Abstract

This article explains the basic concepts and background of multicultural education. This article aims to examine the concept and background of multicultural education. Writing this article using a qualitative method with the type of research library research. The data collection technique in writing this article is to collect various sources on the subject and then study it more deeply. The data analysis used is Content Analysis. This study found that 1) Multicultural education is a conscious and planned process of providing services to students to provide understanding, appreciation, and assessment without discriminating between individual differences. 2) The background of multicultural education, namely the second world war and increasing diversity in western countries, that it also resulted from political, social, economic, and intellectual interests

Abstract

The circulation of illegal cigarettes in Berampu has become a significant issue, negatively impacting state revenues and public health. Illegal cigarettes that do not meet excise standards cause substantial economic losses and place consumers at risk due to unregulated product quality. This article analyzes consumer protection against the circulation of illegal cigarettes from the perspective of positive law and the teachings of Ibn Taymiyyah. Through a normative approach, this study highlights the importance of enforcing excise regulations as a consumer protection instrument and the relevance of principles of justice in trade transactions according to Ibn Taymiyyah. Ibn Taymiyyah emphasizes the importance of transparency, honesty, and justice in trade, aligning with modern regulatory objectives to protect consumers from fraud and harmful products. The study concludes that consumer protection from illegal cigarettes must involve synergy between strict law enforcement, public education, and the application of strong moral values as outlined in Islamic teachings. This synergy is expected to provide a comprehensive solution in efforts to curb the circulation of illegal cigarettes in Indonesia.

Abstract

This study is motivated by the widespread practice of unofficial over-credit house sales, particularly in the Griya Madani Housing Complex, Parbangunan Village, Panyabungan Sub-district, Mandailing Natal Regency. The aim of this research is to analyze the legality of unofficial over-credit house transactions from the perspective of sadd adz-dzari’ah. This study employs an empirical juridical method with a case study approach. Primary data were obtained through interviews and direct observation, while secondary data were collected from literature reviews. The findings reveal that there have been seven unofficial over-credit transactions in the Griya Madani Housing Complex. Contributing factors include the avoidance of high bank administrative fees, faster and simpler processes, and greater financial benefits compared to purchasing a new house. The sadd adz-dzari’ah analysis identifies several potential harms (mafsadat), such as legal uncertainty regarding property ownership, the risk of fraud or default, breach of contract with the bank, financial losses for the bank as the creditor, and the absence of legal protection for the new buyer. Based on the principles of sadd adz-dzari’ah, such transactions fall into the category of harmful means that should be prevented due to the greater harm than benefit they pose. This study recommends that such transactions be conducted through official credit transfer mechanisms involving banks and notaries to ensure legal certainty and prevent detriment to all parties involved.

Abstract

The research sheds light on the implementation issues of the Non-Cash Food Assistance Program (BPNT), particularly the E-Warong program in Simulajadi Tanjung Balai Sub-District. It aims to understand the management practices of E-Warong and the background of discrepancies in the quantity of goods received by the community. The study concludes that the discrepancy between the quantity of goods and their corresponding value received by the community does not align with the funds allocated by the government, indicating discrepancies attributed to fraudulent practices by shop owners. This juridical-empirical study employs a living case studies approach followed by conceptual and statute approaches. Data collected through interviews and document analysis reveal discrepancies in the distribution of staple goods among BPNT recipients in Simulajadi Tanjungbalai.

Abstract

The practice of recycling SIM card numbers by telecommunications providers often results in losses for existing customers, such as misuse of personal data and communication disruptions. This research aims to identify the types of losses experienced by customers due to the recycling of SIM card numbers and to analyze the accountability of telecommunications service providers for the losses incurred from the recycling of SIM card numbers from the perspective of Maslahah Mursalah. This type of research is empirical legal research with a living case studies approach, a statute approach, and a conceptual approach. Data is collected using interviews and document studies. The data is then processed and analyzed using qualitative methods. The results of this research indicate that the practice of recycling SIM cards in Gunungtua city leads to losses such as financial losses, reputational damage, and privacy breaches. In the perspective of maslahah mursalah, customers feel that the recycling of the number does not provide them with benefits compared to the operators who gain many advantages and profits. A review of the maslahah mursalah concerning the practice of recycling SIM card numbers indicates that if the harms outweigh the benefits, then it is not permissible. Furthermore, telecommunications service providers must be held accountable for any losses experienced by customers due to the practice of recycling SIM card numbers.

Abstract

This research analyzes the practice of buying and selling iPhones with illegal IMEI codes without warranty through the lens of Fatwa DSN No: 146/DSN-MUU/XII/2021, which addresses online stores based on Islamic principles. Employing a qualitative approach, the study focuses on case studies from the Facebook marketplace. Data is collected through the observation of transactions involving illegal iPhones on the platform and an analysis of the relevant Fatwa DSN. Findings indicate that these transactions violate Islamic principles, specifically gharar (uncertainty) and fraud. The study highlights the implications of these practices on public welfare and justice, underscoring the need to enforce Islamic law in online business contexts. This research contributes to the understanding of Islamic business ethics and the necessity for stricter regulations to uphold justice and public welfare in online transactions. Ensuring legal and transactional validity, promoting public welfare, and maintaining social justice are essential for conducting Sharia-compliant and fair transactions in the digital marketplace.
