Abstract

The structural changes to the People's Consultative Assembly (MPR) following the 1945 Constitution amendment have created ambiguity in Indonesia’s representative system. The MPR, consisting of the House of Representatives (DPR) and the Regional Representative Council (DPD), does not fully reflect true bicameralism due to the unequal authority between the two chambers. Using a legal-political approach, this study examines the implications of MPR membership for constitutional dynamics and power balance. Findings indicate that regulatory changes and constitutional practices influence MPR’s role and checks and balances in legislation and policymaking, highlighting the need for reforms to strengthen the representative system.

Abstract

This study aims to analyze the effectiveness of Indonesia’s positive law in providing legal certainty and justice for the parties in resolving franchise disputes arising from breach of contract. The research uses a normative juridical method with a statutory and conceptual approach. The findings indicate that Indonesia’s legal framework on franchising has been comprehensively regulated under Government Regulation No. 42 of 2007, Minister of Trade Regulation No. 71 of 2019, and the Civil Code provisions. Normatively, these regulations have provided a foundation of legal certainty and protection for both franchisors and franchisees. However, the effectiveness of implementation remains limited due to the lack of administrative compliance among business actors, weak government supervision, and the inequality of bargaining power in standard contracts. Therefore, it is necessary to strengthen state supervision, enhance legal awareness among business actors, and enforce principles of justice and good faith in the execution of franchise agreements, so that the law not only ensures formal certainty but also achieves substantive justice for both parties.

Abstract

This study aims to analyze the disharmony between norms and practices related to interfaith marriage in Indonesia, which has led to legal uncertainty and differences in interpretation in court. The method used is a normative juridical approach with a comparative analysis of regulations and court decisions. The results of the study show contradictions between Law No. 1 of 1974 concerning Marriage (jo. Law No. 16 of 2019), Article 28B paragraph (1), and Article 29 of the 1945 Constitution, as well as technical policies through SEMA No. 2 of 2023. Court decisions also differ, for example, South Jakarta District Court Decision No. 916/Pdt.P/2022/PN JKT.SEL, which granted the request, compared to Supreme Court Decision No. 1400 K/Pdt/1986, which rejected it. This difference causes inconsistency in the protection of citizens' constitutional rights. The novelty of this research lies in offering guidelines for interpreting national law as a uniform reference for law enforcement officials. These findings contribute to strengthening legal certainty, providing practical guidance for judges, input for regulators, and protection of the rights of the community in the practice of interfaith marriage. Thus, this research has direct implications for improving the governance of interfaith marriage law in Indonesia. UU No. 16 Tahun 2019), Pasal 28B ayat (1) dan Pasal 29 UUD 1945, serta kebijakan teknis melalui SEMA No. 2 Tahun 2023.
