Abstract

The ratification of the nazhir legal entity is related to the Notary's role in the waqf legal actions that have been ongoing thus far. The purpose of this research is to ascertain the Authority of a Notary to act as the Official for Making Waqf Pledges (PPAIW) and the implementation of the making of the Waqf Pledge Deed by a Notary who acts as the Official for Making Waqf Pledges (PPAIW). This examination is a clear exploration. Enlightening exploration expects to precisely depict the qualities of an individual, condition, side effect or certain gathering, or to decide the spread of a side effect, or to decide if there is a connection among side effects and different side effects in the public eye. Execution of making the Deed of Waqf Promise completed by a Legal official as PPAIW which is as expressed in the clarification of the arrangements of the Law on Legal official Position Number 2 of 2014 concerning Revisions to Regulation Number 30 of 2004 concerning.

Abstract

Penyuluhan hukum yang akan disampaikan dalam pengabdian ini berkaitan dengan permberian upah dan insentif di lingkungan pusat pasar kota Medan. Diataranya penyuluhan yang di kenal dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan peraturan pelaksananya. Adapun manfaat yang dirasakan adalah buruh harian pasar lebih memahami terkait dengan upah minimum yang harus disetor dan diberikan oleh atasannya. Kesimpulannya adalah Tim pengabdian UNPAB memberikan arahan sesuai dengan arahan pedoman kerja yang akan dilakasanakan oleh setiap buruh, karyawan dan juga bos yang ada di pasar Central Medan. Dengan adanya kegiatan ini maka, karyawan juga dapat memahami hak dan tanggung jawabnya, begitu juga sebagai pengusaha yang tidak hanya mementingkan pendapatanya saja dan tidak mau memperhatikan kesejahteraan karyawan nya. Untuk itu pentingnya perlindungan hukum dan wabah sebagai tempat untuk menampung aspirasi masyarakat

Abstract

SMK (SMEA) Swasta Panca Budi Medan merupakan salah satu kampus yang sudah sangat maju di kota Medan. Perkembangan SMK Swasta Panca Budi Medan terus mengalami peningkatan setiap tahunnya baik dari jumlah mahasiswa, fasilitas sekolah yang sangat memadai serta para guru yang mengajar juga sangat profesional. Kegiatan pengabdian ini dilakukan untuk membangun pola pikir siswa dalam meminimalisir tindakan kriminal karena akan berakibat buruk bagi mereka. Penegakan hukum bagi seorang kriminal harus ditindak dan diproses sesuai dengan Undang-Undang yang berlaku. Kriminalitas harus dihindari oleh setiap siswa yang ada di sekolah-sekolah khususnya di SMK Panca Budi. Setiap siswa wajib melaporkan kepada orang tua, guru apabila terdapat pelanggaran yang bersifat kriminal dari siswa yang melakukan hal tersebut

Abstract

Land law in Indonesia faces complex challenges due to ownership conflicts, overlapping regulations, and weak law enforcement. The mismatch between outdated regulations and the needs of modern society often gives rise to land disputes, uncertainty over rights, and obstacles to investment. This study analyzes the dynamics of land law in Indonesia, focusing on the urgency of legal reform. The methods used are normative studies and descriptive analysis of laws and regulations, court decisions, and related literature. The findings indicate that land law reform is needed to harmonize regulations scattered across various laws, strengthen legal certainty, and increase public access to land rights. Furthermore, improving administrative procedures, simplifying certification mechanisms, and protecting the rights of indigenous peoples are crucial aspects of reform. This study emphasizes the need for regulatory harmonization and increasing the capacity of law enforcement agencies to reduce land conflicts. In conclusion, land law reform is not only crucial for social and economic stability but also serves as a foundation for equitable, sustainable development. With effective reform, it is hoped that land rights security for all levels of society can be achieved, disputes can be minimized, and a healthy investment climate can be supported.

Abstract

Infrastructure development in Indonesia often involves complex land issues, including ownership conflicts, land acquisition, and socio-economic impacts on local communities. This study aims to analyze the sustainability of land development from a legal perspective through case studies of infrastructure projects in Indonesia. The methods used are normative and descriptive studies, reviewing laws and regulations, project documents, and related literature. The analysis shows that sustainable land development requires regulatory harmonization, legal certainty for landowners, and fair compensation mechanisms. Weaknesses in legal implementation, complicated administrative procedures, and lack of community participation have the potential to give rise to disputes and delay project implementation. This study emphasizes the importance of integrating legal principles with development planning, including the protection of community rights, transparency, and accountability of relevant institutions. With an effective legal approach, infrastructure projects can be sustainable, reduce land conflicts, and increase socio-economic benefits for communities. These findings provide recommendations for strengthening land regulations, clarifying land acquisition procedures, and improving inter-agency coordination so that infrastructure development can align with the principles of sustainability and legal certainty in Indonesia.

