Abstract

Alpen Food Industry, the most renowned ice cream manufacturer in Indonesia, boasts a widespread presence with 80,000 outlets across the nation. However, beneath the surface of PT. Alpen Food Industry's success, having once been honored with the Excellent Brand Award, allegations of labor law violations have emerged, leading to protests by its employees. In an effort to fight for their rights, the workers staged a two-week strike. The strike was initiated to advocate for their entitlements. Additionally, PT. Alpen Food Industry is accused of unilaterally implementing Termination of Employment (PHK) procedures. Nonetheless, the company refutes these allegations, asserting that they conducted the PHK in accordance with existing protocols and guidelines. They claim to have sent two separate Call Letters to the workers, which went unanswered, and argue that this inaction is tantamount to resignation based on the prevailing guidelines. This research employed a qualitative approach, gathering data through literature review methods involving various sources such as journals, news articles, and websites. The author then drew conclusions based on the obtained data. The research findings suggest that the dispute arose primarily from a lack of communication between the workers and the employer.

Abstract

Contract work in construction is one of the common forms of work performed in the construction industry. In contract work, workers are hired to complete construction projects within a specified timeframe and agreed-upon cost. However, there are often cases where contract workers experience delays or wage payment postponements. The research aims to analyze the legal protection for contract workers in the construction industry concerning delayed wage payments. In Indonesia, there are labor regulations that govern the rights and obligations of workers, including wage payments. If there is a delay in wage payment, workers have the right to file a lawsuit or report the violation to the authorities. This research adopts a qualitative research method, analyzing data and gathering information from various sources. Legal protection plays a crucial role in safeguarding workers. Some relevant legal roles include employment agreements, which enable workers to enter into contractual agreements with employers that protect their rights.

Abstract

Hubungan industrial merupakan hubungan yang berlangsung antar pekerja dengan pemberi kerja. Sering sekali terjadi perselisihan antara pengusaha dengan buruh. Penelitian memailih metode kualitatif dengan menggunakan data sekunder dengan metode non-eksperimen. Hasil yang didapat yaitu serikat pekerja memiliki pengaruh yang cukup kuat dalam proses keberlangsungan hubungan industrial yang harmonis yaitu serikat pekerja menjalankan peran sebagai lembaga bipartit, membangun komunikasi baik dengan internal maupun eksternal, dan juga merumuskan perjajian kerja bersama. Serikat pekerja juga harus bersifat sukarela, mandiri, demokratis, dan menjunjung tinggi rasa solidaritas antar anggota. Kesimpulannya yang didapatkan dari penelitian kali ini adalah ketika perusahaan melakukan tindakan pemutusan hubungan kerja serikat pekerja akan melakukan upaya terlebih dahulu dengan cara persuasif lalu tindakan terakhir yaitu upaya mogok kerja.

Abstract

Studi ini mengkaji tentang peran Pemerintah Republik Indonesia dalam penuntasan perselisihan hubungan industrial di Indonesia. Penelitian ditujukan untuk mengetahui peran pemerintah Republik Indonesia dalam penuntasan perselisihan hubungan industrial di Indonesia. Metode penelitian yang diaplikasikan merupakan kualitatif dengan pendekatan eksploratif. Hasil penelitian ini memperlihatkan pemerintah hadir dan aktif dalam penyelesaian perselisihan perburuhan, terbukti dari catatan Mahkamah Agung, mayoritas kasus diselesaikan di tingkat tripartit dibandingkan dengan jumlah kasus hubungan industrial yang dilanjutkan pada tingkat Pengadilan Hubungan Industrial. Selain itu, pemerintah berhasil berperan sebagai mediator dan regulator, terbukti dengan pertumbuhan ekonomi negara dengan penurunan kasus yang dilaporkan dibandingkan tahun 2020, saat ekonomi terpuruk akibat pandemi.

