Abstract

The formation of the School Committee which has been stipulated in the Decree of the Minister of National Education No. 044/U/2002 dated 2 April 2002, is a mandate from Law no. 25 of 2000 concerning the National Development Program (Propenas) for 2000-2004, with the aim that the formation of School Committees can realize school/community-based education management (school/community-based management). The formation of School/Madrasah Committees is stronger from the legal aspect. Community participation through the School Committee has a very strategic position in developing community responsibility for educational progress. An important aspect of community participation through the School Committee is related to building an attitude of awareness of the quality of education in the community and knowing the meaning and importance of the existence of schools for their children. This type of research is Normative and. The aim of this research is to determine the role of school committees in improving the quality of national education services in the education system. Data obtained through several methods, namely to facilitate data analysis, is then interpreted using inductive thinking, namely based on specific knowledge and then a general solution is taken. , so as to produce conclusions that can be accounted for. Based on the results of the analysis of observation data, interviews and documentation obtained, it can be concluded that the role of the School Committee in Improving the Quality of East education can be carried out with the school Committee as an Advisory agency (giving consideration), the school Committee as a Supporting agency (supporting educational service activities, school committee as controlling agency (controlling educational service activities), school committee as mediator (liaison or communication link between the community and the government).

Abstract

Sebagai negara yang berada pada perlintasan dua benoa dan dua samudera, Indonesia termasuk negara yang rawan dari sisi keamanan laut, baik keamanan laut yang bersifat lokal, nasional, maupun internasional. Perompakan di perairan Indonesia masih sering terjadi, baik yang dilakukan oleh orang Indonesia sendiri maupun orang asing, baik yang ditujukan kepada kapal nelayan Indonesia, maupun kepada kapal asing. Penetapan prioritas pembangunan sektor maritim ini sangat beralasan bila dilihat dari sudut sejarah bangsa. Nenek moyang bangsa ini dikenal sebagai bangsa pelaut atau bangsa bahari dan pernah jaya di laut di masa sebelum kehadiran kolonialisme, melalui perdagangan antar pulau. penulis, maka metode penelitian Hukum normatif adalah metode atau cara yang dipergunakan di dalam penelitian Hukum yang dilakukan dengan cara meneliti bahan pustaka yang ada. Deskriptif Analistis, karena data yang dikumpulkan adalah berupa kata-kata, gambar, dan bukan angka-angka. Hal itu disebabkan oleh adanya penerapan metode kualitatif dapat di simpulkan Upaya pembangunan kemaritiman di Indonesia bukan hal yang mudah, permasalahan ini dikarenakan latar belakang karakter maritim yang kian memudar. Persepsi tentang kemaritiman masih berupa puzzle yang belum optimal tersusun secara benar.

Abstract

This study, entitled "A Legal Review of the Position of CCTV Recordings as Evidence in the Investigation and Proving of Criminal Cases (A Case Study at the Rembang Police Department and the Rembang District Court), aims to determine the position of CCTV recordings as evidence in the investigation and proving of criminal cases at the Rembang Police Department and the Rembang District Court. It also aims to identify the obstacles and solutions faced by the police and judges in the investigation and proving of criminal cases through CCTV recordings. The research method uses a sociological legal approach. Data sources were obtained through several stages, namely field research (interviews) and library research. Data analysis was carried out systematically, including data reduction, data presentation, and drawing conclusions. Based on the research results, it can be concluded that the position of CCTV recordings as evidence in the investigation and proving of criminal cases at the Rembang Police Department and the Rembang District Court is that CCTV recordings are intended to expedite and simplify the process in court proceedings, and are permissible as long as the process is conducted in a manner permitted by regulations and other legal norms. The solution to address this problem is to provide training for members in digital forensics and to seek assistance from the central government, namely the regional police, to bring in experts in the field of digital forensics.

Abstract

The sea is the boundary between a country and another country which is determined through extradition. On December 13, 1957 the government issued a statement known as the Djuanda Declaration with the intention of uniting the fragmented land areas so that the declaration would close the existence of the open sea between mainland islands by covering the problem of the ideal concept of regulating the authority to enforce maritime accident laws in indonesian territorial waters. The approach method in this research is normative juridical based on an analysis of the law. Then it is described in a descriptive-analytical description. The problem is investigated by describing/describing the condition of the subject/object of research, finding facts thoroughly, and systematically reviewing national regulations. Conclusion maritime law enforcement can cause potential friction between one institution and another. For this reason, this research provides a concept that maritime security and law enforcement institutions will be productive and effective-efficient if they are in accordance with Pancasila.

Abstract

Digital signatures can provide a greater guarantee of document security than regular signatures. The recipient of the electronic message which is affixed with a digital signature can check whether the message really came from the correct sender and whether the message has been altered after being signed either intentionally or unintentionally in the case of electronic payment systems. The formulation of this research problem is how the authenticity of digital signatures according to Law Number 11 of 2008 concerning Electronic Information and Transactions and how the legal power of digital signatures in proving civil disputes is reviewed from Law Number 11 of 2008 concerning Electronic Information and Transactions. The research method used in this research is a type of normative research. The results of the discussion in this study are as follows: It needs to be well understood by legal practitioners that an electronic signature, not a scanned signature image is then placed on a document, so that a document is impressed (on a computer monitor screen) signed. The actual definition of an electronic signature (according to the ITE Law) can be made in various ways, including by means of a digital code that is attached to an electronically transmitted message, which will specifically provide a special identification of the sender. The strength of the burden of proof inherent in digital signatures in terms of proving that civil procedural law has the strength of the evidence burden at the level of an underhanded deed (ABT), therefore the strength of the evidence load inherent in signatures in electronic mail is only the strength of formal proof and material proof.

Abstract

Penelitian ini berjudul, “Mediasi Penal Ditingkat Kepolisian Dalam Mewujudkan Restoratif Justice”.Permasalahan yang dibahas dalam Penelitian ini adalah Penerapan mediasi oleh pihak kepolisian dalam penanganan tindak pidana sebagai upaya mewujudkan restoratif justice dan Faktor-faktor yang menghambat penerapan mediasi oleh kepolisian dalam upaya mewujudkan restoratif Justice. Metode penulisan yang digunakan dalam Penelitian ini adalah penelitian Normatif. Mediasi oleh pihak kepolisian dalam penanganan perkara tindak pidana sebagai upaya mewujudkan restoratif justice. Penyelesaian perkara pidana khususnya tindak pidana kepolisian. Peroses mediasi ini dilakukan oleh penyidik kepolisian agar terjadi pemecahan atas permasalahan hukum yang terjadi, sehingga kedua belah pihak merasa mendapatkan keadilan yang diinginkannya., Faktor penghambat penerapan perisip restoratif justice dalam penyelesaian perkara pidana adalah: Tidak adanya aturan hukum yang mengatur proses mediasi penal dalam penyelesaian perkara pidana, kewenangan diskresi yang dimiliki aparat kepolisian dalam mengambil langkah penyelesaian perkara pidana memiliki celah penyimpangan, aparat penegak hukum terkadang selalu berpegang teguh pada asas legalistik formal sehingga aparat kepolisian yakni penyidik mengesampingkan rasa keadilan serta kemanfaatan yang ada di masyarakat.
