Abstract

Perkembangan kehidupan sosial masyarakat dewasa ini menimbulkan permasalahan yang kompleks baik dari sisi hukum maupun masalah sosial lainnya. Era digital memberikan dampak yang cukup besar baik dampak positif maupun dampak negative bagi kehidupan masyarakat. Dampak positif dari perkembangan era digital yaitu membuat mobilitas lebih efektif dan efisien dengan kemudahan teknologi.Cyberspace telah menjelma menjadi ruang publik (publicsphere) sebagaimana diungkapkan oleh Hubermas. Internet menjadi media diskusi publik yang terbuka bagi setiap individu tentang berbagai tema tanpa pembatasan. Cyberspace juga telah mengalihkan kegiatan manusia yang semula dilakukan didunia nyata. Kehadiran email, weblog, chat, webcam sampai dengan facebook dan twiter, kemudian adanya elearning, e-commerce dan e-banking menjadi media baru beraktivitas yang selama ini dilakukan secara fisik. Era digital tidak terlepas dai cyberspace dimana seluruh informasi dapat diakses melalui berbagai situs. Akan tetapi hal tersebut menjadi celah untuk melakukan kejahatan karena kemudahan perolehan data. Masalah kebocoran informasi saat ini semakin beragam.Perubahan pola kehidupan masyarakat secara realita ini tidak selalu berdampak positif, bahkan terkandang dampak negative yang ditimbulkan sering tidak terkendali disebabkan belum adanya peraturan yang mengikatnya. Disatu sisi dampak perubahan pola hidup masyarakat dari era modern ke era digitalisasi memberikan kemudahan sekaligus memperluas tindak kejahatan secara global. Perkembangan teknologi senantiasa membawa dampak secara langsung maupun tidak langsung, baik dalam arti positif maupun negatif, dan akan sangat berpengaruh terhadap setiap sikap tindak dan sikap mental setiap anggota masyarakat. Permasalahan ini membuat perusahaan harus lebih cepat tanggap dalam menyesuaikan sistem kerja dengan perubahan cara kerja dunia digitalisasi. Istilah kejahatan maya (cybercrime) melahirkan hukum cyber (cyber of law). realitas di dunia dapat terkoneksi dengan dunia virtual melalui bantuan internet. Ini yang menyebabkan terjadinya berbagai perubahan dalam kehidupan manusia, terutama di dunia bisnis. Kemajuan teknologi yang ada di dalamnya membuat wajah industri dunia berubah secara drastis.Bagi berbagai perusahaan, era revolusi industri 4.0 merupakan fenomena yang mutlak dan tidak bisa dihindari. Perusahaan harus mempunyai strategi yang mampu melakukan transformasi dan inovasi untuk menghadapinya. Ini agar perusahaan dan bisnis yang telah dibangun tidak tergilas oleh zaman dan terhambat perkembangannya. Perusahaan harus sudah memiliki sebuah peta perjalanan yang terintegrasi sehingga arah pengembangan bisnis terlihat dengan jelas. Saat ini pemerintah Indonesia pun telah memunculkan strategi yang membuka jalan menuju Indonesia 4.0. Jika dikaitkan dengan perusahaan, peta strategi yang dikeluarkan ini digadang-gadang sebagai solusi untuk mempercepat pengembangan industri nasional di era digital ini.Perusahaan yang mampu bersaing adalah perusahaan yang mampu mengimplementasikan teknologi ke dalam perusahaannya. Salah satu jenis implementasi teknologi dalam hal meningkatkan persaingan bisnis dan penjualan produk-produk adalah dengan menggunakan electronic commerce (e- Commerce) yang dapat membantu memasarkan berbagai macam produk atau jasa, baik dalam bentuk fisik maupun digital. Dalam penggunaan teknologi tersebut, berbagai pihak yang terkait dengan perusahaan seperti investor, konsumen, pemerintah akan ikut berperan dan dapat memberikan manfaat yang sangat besar bagi kelancaran proses-proses bisnis.

