Abstract

The Village Spatial Plan (RTRW) is a follow-up interpretation of the District RTRW. These provisions have been stated separately in the Village Law. However, in practice, standardization of village spatial policy implementation has not been fully implemented. The concept of village development needs to pay attention to village spatial planning to ensure the benefits and compliance of existing regulations. The method applied in this study is the normative juridical method through qualitative review. Normative juridical review is a stage of legal review carried out through the review of library sources or secondary information as the main material by conducting research related to the problem under study. The results of this study show that to implement policies related to village spatial planning, there are two possible factors, namely supporting and inhibiting factors. To develop clarity on the objectives of policy implementation, legal certainty is needed that can accommodate the needs of village structuring and control.

Abstract

Gagasan mendasar negara kesejahteraan pada tataran teoretis dan praktis mengupayakan untuk kemanfaatan saat ini dan mendatang. Melalui konsep green constitution, Indonesia mengaktualisasikan norma tersebut kedalam Pasal Undang-Undang yang mengatur mengenai pengendalian dan pengelolaan lingkungan guna menjaga kestabilan dan konservasi lingkungan. Konsep pembangunan berkelanjutan secara general merepresentasikan adanya kesejahteraan sebesar-besarnya untuk kemakmuran rakyat tanpa membebankan kondisi lingkungan saat ini dan mengupayakan kelestarian lingkungan untuk generasi mendatang. Taraf konstitusionalisasi norma dalam Pasal turunan lazimnya menghendaki adanya keselerasan jaminan hak konstitusional terhadap akses lingkungan yang layak bagi masyarakat. Ruang Terbuka Hijau merupakan realisasi komitmen pemerintah untuk kepentingan masyarakat secara publik. Metode yang digunakan dalam penelitian ini adalah yuridis normatif, dengan jenis penelitian kualitatif. Hasil penelitian ini menunjukkan bahwa green constitution erat kaitannya dengan kebijakan atau regulasi turunan dari konstitusi. Di Indonesia, kebijakan tersebut dimuat dalam ketentuan Undang-Undang dan Peraturan Presiden. Adapun terkait korelasi dengan Rencana Tata Ruang dan Wilayah merupakan wujud praktis dalam realisasi konsep pembangunan yang ideal untuk iklim yang sehat terhadap kebutuhan lingkungan hidup.

Abstract

This study examines the filling of public offices with special criteria, as outlined in the constitution, which applies specifically to Constitutional Court judges. However, the term "statesman" is not explicitly defined in the criteria. Progressive law, de facto, emphasizes the substantive dimension of justice in the pursuit of upholding the right to justice and democracy. This paper explores the reconstruction of recruitment and external supervision of constitutional judges, focusing on the qualifications of statesmen from a progressive legal perspective. It also discusses the relevance of the progressive legal understanding of statesman qualifications to the independence of the Constitutional Court in Indonesia. The method employed in this research is normative juridical, conducted through literature review. The findings suggest that constitutional decisions and policies should be based on a justice dimension grounded in progressive law. The qualification of a statesman can be assessed through a track record of daily actions and relationships with the broader environment. By applying statesman qualifications to constitutional judges, it signals their capability and compatibility in ensuring the independence of institutions that prioritize justice in state governance and public administration.

Abstract

This paper delves into the discourse surrounding marriage principles within Indonesia's diverse multicultural landscape, with a particular focus on both monogamous and polygamous practices. As a nation characterized by rich cultural and religious diversity, Indonesia provides a unique context for examining the dynamics of marital norms and traditions. Through a comprehensive analysis, this study explores the historical, legal, and socio-cultural dimensions of monogamous and polygamous marriages, shedding light on their prevalence, legal frameworks, and societal implications. Drawing upon legal perspectives, societal attitudes, and empirical evidence, this discourse aims to provide a nuanced understanding of the complexities inherent in marital practices within Indonesia's multicultural society. Ultimately, this study contributes to broader discussions on marriage, diversity, and legal pluralism, offering insights into the evolving nature of marital norms and their intersection with Indonesia's multicultural fabric.
