Abstract

The presence of conventional commercial banks with foreign ownership in Indonesia introduces a new dynamic in the national banking structure, with significant implications for the financing of Micro, Small, and Medium Enterprises (MSMEs). This study explores the potential involvement of these banks in enhancing the capital capacity of MSMEs, a sector traditionally dominated by the Himbara banks. Using normative legal research methods with doctrinal and comparative approaches, this study aims to identify the urgency and procedures for the involvement of conventional commercial banks with foreign ownership in MSME financing. The findings reveal that such involvement could create a mutually beneficial relationship, where MSMEs gain access to more diverse funding options, while these banks expand their customer base. These implications highlight the potential for strengthening MSME capital structures and contributing positively to the national economy.

Abstract

Indonesia has a partnership policy as a prerequisite for foreign parties who wish to open a bank in Indonesia. This partnership policy has been known since the allowance for foreigners to own banks with a 99% stake which continues to this day in today’s era of financial industry consolidation. This paper will elaborate on the idea of implementing a partnership policy through the concept of parent-subsidiary bank between Commercial Bank with Foreign Ownership and Local Banks in Indonesia such as Regional Development Banks and People’s Economic Banks. This idea will examine the possibility, procedure, and impact of the implementation of the concept on the consolidation of the national banking industry, especially the strengthening of local banks as an effort to improve the welfare of the people as a whole. This research is normative legal research with a statutory and conceptual approach. Based on the analysis conducted in this paper, the implementation of the parent-subsidiary bank concept is in line with the positive regulations prevailing in Indonesia around strengthening the capital of Regional Development Banks and People’s Economic Banks as well as having an impact on strengthening capital and transferring technology to these local banks which have an impact on improving the services and capacity of local banks in competing in the banking industry.

Abstract

Transmigration in Lampung Province is part of Indonesia's national transmigration program, which aims to equalize development and reduce the population density of densely populated islands such as Java. Transmigration in Lampung began in 1905 with a colonial approach by the Dutch and continued during the Old Order New Order and began to decline after the 1998 reformation. The challenges of transmigration in Lampung include social and economic problems, integration of immigrants with local communities, and environmental impacts; the next challenge is the availability of health and welfare infrastructure and sustainable development. This study examines the dynamics of transmigration in Lampung Province as an instrument of social welfare. The purpose of the study is to describe the development of the transmigration program from the colonial era to the contemporary era, and to identify achievements and challenges in social integration, environmental impacts, and infrastructure development in transmigration areas. The method used is socio-legal, which focuses on studying problems in the implementation of law in everyday society. Data were collected through field studies in Lampung Province in 2024. The findings of this study are that transmigration in Lampung Province has experienced significant development since the start of the program. Lampung Province has shifted from a province receiving transmigration to one that is sending transmigration. Although there have been some socio-economic achievements, challenges remain, especially regarding social integration, environmental impacts, and infrastructure development. The success of the future transmigration program will depend mainly on how these challenges are addressed with a more inclusive and sustainable approach.

Abstract

Abstract: As a constitutional state grounded in Pancasila, Indonesia requires a transparent, objective, and accountable system for recruiting constitutional judges to safeguard judicial independence. Unfortunately, the current mechanism is fraught with conflicts of interest and lacks meaningful public participation. There are discrepancies in recruitment standards among the proposing institutions, resulting in inconsistencies in the quality of constitutional judges. Non-transparent and unaccountable mechanisms hinder the attainment of judicial integrity and professionalism. This research aims to analyze and formulate an ideal reform for the recruitment system of constitutional judges based on Pancasila values and meaningful public involvement. This study employs a doctrinal legal research method. Data collection was conducted through library research, consisting of primary and secondary legal materials. The findings reveal that the weaknesses in the current mechanism can be addressed through two main innovations: the establishment of an independent selection panel and the SHAKTI platform (Transparent and Informative Selection of Constitutional Judges). These mechanisms ensure not only transparency and public participation but also promote the independence and integrity of constitutional judges.Keywords: Constitutional Judges, Recruitment, Pancasila. Abstrak: Sebagai negara hukum yang berlandaskan Pancasila, Indonesia memerlukan sistem rekrutmen hakim konstitusi yang transparan, objektif, dan akuntabel untuk menjaga kemerdekaan kekuasaan kehakiman. Sayangnya, mekanisme yang ada saat ini masih dipenuhi konflik kepentingan dan kurang melibatkan partisipasi publik yang bermakna. Terdapat perbedaan standar rekrutmen antar lembaga pengusul yang menyebabkan ketidakseragaman kualitas hakim konstitusi. Mekanisme yang tidak transparan dan akuntabel menjadi penghalang tercapainya integritas dan profesionalisme hakim. Penelitian ini bertujuan mengkaji dan merumuskan reformasi sistem rekrutmen hakim konstitusi yang ideal, berbasis nilai-nilai Pancasila, serta melibatkan publik secara bermakna. Penelitian ini menggunakan metode penelitian hukum doktrinal Pengumpulan data dilakukan melalui studi kepustakaan berupa bahan hukum primer dan bahan hukum sekunder. Hasil penelitian menunjukkan bahwa kelemahan mekanisme saat ini dapat diatasi dengan dua inovasi utama, yaitu pembentukan lembaga panel seleksi yang independen dan situs SHAKTI (Seleksi Hakim Konstitusi Transparan dan Informatif). Mekanisme ini tidak hanya menjamin transparansi dan partisipasi publik tetapi juga mendorong independensi serta integritas hakim konstitusi.Kata kunci: Hakim Konstitusi, Rekrutmen, Pancasila.
