Abstract

Mediator merupakan pihak penengah dalam rangka membantu menyelesaikan perkara diantara para pihak yang berselisih. Peluang bagi para sarjana hukum adalah berkontribusi dalam rangka mengisi mediator non hakim di pengadilan ataupun mengelola mediasi secara pribadi. Pada implementasinya bahwa eksistensi mediator non hakim masih belum dilirik banyak sarjana hukum. Hal ini karena biaya pelatihan mediator cukup mahal, kepercayaan masyarakat pada mediator non hakim yang berbeda dengan mediator hakim, jasa menggunakan mediator non hakim memerlukan biaya tambahan yang harus dikeluarkan oleh para pihak, kolaborasi pengadilan agama dengan para mediator non hakim yang tidak merata, dan cerai gugat putusan verstek sehingga peran mediasi jarang terealisasikan. KUA dan Pengadilan Agama belum bersinergi dengan baik dalam rangka mewujudkan keluarga sakinah. Strategi yang ingin dimiliki seorang mediator dalam upaya memediasi adalah menguasai forum mediasi, mampu bersikap netral atau mengelola emosi, menjadi pendengar yang baik, menguasai ilmu pengetahuan terkait hukum, kemampuan komunikasi yang baik, kuat dalam upaya negosiasi, reframing/membingkai ulang, dan merancang ulang masalah, memiliki berbagai macam solusi alternatif yang ditawarkan bagi pihak yang dimediasi.

Abstract

Islamic law and customary law are two legal systems that collaborate in carrying out their roles in inheritance law. This research focuses on the comparative analysis of legal dualism (Islamic law and customary law). It was found that the basic principles of Islamic inheritance law in its implementation include, proportionately determined by the heirs (who is entitled and how much), carried out after the completion of the arrangement of the body, debts and wills of the deceased, and carried out on the basis of mutual agreement among the heirs. Meanwhile, the principles of the implementation of customary inheritance law include, the important role of customary elders in the division and resolution of conflicts regarding inheritance, generally carried out in a familial manner with a concept that has usually been passed down from generation to generation in the family, and paying attention to the kinship systemThe implementation of inheritance is not only a legal obligation, but also has an impact on the representation of social and social ties, economic stability, and family prosperity. Abstract

This research discusses the legal implications of the rejection of inherited property in the perspective of Islamic law and the Indonesian civil law system (Civil Code). In Islamic law, the rejection of inherited property is understood as the resignation of an heir or several heirs from their right to receive a share of the inheritance, provided that it can be accompanied by the provision of compensation either from the inherited property itself or from other heirs, as stipulated in Article 183 of the Compilation of Islamic Law (KHI). Meanwhile, in the Civil Code Article 1057-1058, the refusal is made expressly through an official statement before the Registrar of the District Court in the jurisdiction where the inheritance is open. This research uses a normative juridical method with a comparative approach to analyze the doctrines of classical Islamic inheritance law and the provisions of positive Indonesian legislation. The results show that in Islamic law, rejection does not erase the status of heirs, but only serves as a voluntary relinquishment of rights. In contrast, in the civil law system, rejection causes a person to be considered never to be an heir so that all rights and obligations, including the obligation to pay off the testator's debt, are canceled. This difference indicates a difference in legal philosophy: Islamic law emphasizes family management and balance of justice between heirs, while civil law emphasizes procedural certainty and protection of third parties, especially creditors. This study emphasizes the importance of harmonizing the principles of the two legal systems within the framework of Indonesia's pluralistic inheritance law to prevent inheritance disputes.
