Abstract

Autism spectrum disorder (ASD) is categorized under neuro-developmental disorders. Individuals with this disorder experience deficits in social interaction and communication skills as well as repetitive patterns of thoughts and behaviours. The purpose of this study was to comparatively analyze the similarities and differences in Malaysian PDRM Autism SOPs with other countries, namely Malaysia, Hong Kong, the United Kingdom, and four countries in the United States, namely, Wisconsin, New Mexico, Illinois, and Virginia. This research focuses on discussing the important elements emphasized in SOPs and some aspects of similarities and differences between them. The research design is based on document analysis. The data were analyzed descriptively and thematically. Research results that autistic people put them at risk of committing violations of the law without realizing or intending to do so. Since they are also categorized as persons with disabilities, they are thus entitled to legal guarantees appropriate to their status. Therefore, their rights to equality and non-discrimination as persons with disabilities attracted worldwide attention holistically, resulting in specific Standard Operating Procedures (SOPs) in several countries, including Malaysia, namely, the Royal Malaysian Police Autism SOP (PDRM). Likewise, there are several important elements outlined in all SOPs, in aspects of their application, legal references, methods of arrest and detention, and intermediary assistance, and there are some similarities and differences between the SOPs analyzed. The implications of this study show the importance of SOPs for autism arrest and prisoners, to meet their specific legal needs.

Abstract

The recent Covid-19 pandemic has swept the globe. As a result, there has been a spike in the number of relative poor who are experiencing economic hardships. This poses a predicament for the unbankable, reducing their options to apply for funding via banking products. With the available financial capacity, zakat institutions are viewed as the closest alternative in terms of being a source of funding, either through the microfinacing method or the qard hasan principle. Zakat is considered capable of becoming a social entrepreneurial system and a worthy alternative. The question is whether Islam permits microfinancing using zakat funds. If permitted, what is the rationale for distributing zakat through microfinance? Are there asnaf entreprenuers in Malaysia ready to take microfinance from the zakat fund to finance their businesses? This study is done using the case study method by conducting a semi-structured interview with zakat expertise and asnaf entreprenuers. Based on the content analysis, the findings of the study indicate that Islam permits microfinance using zakat funds. Asnaf entreprenuers are likewise eager to acquire microfinance from zakat money in order to to strengthen their economic position and develop in life. This microfinancing is expected to have a good effect, particularly on the rising demand for asnaf entreprenuers. So, it is expected that asnaf entreprenuers will be able to switch from being a zakat recipient to a zakat payer within a certain amount of time.

Abstract

Delayed implementation of child support payments by fathers has become a frequently debated topic in child support disputes across innumerable countries, even when mandated by a court order. This study focused on comparing the enforcement of child support orders between Malaysia and Indonesia. It also examined administrative factors in the respective courts that contribute to delays in executing these orders. It adopted the empirical legal study approach, employing content analysis and legal comparison methodologies. Primary data were collected through observation, interviews, and analysis of both primary and secondary sources. Findings revealed that provisions in Malaysian Law (Section 73) and Indonesia's Law No. 1 Article 41 (1974) assign fathers the responsibility of providing for their children. While the basic obligations are similar, differences emerge in the transfer of responsibility to mothers. In Malaysia, child support orders under Section 79 remain effective until the child reaches 18 years. In contrast, in Indonesia, Article 156 (d) of the Compilation of Islamic Law (KHI), consolidated by Article 98 (1), extends this to 21 years. Key factors contributing to delays in child support payments in the Federal Territory Syariah Court, Kuala Lumpur, and the Religious Court of Riau were identified. Both courts faced challenges stemming from a lack of legal awareness among the public and administrative weaknesses, including delays in case hearings. Cumbersome procedures, lengthy processes, and high costs characterized the Religious Court of Riau. Abstract

Nowadays, information and communication technology (ICT) is being used in completing daily tasks of Muslims family. The tasks are including education, management services, banking, and more. The rapid developing of the technology such as gadgets, online services affected the families that lead to dilemma for society. There are positive and negative impacts of the ICT. Even though there are advantages, there are also conflicts and shortcomings that affected our religious beliefs and ethics. Therefore, this paper will discuss this issue and suggest solutions from the Islamic perspective and alternative solutions. As a result, this paper suggests that Muslims should utilize ICT wisely, intelligently and with integrity, guided by Shariah.

Abstract

This study investigates the impact of intrinsic, extrinsic, and religiosity factors on investment selections in Amanah Saham Bumiputera (ASB) among investors in Kelantan, focusing on the mediating role of intention. A survey was conducted with 300 ASB investors, and data analysis was performed using Partial Least Squares Structural Equation Modeling (PLS-SEM). The results reveal that extrinsic factors, such as marketing, and religiosity significantly influence ASB investment selections, with intention acting as a mediator. In contrast, intrinsic factors, such as the understanding of ASB, exhibit a weaker relationship with investment selections. The findings underscore the importance of offering Shariah-compliant investment products to meet the religious needs of investors. Additionally, enhancing financial education is vital to ensuring that investment choices align with ethical and social responsibility standards. Stakeholders are encouraged to collaborate with religious bodies to develop Shariah-aligned policies, thereby enhancing the acceptance and effectiveness of investment products in Kelantan.