Abstract

ABSTRACTCorporate governance (corporate governance) is a concept which still debatable among experts in describing it. The purpose of this study is to explore how the implementation and principle problems of good corporate governance in the management of current limited liability company. This research is kind of library research with normative juridical approach, the approach used was the concept of legit positivism which states that the law is identical to written norms established and enacted by authorized bodies or authorities. The result is known that Law Number 40 Year 2007 regarding Limited Liability Company does not explicitly regulate the implementation of Good Corporate Governance principles. The GCG principle setting is explicitly found only in the Regulation of the Minister of State-Owned Enterprises and Bank Indonesia Regulation, so it does not bind the limited liability company in general.

Abstract

In the current era of globalization, the ease and speed of obtaining something is highly sought after, including the ease and speed of obtaining financial services. This new method is a digital financial service that offers and provides convenience and speed of financial services. It is hoped that this method will provide convenience for the public to obtain financial services. But we need to remember that in our constitution, Indonesia is a state of law so that everything that is done in this country must be based on the law. Including digital finance businesses must be regulated and supervised by existing laws in Indonesia. Based on the research results, it is known that the financial business in Indonesia is regulated and supervised by three institutions, namely the Ministry of Communication and Information, Bank Indonesia, and the Financial Services Authority.

Abstract

Pada penghujung tahun 2019, dunia menghadapi tantangan dengan munculnya Corona Virus Disease (Covid) - 19 yang mewabah di Kota Wuhan, China. Konstitusi mengatur secara umum landasan norma kebijakan oleh Pemerintah. Konstitusi negara yang berbicara tentang persoalan ekonomi terdapat pada pasal ”Perekonomian disusun sebagai usaha bersama berdasar atas asas kekeluargaan” (Pasal 33 Ayat 1). Asas kekeluargaan Pasal 33 ayat 1 telah menggambarkan secara gamblang bahwa konsep pembangunan ekonomi kita berbasis asas kewarganegaraan amanat kontitusi yang mengarah pada terciptanya negara walfare state. Yaitu negara yang pemerintahannya menjamin terselenggaranya kesejahteraan rakyat. Oleh karenanya, pembangunan ekonomi mesti berdasarkan konstitusi secara substantif dengan asas kekeluargaan sebagai soko guru perekonomian yang dicita-citakan oleh pendiri bangsa. Untuk itu, diperlukan kesadaran dalam menerapkan kembali nilai-nilai ideologi di bidang ekonomi dalam konstitusi secara substansif guna penguatan ekonomi terdampak yang covid-19 ini agar roda ekonomi kembali pulih serta semakin kuat dan kokoh

Abstract

Each country basically has the right to sail in its territorial sea, exclusive economic zone, open sea, and territorial sea belonging to other countries. But in this case relating to the right to sail at sea or territorial waters belonging to other countries, Subject to the provisions of the 1982 Sea Law Convention II, ships of all countries, both coastal and non-coastal countries, enjoy the right of peaceful crossing through territorial seas. The problem in this study is how the legal arrangement of the authority of the sea and coast guard unit in the enforcement of violations of the right to cross the peace in Indonesian waters ,. The conclusion of this study Law enforcement at sea is still sectoral because many government agencies are authorized at sea with various legal bases at their disposal and have the potential to cause many legal problems, including overlapping authority between law enforcement agencies which causes conflicts between law enforcement agencies so optimize the interagency sector that exists in the supervision and protection of jurisdictions in the waters, and strict sanctions must be held against violations of the right to peace in the path of the rights to peace in Indonesia Keywords: Authority, Sea and Coast Guard Unit, Right of Peace ABSTRAK Setiap negara pada dasarnya memiliki hak untuk berlayar di laut teritorialnya, Zona ekonomi eksklusif, laut lepas, dan laut territorial milik negara lain. Namun dalam hal ini berhubungan dengan hak untuk berlayar di laut atau perairan teritorial milik Negara lain, Dengan tunduk pada ketentuan Konvensi Hukum Laut II Tahun 1982 , kapal semua negara, baik negara berpantai ataupun negara tak berpantai, menikmati hak lintas damai melalui laut teritorial. Permasalahan dalam penelitian ini adalah bagaimana pengaturan hukum kewenangan kesatuan penjagaan laut dan pantai dalam penindakan pelanggaran hak lintas damai di perairan indonesia,. Kesimpulan dari penelitian ini Penindakan hukum di laut masih bersifat sektoral karena banyak instansi pemerintah yang berwenang di laut dengan berbagai dasar hukum yang dimilikinya dan berpotensi menimbulkan banyak permasalahan hukum, di antaranya tumpang tindih wewenang antar instansi penegak hukum yang menimbulkan konflik antar lembaga penegak hukum sehingga perlu mengoptimalkan sektor antar lembaga yang ada dalam pengawasan dan perlindungan wilayah hukum di perairan, serta perlu diadakan sanksi yang tegas terhadap pelangaran hak lintas damai di jalur hak lintas damai di perairan indonesia Kata Kunci: Kewenangan, Kesatuan Penjagaan Laut dan Pantai, Hak Lintas Damai