Abstract

The purpose of this research is to understand the factors that lead to Termination of Employment (PHK) based on the Job Creation Law and to obtain legal protection for employees of PT. Shopee International Indonesia against layoffs in a unilateral way. This research also uses normative legal research methods through a conceptual and statutory approach with the support of both primary and secondary legal materials and uses techniques in qualitative analysis so that it can examine the problems that are currently happening in the field. The results of this study show that namely the case of PT. Shopee Internasional Indonesia as part of a unilateral layoff case by violating the provisions of the Job Creation Law. The absence of clear sanctions in the law provides an opportunity for companies to carry out layoffs in a unilateral way for employees. For workers who have been laid off unilaterally, they must receive a form of legal protection that is in accordance with the Job Creation Law, as well as the President's commitment to improving quality in the economic sector. Companies that carry out layoffs in a unilateral way must receive appropriate sanctions because they have violated the law and also the lack of fulfillment of various rights of citizens who should receive constitutional guarantees.

Abstract

Writing this article aims to find out how to fulfill the rights that will be obtained by workers when these workers experience layoffs. The method used is a qualitative method using literature studies related to the law on fulfilling the rights of layoff workers. Fulfillment of these rights will be based on the applicable laws and regulations. Fulfillment of the rights obtained by workers affected by layoffs has been regulated through Law No. 13 of 2003 concerning Manpo wer and is also regulated in Law No. 6 in 2023 with a few changes. In reality, the application of these regulations has been carried out well. Although there are still several companies that do not fulfill workers' rights as regulated in legislation. This article also explains what workers get or what rights they get in accordance with the policies in force in granting workers’ rights. Policies or regulations that exist in Indonesia are a form of legal protection in industrial relations for both workers and employers in guaranteeing the rights they obtain.

Abstract

Hubungan industrial Pancasila merupakan hubungan kerja yang dilandasi dengan nilai-nilai pancasila yang terjadi antara pekerja dengan pengusaha. Pengusaha dan pekerja dalam hubungan industrial Pancasila memiliki tujuan yang sama yaitu bertujuan untuk mendorong kemajuan perusahaan dan meningkatkan kesejahteraan tenaga kerja atau buruh. Dalam hal ini, pekerja/buruh dan pengusaha berperan untuk saling mengisi dan melengkapi. Dengan adanya penerapan hubungan industrial Pancasila dalam sebuah perusahaan, diharapkan dapat mengatasi segala tantangan yang akan mendahulukan penyelesaian melalui diskusi bersama untuk mencapai tujuan bersama, yakni kemajuan perusahaan dan kesejahteraan para pekerja atau buruh. Penelitian ini bertujuan agar sebuah perusahaan dalam melakukan penyelesaiaan masalah berdasarakan dengan nilai-nilai dari Pancasila yang berhubungan dengan hubungan industrial kerja agar lebih dapat mendorong pertumbuhan perekonomian yang lebih sejahtera

Abstract

This article intends to be able to study and gain knowledge of the process of resolving and handling labor relations disputes or industrial relations at one of the hotels in Pangandaran Regency. The problem is focused on the process of settling and handling disputes over termination or termination of employment at one of the hotels in Pangandaran Regency. This study uses several theories about the settlement of industrial relations disputes. This study uses empirical juridical methods and data collection techniques, namely documentation studies. The data collected was analyzed qualitatively. This study concludes that the process of settling and handling industrial relations disputes at a hotel in Pangandaran complies with applicable regulations. The process of settling and handling industrial relations disputes is carried out through mediation and continues at the Industrial Relations Court.

Abstract

Training for intern employees is a crucial component in human resource development within the company. The objective of the research to be achieved is to evaluate the effectiveness of the e-learning training program for marketing interns at PT. X. The research subjects include four individuals: one HRD Development staff, one mentor, and two training participants involved in the Magang Belajar Kampus Merdeka (MBKM) internship program at company X, batch 5, for the period from August to December. The researcher employs a qualitative method. Data sources consist of direct information and information from other parties. Data collection techniques include documentation, observation, and interviews. The triangulation used comprises source triangulation and technique triangulation. The research was conducted in East Jakarta from August 2023 to July 2024. The research findings indicate that PT X has taken positive steps to realize reaction evaluations concerning the willingness to participate in the training program, preparation of the materials to be used, and the motivation of the training participants. In terms of learning stage evaluation, PT X also has clear training objectives, a well-structured learning process, effective material delivery, and significant skill enhancement. Regarding behavioral stage evaluation, PT X has made an impact through behavioral changes, behavioral comparisons, and assessments after the training process, all of which have shown positive trends. This evaluation demonstrates that PT X's program effectively enhances participants' understanding and motivation through interactive methods and flexible access, although the heavy workload needs to be addressed.
