Abstract

**English**Divorce often involves complex factors that vary with individual circumstances. Beyond legal considerations governing the process, the development of the internet has introduced new dynamics, such as illegal online loans and online gambling, affecting marital stability. Legally, divorce impacts not only the husband and wife but also the children. Economically, divorce has significant effects, especially when one or both parties lack stable income. This study aims to analyze the phenomenon of divorce and its impact on children in the Religious Court of Tangerang City. The methods used include data collection and interviews with relevant stakeholders. Divorce data were obtained from the documents of the Religious Court of Tangerang City for the period 2021-2023. This study also employs the theory of legal certainty to assess the legal implications of divorce. The results show a significant increase in the divorce rate in the Religious Court of Tangerang City from 2021 to 2023, with divorce claims by the wife being the most common type. Contributing factors include economic issues, lack of effective communication, prolonged disputes, and domestic violence. The study emphasizes understanding the legal and economic implications of divorce for couples considering it.                     **Indonesia**Perceraian sering kali melibatkan faktor-faktor kompleks yang dapat bervariasi sesuai dengan situasi individu. Selain pertimbangan hukum yang mengatur proses perceraian, perkembangan internet telah membawa dampak baru dalam dinamika perceraian, seperti munculnya pinjaman online ilegal dan perjudian online yang dapat memengaruhi kestabilan hubungan suami istri. Dalam kajian aspek hukum, perceraian berdampak tidak hanya pada suami dan istri tetapi juga pada anak-anak. Secara ekonomi, perceraian juga memiliki dampak signifikan terutama ketika salah satu atau kedua belah pihak tidak memiliki penghasilan yang stabil. Penelitian ini bertujuan untuk menganalisis fenomena perceraian dan dampaknya terhadap anak-anak di Pengadilan Agama Kota Tangerang. Metode yang digunakan adalah pengumpulan data dan wawancara dengan pemangku kepentingan terkait. Data perceraian diperoleh dari dokumen Pengadilan Agama Kota Tangerang selama periode 2021-2023. Penelitian ini juga menggunakan pendekatan teori kepastian hukum untuk menilai implikasi hukum dari perceraian. Hasil penelitian menunjukkan bahwa tingkat perceraian di Pengadilan Agama Kota Tangerang meningkat signifikan dari tahun 2021 hingga 2023, dengan kasus cerai gugat menjadi jenis perceraian yang paling umum. Faktor-faktor yang menyebabkan perceraian meliputi masalah ekonomi, kurangnya komunikasi efektif, perselisihan yang berkepanjangan, dan kekerasan dalam rumah tangga. Penelitian ini menekankan pentingnya pemahaman dan kesadaran akan implikasi hukum dan ekonomi dari perceraian bagi pasangan yang mempertimbangkan untuk bercerai.

Abstract

This study examines the role of legal awareness and community empowerment in enhancing access to justice within marginalized communities. Grounded in the perspectives of Legal Studies and Sociolegal Studies, the research explores how individuals’ understanding of legal rights and their capacity for collective action influence their ability to seek and obtain justice. The study aims to analyze the extent to which legal awareness contributes to empowerment processes and to identify structural and cultural barriers that hinder equitable access to justice. This research employs a qualitative approach using in-depth interviews, focus group discussions, and document analysis to capture the lived experiences of community members, legal aid providers, and local stakeholders. Data were analyzed through thematic analysis to identify recurring patterns related to legal knowledge, empowerment strategies, and institutional responsiveness. The findings reveal that increased legal awareness significantly enhances individuals’ confidence and willingness to engage with formal legal mechanisms. Moreover, community empowerment initiatives, such as legal education programs and grassroots advocacy, play a crucial role in bridging the gap between formal legal systems and vulnerable populations. However, the study also identifies persistent challenges, including limited institutional capacity, socio-economic inequalities, and cultural perceptions that discourage legal engagement. The research concludes that strengthening access to justice requires an integrated approach that combines legal literacy, participatory empowerment, and institutional reform. This study contributes to the development of more inclusive legal frameworks by emphasizing the importance of community-based strategies in achieving substantive justice.

Abstract

This study examines the relationship between legal certainty and public trust in the legal system through a qualitative analytical approach grounded in Legal Studies and Sociolegal Studies. Legal certainty, understood as the clarity, consistency, and predictability of legal norms and their enforcement, is widely regarded as a fundamental principle of the rule of law. However, in many contexts, inconsistencies in legal interpretation, selective enforcement, and procedural inefficiencies have contributed to declining levels of public trust. This study aims to explore how perceptions of legal certainty influence public confidence in legal institutions and to identify key factors shaping this relationship.The research employs a qualitative design using in-depth interviews, focus group discussions, and document analysis involving community members, legal practitioners, and institutional stakeholders. Data were analyzed thematically to capture patterns related to perceptions of fairness, transparency, and accountability within the legal system. The findings reveal that higher levels of perceived legal certainty are strongly associated with increased public trust, particularly when legal processes are transparent, consistent, and accessible. Conversely, ambiguity in regulations, unequal application of the law, and lack of institutional accountability significantly undermine trust.Furthermore, the study highlights that public trust is not solely determined by formal legal frameworks but also by the lived experiences of individuals interacting with legal institutions. The research concludes that strengthening public trust requires a comprehensive approach that enhances legal clarity, institutional integrity, and participatory engagement. This study contributes to ongoing discussions on building a credible and inclusive legal system capable of ensuring justice and social stability.
