Abstract

Public hearing is one of the instruments for Local People's Representative Council (DPRD) of Salatiga City to absorb people's aspirations in the formation of local regulations. Networking and absorbing the aspirations of the community is important in the process of forming local regulations so they can answer the needs and solve the problems, because sociologically, local regulations must prioritize usability and usefulness. This Public Hearing was held in order to absorb the aspirations of the community regarding the Draft Regional Regulation on the Implementation of Social Order. The activity began with the presentation of the substance of the Draft Regional Regulation then continued with a direct question and answer session, also can access by Youtube even for those who have not had the opportunity to submit questions and suggestions can access the google form link that has been provided. This activity provide benefit where the DPRD as the people's representative can absorb the aspirations of the community as a whole.

Abstract

Artikel ini membahas penerapan asas Lex Favor Reo dalam Pasal 3 KUHP Nasional terhadap putusan yang telah berkekuatan hukum tetap. Penelitian ini menggunakan metode penelitian yuridis normatif. Hasil penelitian menunjukkan perlunya mengkualifikasikan perubahan undang-undang yang menguntungkan pelaku sebagai keadaan baru, sehingga syarat peninjauan kembali sebagai upaya hukum luar bisa dapat dilakukan. Keberlakuan asas Lex Favor Reo terhadap putusan yang telah berkekuatan hukum tetap (Inkracht) untuk mewujudkan keadilan dan kemanfaatan hukum itu sendiri karena hukum pidana seharusnya mampu menyesuaikan dengan kondisi perkembangan hukum di masyarakat. Hukum harus selalu memberikan yang mengutamakan hak dari pihak yang berperkara baik seorang pelaku kejahatan maupun korban. Hukum pidana harus sesuai dengan eksistensinya yaitu keadilan dan kemanfaatan hukum itu sendiri sehingga terhadap suatu perubahan undang-undang yang menguntungkan pelaku dapatlah dikategorikan sebagai novum sehingga terwujud novum demi keadilan.

Abstract

Of the various articles that have undergone changes and additions in the new Criminal Code, one of them is interesting, namely Article 54 related to forgiveness by judges. However, whether the concept of forgiveness decision by the judge in the new Criminal Code has a position as a decision in the Criminal Procedure Code or the Criminal Procedure Bill. This research uses a normative juridical research method, which examines the problem by referring to positive law. The results of this study indicate the need for additional types of forgiveness decisions in the Criminal Procedure Bill as a form of criminal law reform because the provisions related to the types of decisions in the Criminal Procedure Code and the Criminal Procedure Bill are currently unable to accommodate forgiving decisions by judges. By examining in more depth the concept of forgiveness by the judge, it will appear that neither the Criminal Procedure Code nor the Criminal Procedure Bill contains the type of forgiveness decision.

Abstract

A code of ethics is a set of written regulations binding members of certain professions, including state officials and judges. For ethical violations by the Constitutional Court judges in Indonesia, an ethics tribunal known as the Honorary Council of the Constitutional Court (MKMK) is authorized to determine whether a breach of the code of ethics has occurred. This study examines whether ethical violations committed by judges as state officials, as determined by the MKMK, can also be prosecuted as unlawful acts, specifically nepotism. Using a normative juridical research method, this study analyzes positive law regarding nepotism as outlined in Law Number 28 of 1999 concerning State Organizer Who is Clean and Free from Corruption, Collusion, and Nepotism, and employs a case study approach, focusing on ethical violations by the Chief Justice of the Constitutional Court, Anwar Usman, as documented in MKMK Decision Number 02/MKMK/L/11/2023. The findings reveal that ethical violations by state officials, such as Constitutional Court judges, may be classified as unlawful acts, including nepotism, provided the ethical violation is substantiated by a formal decision from the ethics tribunal confirming the breach.
