Abstract

Pelanggaran narkoba adalah tindakan yang dilarang oleh undang-undang terkait narkoba. Narkotika adalah zat atau obat yang berasal dari tumbuhan atau bukan tumbuhan yang dapat menimbulkan ketergantungan fisik atau psikis pada pemakainya. Pelanggaran narkoba umumnya melibatkan penggunaan, penyalahgunaan, distribusi, produksi atau kepemilikan narkoba tanpa izin dari otoritas yang berwenang. Teddy Minahasa diduga menjual barang bukti seberat 5 kilogram dalam kasus narkoba, dan informasi keterlibatannya dalam peredaran barang bukti sudah dihimpun penyidik. Oleh karena itu Kejaksaan Agung harus memiliki hukuman yang lebih berat daripada para terdakwa lainnya. Permohonan jaksa tersebut dirinci dalam Pasal 55 KUHP yang melanggar Pasal 114 ayat 2 UU No 35 Tahun 2009 tentang Narkotika, dan digabungkan dengan Pasal 55 ayat 1 ayat 1 KUHP.

Abstract

Juridical Review of the Digital Banking System for Customer Protection discusses legal certainty for customers in banking transactions via internet banking. The study highlights the protection of customers' personal data and the security of banking information regulated in related agreements including Law no. 10 of 1998 concerning banks and Law no. 11 of 2008, which was changed to Law no. 19 of 2016 concerning electronic information and transactions. Legal protection of online banking users from cybercrime also serves as a research focus. Several studies also highlight the importance of policy protection for victims of economic crime in the banking sector. Customer protection in digital banking systems is becoming increasingly important along with rapid technological developments

Abstract

In Indonesia, there are many business entities to create jobs in order to reduce the unemployment rate. In general, business entities can be separated into 2, namely business entities in the form of legal entities and business entities that are not in the form of legal entities. Business entities in the form of legal entities, namely limited liability companies, state-owned companies, cooperatives, etc. Meanwhile, business entities that are not in the form of legal entities that are often encountered are firms, CVs, and limited partnerships. In running this business, a business entity requires a workforce that plays an important role in the running of the activities of a business. Labor is someone who does a job to produce goods or services to get wages so that they can fulfill their lives. Law Number 6 of 2023 concerning Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation Becomes an Act which aims to provide protection for every worker so that they are not treated arbitrarily, as well as guarantee certainty in life peace of mind for workers, to find out legal certainty for workers who work in business entities that are not legal entities. Wages that are needed by workers to meet their needs are very important. Therefore employers must pay wages in accordance with the minimum wage regulations set by governors in provincial areas and regents/mayors in urban areas. In addition, employers must guarantee that all workers who work in their company are peaceful, safe, and peaceful in carrying out their work. The purpose of this research is also as a science for readers to know that there is legal certainty that protects a worker in obtaining certainty in obtaining a job. matters and these matters cannot be contested.

Abstract

Apart from regulating the use of arbitration, Law Number 30 of 1999 concerning Arbitration and Alternative Conflict Resolution encourages business actors to examine alternative conflict resolution. Arbitration is a method of resolving a civil settlement outside of general court which is based on an arbitration agreement signed between the parties. According to Law Number 30 of 1999, alternative recovery methods include mediation, negotiation, consultation, expert review and conciliation. Arbitration comes from the Latin word arbitrare which means the power to resolve something based on discretion. The appointment of arbitration with discretion gives the impression that an arbitrator is someone who can reach a more reasonable conclusion regarding the settlement. This research method uses a descriptive analysis approach which uses factors that influence the advantages of arbitration and this data source is secondary, namely according to legal documents - Law number 30 of 1999 and related laws, as well as journals and books. The fact that the arbitrators are selected by both parties to the dispute and are experts in their fields indicates that they are informed about the issues at hand, which is one of the benefits of resolving conflicts outside the court system rather than through litigation. Second, settlement decisions are made behind closed doors, so that only a few parties know the main issues at issue. Specialization or expertise in case management gives clients confidence• Arbitration is a popular alternative in business settlements due to several key advantages. The closed process maintains confidentiality and avoids adverse publicity. Arbitration decisions are final and binding, and the process is faster and more predictable than court. Flexibility in selecting arbitrators and arbitration procedural rules also provides parties with greater control over the outcome of their settlements. Overall, arbitration achieves amicable resolutions, supports sustainable commercial relationships, and allows for resolution in a more efficient and effective manner
