Abstract

The legal protection of child labor rights in Indonesia, which is regulated in the Indonesian legislation, was not yet ideal. There are many working children (aged 13 to 15 years) in Indonesia whose rights to a prosperous life have not been fulfilled, both in the maqāṣid al-sharī‘ah dimension and in the welfare state dimension. Thus, this research was about the ideal legal protection for the rights of child workers in Indonesia, and the aim was to know and look for the concept of ideal legal protection for the rights of child workers of 13-15 years of age in Indonesia which was in accordance with maqāṣid al-sharī‘ah and the welfare state. This normative research discussed the constitution and laws related to child labor rights by examining the main legal materials, theories, concepts and legal bases related to this research. The results of this research explained that the legal protection of child labor rights in Indonesia was not yet ideal due to lack of clarity in the labor law itself. Meanwhile, the findings in this research; legal protection for the rights of child workers aged 13 to 15 years in Indonesia was not yet ideal because it was not yet in accordance with the dimensions of maqāṣid al-sharī‘ah and the welfare state, and because child labor in Indonesia was still considered unlawful, therefore many children in Indonesia became neglected and poor.

Abstract

Kepala desa memiliki kewenangan strategis dalam penyelenggaraan pemerintahan desa, termasuk kewenangan mengangkat dan memberhentikan perangkat desa sebagaimana diatur dalam Undang-Undang Nomor 6 Tahun2014 tentang Desa yang telah diubah dengan Undang-Undang Nomor 3Tahun2024. Namun, dalam praktiknya kewenangan tersebut sering dijalankan secara diskriminatif dan tidak objektif. Artikel ini bertujuan untuk menganalisis tugas dan kewenangan kepala desa yang bersifat diskriminatif terhadap perangkat desa berdasarkan Pasal 26 huruf b, Pasal 49 ayat (2), dan Pasal 53 UU Desa, ditinjau dari perspektif hukum tata negara dan fiqih siyasah. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil kajian menunjukkan bahwa tindakan diskriminatif kepala desa merupakan bentuk penyalahgunaan kewenangan yang bertentangan dengan prinsip negara hukum berdasarkan demokrasi Pancasila serta nilai keadilan dan amanah dalam fiqih siyasah.

Abstract

This study analyzes the legal protection for whistleblowers in narcotics criminal cases in Indonesia through the perspective of Islamic Constitutional Law (Siyāsah Shar‘iyyah) and the theory of maqāṣid al-sharī‘ah. As an extraordinary crime, narcotics require active public participation, yet whistleblowers often face significant legal and physical risks. This normative legal research uses a statutory and conceptual approach to evaluate Law No. 35 of 2009 on Narcotics, Law No. 31 of 2014 on Witness and Victim Protection, and the 1945 Constitution. The results indicate a normative vacuum and regulatory fragmentation that fail to provide absolute immunity for whistleblowers. From an Islamic perspective, protecting whistleblowers is a constitutional-theological obligation to safeguard the five essential elements (al-darūriyyāt al-khamsah), particularly hifẓ al-nafs (protection of life) and hifẓ al-‘aql (protection of intellect). This study proposes a legal reconstruction that integrates constitutional principles with maqāṣid al-sharī‘ah to ensure comprehensive protection and legal certainty for those reporting narcotics crimes.
