Abstract

Abstrak Perkara-perkara perdata yang terjadi dalam masyarakat dapat menimbulkan konflik dan ketegangan antara pihak-pihak yang terkait. Oleh karena itu, diperlukan suatu upaya yang efektif untuk mengatasi konflik tersebut. Mediasi sebagai salah satu alternatif penyelesaian perkara perdata telah menjadi pilihan yang banyak digunakan. sehingga perlu diketahui tolak ukur keberhasilan dan keterkaitan mediasi dalam penerapanya pada tiap sistem hukum. Tulisan ini bertujuan untuk membandingkan penerapan Mediasi berdasarkan sistem hukum yang dianut. Metode penelitian yang digunakan adalah analisis dokumen dengan mengkaji peraturan perundang-undangan dan artikel terkait. Hasil penelitian menunjukkan bahwa mediasi memiliki perbedaan dalam penerapanya di tiap sistem hukum serta Mediasi diketahui dapat membantu meningkatkan komunikasi dan kerja sama antara pihak-pihak yang terkait, serta mengurangi konflik dan ketegangan. Dengan demikian, mediasi dapat menjadi alternatif penyelesaian perkara perdata yang efektif dan efisien. Kata Kunci: Mediasi, Efektivitas, Upaya Damai, Penyelesaian Sengketa Abstract Civil cases that occur in the community can cause conflicts and tensions between related parties. Therefore, an effective effort is needed to overcome the conflict. Mediation as an alternative to resolving civil cases has become a widely used option. So it is necessary to know the benchmark of success and the relevance of mediation in its application in each legal system. This paper aims to compare the application of Mediation based on the legal system adhered to. The research method used is document analysis by reviewing laws and regulations and related articles. The results of the study show that mediation has differences in its application in each legal system and mediation is known to help improve communication and cooperation between related parties, as well as reduce conflicts and tensions. Thus, mediation can be an effective and efficient alternative to resolving civil cases. Keywords: Mediation, Effectiveness, Peace Efforts,, Dispute Resolution

Abstract

The criminal act of assault is a prevalent offense in society and is regulated under Articles 351 to 354 of the Criminal Code (KUHP). In the evidentiary process of assault cases, the Visum et Repertum (VER) serves a critical role as both documentary evidence and expert testimony, as specified in Articles 133 and 184 of the Indonesian Criminal Procedure Code (KUHAP). However, the admissibility of VER requires compliance with both formal and substantive standards in accordance with medical and legal norms. This study examines formal defects in VER and their legal implications for evidentiary value, using Case Decision No. 309/Pid.B/2024/PN BJM as a case study. The findings reveal that the VER was issued based on a Visum Request Letter (SPV) signed by an unauthorized investigator, and its contents failed to meet the requirements of the Indonesian Medical Competency Standards (SKDI). Despite these deficiencies, the court relied on the VER as the basis for conviction, even though the case lacked two valid pieces of evidence and no witness directly observed the alleged crime. This research concludes that formal defects in VER can undermine the principles of legality and legal certainty, and may violate the defendant's fundamental rights.
