Abstract

Criminal law in Indonesia has yet to guarantee justice and human rights of bona fide (good faith) third parties in protecting their confiscated assets in corruption and money laundering cases. Criminal procedural law is inadequate in providing assessments for bona fide third parties. Therefore, Economics and Anthropology are needed in the investigation stage up to the evidentiary stage during trials. In this research, the main problems are formulated as follows: (1) what is the concept, definition, and scope of the assets of third parties in good faith in the laws and regulations in Indonesia? (2) how is the application of legal provisions regarding the protection of third parties with good intentions in corruption and money laundering? (3) what is the ideal role of the Public Prosecutor and Judge in protecting the property of a third party with good intentions in the criminal justice system? Normative law research conducted in this article showed that (1) the concept and understanding of bona fide third parties in civil law can be adopted in criminal law; (2) the application of legal protection to bona fide third parties over their assets in corruption and money laundering cases still depends on the moral goodness of law enforcement officials; and (3) investigators, prosecutors, and judges play an important role in protecting the human rights of bona fide third parties in corruption and money laundering cases.

Abstract

Environmental law is a set of regulations that regulate the protection and management of the environment. Environmental protection and management is a systematic and integrated effort carried out to preserve environmental functions and prevent environmental pollution and/or damage through structuring, utilization, control, maintenance, supervision and law enforcement.The problems in this journal are:What is the criminal responsibility of corporations as perpetrators of criminal acts of environmental pollution and how?efforts to overcome environmental pollution resulting from criminal acts of environmental pollution committed by corporations.The research method was carried out by methodnormative legal research/normative juridical legal research. This research was conducted to identify the application of corporate criminal responsibility teachings in criminal law enforcement. Based on this research, it can be understood that corporate criminal acts in the environmental sector have widespread and complex negative impacts so that they not only cause direct losses to society and the environment but also disrupt the financial and economic stability of the country, considering that environmental criminal acts are carried out with economic motives. The impact on society includes material losses, health and safety problems, and social and moral losses, namely damage to public trust in business behavior. Administrative environmental law functions to resolve the problem of their actions (environmental pollution), civil environmental law functions to provide legal protection to victims of pollution, and criminal environmental law functions to resolve the problem of polluters (perpetrators of pollution).

Abstract

The objectives to be achieved in this study are to determine the causes and efforts to prevent foreigners from entering the Indonesian territorial area illegally. The research method used in this study is normative juridical (normative legal research method). Efforts that can be made to overcome the illegal entry and exit of foreigners include: First, cooperation with immigration in improving the performance of immigration intelligence. Second, create an online foreign national reporting system. Currently, the Directorate General of Immigration has created an online foreign national reporting system or https://apoa.imigration.go.id/. Third, provide a maximum criminal penalty where if reviewed from the regulatory arrangements above, namely for a maximum of one year, this penalty is considered too light even though the state losses incurred are quite large. This is the reason that many foreigners go through back channels to enter Indonesia.

Abstract

Seorang dokter atau tenaga medis lainnya dikatakan melakukan malpraktik jika melakukan praktek kedokteran dengan buruk, berupa kelalaian besar (culpa lata) atau kesengajaan yang tidak mungkin dilakukan oleh dokter pada umumnya dan bertentangan dengan undang-undang, sedemikian sehingga pasien mengalami kerugian. Perbuatan secara medik yang terjadi antara dokter dan pasien dapat merupakan tindak pidana, apabila perbuatan dokter atau tenaga medis lainnya terhadap pasien tersebut memenuhi unsur tindak pidana menurut hukum pidana tertulis. Malpraktik medis terjadi apabila pasien meninggal dunia atau mengalami cacat akibat dokter atau tenaga kesehatan lainnya kurang hati-hati atau kurang cermat dalam melakukan upaya penyembuhan terhadap pasien yang meninggal dunia atau cacat tersebut. Permasalahannya, Bagaimana Pertanggungjawaban Pidana Tenaga Medis yang Melakukan Malpraktik Menurut KUHP maupun Menurut Undang-undang Praktek Kedokteran, Bagaimana Membuktikan Tindakan Malpraktik Tenaga Medis dalam Studi Kasus Nomor 1441/Pidsus/2019/PN. dan Putusan Nomor 1110/K/Pidsus/2012. Kesimpulannya Pertanggungjawaban pidana tenaga medis yang melakukan Malpraktik menurut KUHP maupun menurut Undang-undang Praktek Kedokteran. Kitab Undang-undang Acara Pidana (KUHAP), Undang-Undang Nomor 23 Tahun 1992 tentang Kesehatan serta Undang-undang Nomor 29 Tahun 2004 Tentang Praktik Kedokteran. Dalam membuktikan tindakan Malpraktik tenaga medis dalam Studi Kasus Nomor 1441 /Pidsus/2019/PN. MKS dan Putusan Nomor 1110/K/Pidsus/2012 dilihat dari Putusan Pidana yang diterima oleh masing-masing terdakwa.