Abstract

Land disputes between the government and citizens are a frequent problem in Indonesia, triggered by unclear ownership, regulatory conflicts, and complex administrative procedures. This study aims to analyze the role of land law in resolving these conflicts and the effectiveness of the mechanisms implemented by the government. The method used is a normative study with an analysis of statutory documents, court decisions, and related literature. The results show that land law serves as a basis for legitimizing ownership, a guideline for dispute resolution, and a tool for enforcing community rights. However, in practice, obstacles remain, such as overlapping regulations, weak inter-agency coordination, and limited public access to legal information. The study emphasizes the importance of reforming land legal procedures, increasing transparency, and protecting community rights in all land policies. With clear and fair law enforcement, it is hoped that disputes between the government and citizens can be minimized, legal certainty guaranteed, and public trust in the land system increased. These findings provide a basis for developing more responsive, effective, and equitable land law policies for all parties.

Abstract

The development of Artificial Intelligence (AI) technology, particularly Natural Language Processing (NLP) and Optical Character Recognition (OCR), has brought significant efficiencies to legal document processing. In notarial practice, AI can be utilized for data extraction, automating deed drafting, verifying identity validity, and precisely and quickly identifying potential risky clauses. Conclusion Legal Alignment: By embedding Privacy by Design principles directly into the technical pipeline, the system bridges the gap between AI automation and legal compliance, satisfying both the strict confidentiality mandates of the Notary Position Law (UUJN) and the technical protection standards of the Personal Data Protection Law (UU PDP).

Abstract

This study aims to analyze the forms of legal protection for the rights of indigenous peoples to customary land amidst increasing investment and regional expansion, while simultaneously formulating strengthening measures that can maintain legal certainty and justice for indigenous peoples. The study uses a normative legal method with a statutory approach, a case approach, and a conceptual approach. Primary legal materials include the 1945 Constitution of the Republic of Indonesia, the Basic Agrarian Law, the Human Rights Law, Regulation of the Minister of Agrarian Affairs and Spatial Planning or the Head of the National Land Agency Number 14 of 2024, and Constitutional Court Decision Number 35/PUU X/2012. Data are analyzed qualitatively through systematic and teleological interpretation to examine the relationship between the recognition of customary rights, land governance, investment, and human rights protection. The results of the study indicate that customary land has a fairly strong basis for recognition in the Indonesian legal system, but its implementation still faces obstacles in the form of complicated recognition procedures, overlapping maps and permits, limited access to information, unequal bargaining positions, and consultations that do not always reflect the free and conscious consent of the community. Protection needs to be strengthened through participatory mapping, integration of customary territory data into spatial planning and licensing systems, meaningful consultation, independent legal assistance, equitable benefit-sharing agreements, and effective complaint and redress mechanisms. This approach ensures that investment can proceed without compromising the sustainability of livelihoods, cultural identity, and collective rights of indigenous communities.

Abstract

This study aims to analyze the legal certainty of electronic certificates as an instrument for protecting land rights and to examine their role in preventing land disputes in Indonesia. The development of digitalization of land administration through the implementation of electronic certificates is expected to improve data security, accelerate services, and minimize the risk of forgery, overlapping ownership, and administrative errors, which have been the main causes of land disputes. This study uses a normative legal research method with a statutory approach, a conceptual approach, and a case approach. Data were obtained through a literature review of laws and regulations, court decisions, and various scientific literature related to land law and the transformation of digital-based land services. The results show that electronic certificates have the same legal force as conventional certificates as long as they are issued in accordance with applicable laws and regulations. The electronic system also guarantees data authentication, integrity, and security, thereby strengthening legal certainty for land rights holders. However, the effectiveness of electronic certificates in preventing land disputes is still influenced by the readiness of technological infrastructure, the quality of land data validation, the competence of human resources, and the level of public trust in the digital system. Therefore, strengthening regulations, improving cybersecurity, and continuously updating land databases are important factors in realizing legal certainty and reducing the potential for land disputes in Indonesia.

Abstract

This research aims to analyze the recognition of communal land rights of indigenous communities within the framework of sustainable development and environmental protection. Customary land is not merely an economic asset, but rather the foundation of the cultural identity, social structure, and survival of indigenous communities. Although the 1945 Constitution, through Article 18B paragraph (2) of the 1945 Constitution, mandates the recognition and respect of indigenous communities and their traditional rights, its implementation still faces various challenges. The research method used is a juridical-normative approach, supported by case study analysis from various regions in Indonesia, including West Sumatra, Papua, and Rempang. Data were collected through a review of relevant laws and regulations, policy documents, and various previous studies. The results show that the recognition of communal land rights is closely linked to environmental sustainability. Indigenous communities play a crucial role in maintaining ecosystem sustainability through local wisdom practices passed down through generations. However, a development paradigm that still views nature as an object of extraction often ignores these communal rights. The government has demonstrated its commitment by issuing 41 Management Rights Certificates for customary land in seven provinces. However, this policy also has the potential to create conflict if it does not involve communities meaningfully. This study concludes that recognizing communal land rights must be the foundation of inclusive, sustainable development, using local wisdom as a guide and ensuring the active participation of indigenous communities in all decisions concerning their land and territories.
