims to describe the fundraising strategy for waqf auctions at the Daarul Muttaqiin foundation in terms of Islamic Law and Law 41 of 2004 concerning Waqf. The research method used is normative legal research and this research is included in the type of descriptive research. The data sources used are secondary and primary data sources. The data collection technique used was interviews with waqf auction administrators at the Daarul Muttaqiin foundation, literature studies and documentation. The results of this study show that the analysis of the implementation of the Fundraising Strategy at the Waqf Auction at the Daarul Mutaqiin Foundation is valid according to Islamic law because it fulfills the pillars and conditions as well as the functions and objectives in accordance with Articles 5, 9 and 15 of Law 41 of 2004 concerning Waqf. The existence of the term fundraising strategy using waqf auctions is an interesting strategy so that people join the Daarul Muttaqiin foundation program. Abstract. DSN-MUI Fatwa No: 108/DSN-MUI/X/2016 is a regulation that is currently the basis for organizing Sharia hospitality tourism in Indonesia after PERMENPAREKRAF No.2/2014 concerning Guidelines for Implementing Sharia Hotel Business which was revoked by Tourism Minister Regulation Number 11 Year 2016 concerning Revocation of PERMENPAREKRAF No.2/2014 concerning Guidelines for Implementing Sharia Hotel Businesses. Revocation PERMENPAREKRAF No.2/2014 concerning Guidelines for Implementing Sharia Hotel Businesses is revoked because it no longer follows current demands and developments in tourism so it needs to be revoked. This research is a qualitative type with a normative juridical method whose data collection comes from interviews, literature studies, and documentation studies which are then analyzed through data reduction or a simplification process which is then carried out by presenting data which provides an opportunity to draw conclusions and take action to draw conclusions as a stage last on the method of analysis in this study. Based on the results of this study, of the seven minimum fatwa requirements No. 108/DSNMUI/X/2016 on the Orang Homes Syariah Hotel, there is one conditions that had not been fulfilled yet, which is the seventh condition. so it can be said that a small part of the Orange Homes Syariah Hotel cannot be categorized as a shariacompliant hotel.Keywords: Sharia Hotel, DSN-MUI Fatwa, Sharia Economic Law

Abstract

Abstract. This research was motivated by the lack of literacy related to the halal or haram problems of cashback provided by sending services to online stores in the Shopee marketplace, the development of technology in the business and economic sector, and the importance of understanding the legal certainty of Islam regarding contemporary issues.. The purpose of this study is to analyze the certainty of Islamic law regarding product marketing strategies and the legal certainty that, according to Islamic law, is related to product marketing strategies used by Delivery Services in the Shopee marketplace. This research framework is based on the relationship between cashback on Shopee as a marketing strategy for sending service products to Islamic legal sources so as to produce legal certainty related to delivery service product marketing strategies, especially the cashback provided by delivery services to online stores such as Surfinclo. The research method applied is normative-juridical with a descriptive-qualitative research approach. The data sources used in this study are the results of interviews from Surfinclo and literature studies such as research journals, scientific articles, textbooks, and so on. Based on their findings, researchers found that the practice of sending service cashback on product marketing on the Shopee marketplace is classified as a marketing fee. It is included in the halal category based on Islamic legal sources, such as the Qur'an, hadith, ijma', and ijtihad. So it can be concluded that legal certainty related to cashback is halal and can be applied by Muslim entrepreneurs Keyword: Islam, Law, Marketplace, Cashback, Marketing, Strategy. Abstrak. Penelitian ini dilatarbelakangi oleh minimnya literasi terkait permasalahan halal atau haramnya cashback yang diberikan jasa kirim kepada pihak toko online di marketplace Shopee, perkembangan teknologi disektor ekonomi bisnis, dan pentingnya mengetahui kepastian hukum islam terhadap sebuah permasalahan yang sifatnya kontemporer. Tujuan penelitian ini adalah untuk menganalisis kepastian hukum islam tentang strategi pemasaran produk, dan menganalisis kepastian hukum yang mana menurut hukum Islam terkait strategi pemasaran produk yang digunakan oleh Jasa Kirim di marketplace Shopee. Kerangka berfikir penelitian ini didasarkan pada keterkaitan antara cashback di Shopee sebagai strategi pemasaran produk jasa kirim terhadap sumber-sumber hukum islam sehingga menghasilkan kepastian hukum terkait strategi pemasaran produk jasa kirim yang khususnya adalah cashback yang diberikan oleh jasa kirim kepada toko online seperti Surfinclo. Metode penelitian yang digunakan adalah yurudis normatif dengan pendekatan penelitian kualitatif deskriptif. Sumber data yang digunakan pada penelitian ini adalah hasil wawancara dari pihak Surfinclo dan studi literatur seperti jurnal penelitian, artikel ilmiah, buku teks, dan sebagainya. Berdasarkan temuan yang peneliti dapatkan bahwa praktik cashback jasa kirim pada pemasaran produk di marketplace Shopee tergolong sebagai marketing fee. Hal tersebut termasuk dalam kategori halal berdasarkan sumber hukum Islam, seperti Al-qur’an, hadits, ijma’, dan ijtihad. Sehingga dapat disimpulkan bahwa kepastian hukum terkait cashback tersebut adalah halal dan dapat diaplikasikan oleh pengusaha Muslim Kata Kunci: Hukum, Islam, Marketplace, Strategi, Pemasaran