Abstract

Currently, the presence of business entities in Indonesia continues to increase in terms of quantity and form, and some are legal entities or not. Village-Owned Enterprises (BUMDes) are expected to improve the economy and public services to the community in the village. Law Number 6 of 2014 concerning Villages (UU Desa) mentions BUMDes as a business entity. The Business Entity in question is not specifically specified in the Village Law. This study aims to analyze the status of BUMDes as legal subjects and after the enactment of Law Number 11 of 2020 concerning Job Creation (UU Cipta Kerja) and its implications because Article 117 of the Job Creation Law changed article 1 number 6 of the Village Law which previously referred to BUMDes as an agency business is converted into a legal entity.

Abstract

Mergers, consolidations, and acquisitions can be a tool for business actors to get rid of their competitors. One of the merger guidelines that can be used to assess whether the consequences of a merger will affect business competition or not is the Merger Review Guidelines (MRG). In Article 29 of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition, it is expressly stated that business actors are obliged to report the occurrence of a merger no later than 30 days after the transaction. A notary is a public official who is authorized to make an authentic deed as long as the making of a certain authentic deed is not reserved for other public officials. From the point of view of laws and regulations, the position of a Notary in the acquisition process is very clear, especially in Government Regulation Number 27 of 1998 concerning Merger, Consolidation.

Abstract

This research was conducted to explain the partial or simultaneous influence of the variables of motivation, compensation, and work discipline on the performance of employees at PT. Mewah Indah Jaya. The total population used is 70 respondents, employees who work at PT. Mewah Indah Jaya which was taken using a questionnaire as a data collection method in this study. This study uses multiple linear regression analysis. The results of the analysis show that there is a simultaneous significant effect between the three variables, and a partially significant influence between the motivation, compensation and work discipline variables on the performance of employees at PT. Mewah Indah Jaya.

Abstract

Human quality as a workforce is the basic capital to create good performance. Work performance for employees in a company is important, as well as creating a work performance is a dream and hope that every company must achieve. Work motivation, work communication and employee personality are some of the factors that affect the work performance of an employee in a company. This research was conducted at Perum Perumnas Regional I Medan, which is a State-Owned Enterprise in the form of a National-based Public Company. The research population of Perum Perumnas Regional I Medan employees as the sample is 78 employees. This study aims to determine whether there is an influence of work motivation, work communication, and employee personality on the work performance of employees who are moderated at Perum Perumnas Regional I Medan. This research method uses a moderating     2      model. The results of the study contained 2 (two) independent variables, namely work motivation and work communication, 1 (one) moderating variable, namely the personality of the employee, and 1 (one) dependent variable which had a significant influence on the work performance of Perum Perumnas Regional I Medan. Suggestions submitted to the company's management, should pay attention to the role of its employees, in order to improve employee performance.   Keywords: Motivation, Communication, personality , work performance.

Abstract

This study aims to test and analyze the effect ofoccupationalsafety (X1) andhealth(X2) on the performance (Y) of employees at PT. PLN (Persero) Customer Service Unit of West Binjai. The data analysis technique used in this study is descriptive quantitative, with the number of samples are 50 respondents. The analysis used is statistical data analysis using namely multiple linear regression analysis and hypothesis testing. The result of this study shows that world safety (X1) partially has a positive and significant effect on the performance of employees at PT. PLN (Persero) Customer Service Unit of West Binjai. Likewise, the health (X2) partially has positive and significant effect on the performance of employees at PT. PLN (Persero) Customer Service Unit of West Binjai. then, the simultaneous testing of the variables in this study consisting of occupational safety and health have a positive and significant effect on the dependent variable which is the performance of employees at PT. PLN (Persero) Customer Service Unit of West Binjai.
