Abstract

This research aims to find out what is behind the increase in the term of office of the leadership of the Corruption Eradication Commission in Indonesia. Also, the urgency of increasing the KPK's term of office is viewed from the perspective of constitutional law. This research is normative legal research that uses a case approach with data collection methods through literature study. Based on the research, the results and conclusions obtained are related to the Constitutional Court decision Number 112/PUU-XX/2022 regarding the term of office of the KPK leadership proposed by Nurul Ghufron as deputy chairman of the KPK for the 2019-2023 period. The reason for the request is related to the applicant's age when he was appointed, 45 years old, and when his position ended, he was 49 years old. So he cannot nominate himself as KPK leader for the next period as stated in Article 29 letter (e) of Law Number 19 of 2019. Also, the term of office for KPK leaders is 4 years for re-election for one period in Article 34 of Law No. 30 of 2002 is considered discriminatory regarding the terms of office of heads of other independent state institutions. The applicant feels that his constitutional rights have been violated due to injustice, discrimination and legal uncertainty. This decision is considered not urgent and is not in accordance with the concept of constitutional theory, justice and legal certainty. The age restriction setting is an open legal policy. And increasing the term of office of the KPK is not urgent considering the performance and achievements of the current KPK leadership. Abstract

Konstalasi politik di tengah perjalanannya seringkali menemukan permasalahan baik dari pelaksanaan politik maupun regulasi yang mengaturnya. Dari sekian banyak Undang-undang tentang pemilu yang diuji oleh Mahkamah Konstitusi, penulis tertarik menarik kesimpulan MK terkait Undang-undang Nomor 10 tahun 2008 tentang Pemilihan Umum Anggota Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, dan Dewan Perwakilan Rakyat Daerah. Penelitian ini bertujuan untuk melihat apa yang melatarbelakangi putusan mahkamah konstitusi nomor 22-24/PUU-VI/2008 dan bagaimana dampaknya terhadap peningkatan partisipasi calon legislatif di kota Jambi. Jenis penelitian ini adalah penelitian lapangan atau penelitian hukum empiris dengan menggunakan pendekatan hukum sosiologis, sumber data diambil melalui dua tahapan yaitu wawancara dan dokumentasi. Hasil penelitian menyatakan bahwa putusan mahkamah konstitusi pemilu berdasarkan suara terbanyak dilatarbelakangi karena adanya permohonan dari pemohon yang merasa dirugikan hak konstitusionalnya akibat diberlakukannya pasal 214 huruf a,b,c,d dan e terkait penetapan calon anggota DPR, DPD, dan DPRD berdasarkan nomor urut kecil jika perolehan suara tidak mencapai 30% dari BPP, kemudian terjadi peningkatan partisipasi calon calon yang mendaftarkan diri sebagai calon legislatif pada pemilihan umum legislatif periode 2014-2019 di DPC Partai Persatuan Pembangunan dan PDI Perjuangan kota Jambi akibat keputusan yang menentukan pemenang pemilu berdasarkan suara terbanyak . Untuk menghindari konflik internal parpol dalam penelitian ini penulis merekomendasikan kepada partai politik agar melakukan penjaringan bakal calon legislatif secara tujuan yang mengedepankan integritas, kompetensi dan komitmen terhadap lembaga partai legislatif maupun politik demi keberlangsungan demokrasi yang berkeadilan.

Abstract

Judicial legal policy in Indonesia is an integral part of the dynamics of the formation, implementation, and reform of the national judicial system, which is based on the principles of justice, legal certainty, and the public interest. This study aims to analyze the direction and trends of legal policy in the judicial sector, including its impact on the independence of judicial institutions, access to justice, and the integrity of law enforcement. Using a normative legal method and a historical-comparative approach, this study finds that judicial legal policy in Indonesia is often influenced by the configuration of state power, political dynamics, and socio-economic pressures. Post-reform judicial reforms have brought significant changes, such as the establishment of the Judicial Commission, an integrated information technology-based judicial system, and a push for a clean and transparent judiciary. However, serious challenges remain, including political intervention, judicial corruption, and disparities in access to justice in regional areas. Therefore, the future direction of judicial legal policy must prioritize strengthening the rule of law, protecting human rights, and ensuring the independence of judicial institutions free from the interests of those in power.
