Abstract

Indonesia termasuk ke dalam 7 (tujuh) negara penyumbang populasi narapidana terbanyak di dunia. Jumlah narapidana terbanyak di Indonesia adalah kasus Narkotika. Data menunjukan bahwa pda tahun 2019 narapidana narkotika mencapai 115.000 orang. Hingga akhir Agustus 2021 dari 145.405 narapidana kasus narkotika, sekitar 28.640 orang atau 24,5% merupakan pengguna atau penyalahguna. Penjatuhan pidana penjara kepada penyalaguna atau pengguna narkotika merupakan keputusan yang tidak tepat. Permasalahan overkapasitas akan muncul jika penyalahgunaan atau pengguna narkotika selalu berujung pada pemidanaan. Penelitian normatif yang menggunakan pendekatan perundang – undangan dan pendekatan konseptual ini akan menganalisis relevansi penjatuhan pidana penjara terhadap penyalahguna narkotika dalam pespektif teori relatif kaitannya dengan tujuan pemidanaan. Penelitian ini berkesimpulan bahwa penyalahguna narkotika dari dimensi kesehatan dipandang sebagai orang yang sakit fisik dan jiwanya karena narkotika. Penyalahguna narkotika lebih membutuhkan pengobatan (rehabilitasi) daripada penghukuman (pidana penjara). Menjadi tidak relevan ketika penyalahguna narkotika yang dipandang sebagai orang yang sakit diberi sanksi pidana penjara, karena didalam penjara tidak dilakukan treatment agar penyalahguna berhenti menggunakan narkotika. Sejalan dengan Teori relatif yang menegaskan bahwa pemidanaan bukan semata – mata sebagai pembalasan (retributif) kepada pelaku tindak pidana karena telah melakukan kejahatan. Pemidanaan mesti dilakukan dengan mengedepankan nilai – nilai tujuan atau nilai kemanfaatan dari dilakukannya pemidanaan itu sendiri. Melakukan pemidanaan kepada penyalahguna justru menimbulkan masalah overkapasitas LAPAS, penyuapan penjaga LAPAS dan tidak tercapai nilai tujuan dan kemanfataan sebagaimana ajaran teori relatif dalam tujuan pemidanaan Indonesia is one of the 7 (seven) countries with the largest number of prisoners in the world. The highest number of convicts in Indonesia are narcotics cases. Data shows that in 2019 drug convicts reached 115,000 people. Until the end of August 2021, of the 145,405 prisoners in narcotics cases, around 28,640 people or 24.5% were users or abusers. Imprisonment of prison sentences for narcotics abusers or users is an inappropriate decision. The problem of overcapacity will arise if the abuse or use of narcotics always ends in punishment. Normative research that uses a statutory and conceptual approach will analyze the relevance of imposing prison sentences on narcotics abusers in a theoretical perspective relative to the objective of sentencing. This study concludes that narcotics abusers from the health dimension are seen as people who are physically and mentally ill because of narcotics. Narcotics abusers need more treatment (rehabilitation) than punishment (prison). It becomes irrelevant when narcotics abusers who are seen as sick people are given prison sentences, because treatment is not carried out in prison so that abusers stop using narcotics. In line with the relative theory which emphasizes that punishment is not merely retributive to the perpetrators of crimes because they have committed crimes. Punishment must be carried out by prioritizing the values ​​of the objectives or the value of the benefits of carrying out the punishment itself. Criminalizing abusers actually creates problems of LAPAS overcapacity, bribery of LAPAS guards and failure to achieve the value of goals and benefits as the relative theoretical teachings in terms of sentencing.

Abstract

This study examines the enforcement of the best interest of the child principle in child custody cases related to child neglect in the Indonesian legal system. This study uses normative legal research methods with approaches to legislation, conceptual, and comparative law, by analyzing national regulations and comparing child protection mechanisms in Sweden, Australia, and Canada. The results showed that the power of parents over children is not an absolute or invulnerable domain, but is limited by the obligation to protect the fundamental rights of children. the role of State parens patriae provides justification for state intervention in cases of child neglect through a system of mandatory reporting, Cross-Sector Coordination, as well as rehabilitative measures. However, law enforcement in Indonesia is still not effective due to weak institutional coordination, insufficient evidence, especially in cases of non-physical neglect, limited involvement of experts, and still strong cultural views that position child neglect as a private family affair. Hence the need for a systemic reform of the law, including the formulation of clearer indicators of child neglect, the strengthening of expertise-based evidence mechanisms, as well as the establishment of a victim-oriented rapid response system. Thus, state intervention is positioned as an essential legal and moral responsibility in protecting the rights of children, not as a form of violation of family privacy.
