Abstract

This research aims to examine the enforcement of SNI (Standar Nasional Indonesia) certification for electronic products in the Medan Denai District of Medan City and to evaluate the accountability of electronic store operators concerning consumer protection under both civil and criminal law. The significance of this study lies in its exploration of the intersection between legal frameworks, consumer rights, and public safety, offering a nuanced understanding of how these elements interact in a localized setting. By focusing on the Medan Denai District, the research not only highlights the specific challenges and dynamics faced in ensuring compliance with SNI standards but also reflects broader national concerns. The incorporation of Maqashid Al-Syari'ah, an Islamic jurisprudential principle, is crucial as it frames the discussion within a moral and ethical context. Maqashid Al-Syari'ah, which aims to protect fundamental human interests such as religion, life, intellect, lineage, and property, provides a unique lens through which consumer protection can be viewed. This perspective emphasizes that ensuring product safety and adherence to standards transcends mere legal obligations, embodying a deeper commitment to fulfilling religious and moral duties. The focus on Medan Denai District as a case study is essential because it offers a tangible example of how these principles are applied in practice, revealing both the successes and limitations of current enforcement mechanisms. This research, therefore, contributes valuable insights into how consumer protection can be enhanced by aligning legal and ethical standards, ultimately promoting societal well-being.

Abstract

This research is motivated by the injustice in Srilelawangsa train services, such as the lack of safety and comfort facilities for passengers who have to stand, including pregnant women, the elderly, and young people, which is an urgent problem to be addressed. This research aims to analyze the policies and implementation of consumer protection for standing passengers on the Srilelawangsa Train service by using an empirical legal method that combines a statute approach and a case approach. The statute approach is employed to examine regulations related to consumer protection, such as Law Number 8 of 1999 on Consumer Protection and applicable railway regulations. The case approach is used to analyze real conditions observed in the field regarding services for standing passengers, utilizing primary data obtained through direct observation and interviews with passengers and related parties involved with the Srilelawangsa Train service. Secondary data are sourced from legal literature, statutory regulations, and Islamic jurisprudence books related to the concept of Maslahah Mursalah. The research findings indicate that standing passengers have not received adequate protection, either from the perspective of positive law or the principle of public interest (Maslahah) in Islam. The lack of clear ticket information, the absence of supporting facilities such as handrails, and the weak enforcement of priority seating policies illustrate that consumer protection in this matter remains suboptimal. From the perspective of Maslahah Mursalah, the existing policies are considered to bring more harm than benefit to passengers and are therefore not justifiable under Islamic law. The conclusion of this research emphasizes the need for policy evaluation and the improvement of consumer protection through fair solutions grounded in the principles of Maslahah that prioritize passenger safety and comfort.

Abstract

Wakaf uang merupakan inovasi dalam sistem keuangan islam yang memiliki potensi besar dalam meningkatkan kesejahteraan masyarakat dan pemberdayaan ekonomi umat.  Namun,  dalam  praktiknya,  pengelolaan  wakaf uang di Indonesia, termasuk oleh Yayasan Darul Waqaf Al-Hadiy, belum sepenuhnya sesuai dengan ketentuan hukum  yang  di  atur  dalam  Undang-  Undang  No.  41Tahun 2004 tentang Wakaf. Permasalahan utama yang dihadapi mencakup belum optimalnya pelaporan keuangan kepada Badan Wakaf Indonesia sebagaimana diatur dalam pasal 43, belum adanya kerja sama yang jelas dengan Lembaga Keuangan Syariah Penerima Wakaf Uang Pasal 28, serta kapasitas nazhir yang belum memenuhi standar kompetensi hukum sebagaimana diatur dalam  pasal  10.  Penelitian  ini  bertujuan  untuk menganalisis kesesuaian praktik pengelolaan wakaf uang di  Yayasan  Darul  Waqaf Al-Hadiy  dengan  ketentuan Undang-Undang No. 41 Tahun 2004, khususnya terkait pelaporan keuangan legalitas nazhir, dan keterlibatan Lembaga Keuangan Syariah Penerima Wakaf Uang (LKS-PWU). Jenis penelitian ini adalah yuridis empiris dengan pendekatan living case study, statute approach, dan conceptual approach. Data primer diperoleh dari observasi dan wawancara serta data sekunder diperoleh melalui studi dokumen. Kemudian, data diolah secara kualitatif dan dianalisis dengan penalaran deduktif. Hasil penelitian ini  menunjukkan bahwa pengelolaan wakaf uang di Yayasan tersebut belum sepenuhnya memenuhi standar hukum, seperti belum diterapkannya pelaporan sesuai Pasal 43, belum bekerja sama dengan LKS-PWU sebagaimana diatur dalam Pasal 28, serta belum maksimalnya kapasitas hukum nazhir sesuai dengan Pasal 10. Oleh karena itu, diperlukan pembenahan dari sisi hukum berupa penguatan kapasitas kelembagaan nazhir, pelatihan hukum perwakafan, serta penyesuaian operasional Yayasan dengan ketentuan hukum positif agar wakaf uang dapat dikelola secara sah, akuntabel dan berkelanjutan.

Abstract

Perdagangan daring yang kian berkembang telah melahirkan tantangan baru dalam pengawasan produk, khususnya terkait peredaran obat luar yang mengandung bahan berbahaya tanpa izin edar. Salah satu produk yang menjadi perhatian adalah Salep Zudaifu, yang secara luas diperjualbelikan di berbagai marketplace meskipun tidak terdaftar di BPOM dan terbukti mengandung Bahan Kimia Obat (BKO) seperti dexamethasone dan merkuri sulfida. Penelitian ini bertujuan untuk menganalisis praktik penjualan produk tersebut dalam perspektif hukum positif Indonesia dan syariah Islam berdasarkan Fatwa DSN-MUI No. 146/DSN-MUI/XII/2021 tentang Pedoman Transaksi Online Shop. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Data dikumpulkan melalui studi pustaka terhadap regulasi nasional, fatwa, serta literatur fiqih klasik dan kontemporer. Analisis dilakukan secara deskriptif dengan penekanan pada prinsip perlindungan konsumen, maqashid al-shariah, dan nilai-nilai muamalah Islam. Hasil penelitian menunjukkan bahwa peredaran salep berbahaya di marketplace merupakan pelanggaran terhadap Undang-Undang No. 36 Tahun 2009 tentang Kesehatan dan Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen. Dalam perspektif syariah, transaksi semacam ini bertentangan dengan prinsip al-dharar yuzal, larangan tadlis, dan amanah dalam jual beli. Marketplace sebagai fasilitator transaksi turut memiliki tanggung jawab moral dan hukum atas peredaran produk berbahaya. Oleh karena itu, diperlukan penguatan regulasi, peningkatan literasi digital syariah, serta implementasi prinsip hisbah dalam pengawasan perdagangan daring.
