Abstract

Since the 2004, election of the president and vice president made directly by the people. Normatively, Indonesia has been striving for election of the president and vice president are more democratic, as reflected through the freedom and the involvement of a political party or coalition of political parties contesting the election to carry the presidential and vice presidential candidates meet all the requirements specified in the legislation. However, in practice the presidential election in 2004  and 2009, found several problems. This paper is intended to identify a number of election issues, once initiated the implementation of a formula for the realization of a more democratic election and aspirative.

Abstract

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

Abstract

Overruling is a revision of a court’s previous judicial precedent, meaning the court replaces the precedent with a new rule. This article sees that overruling is legitimate to seek constitutional truth. In practice, the Constitutional Court of the Republic of Indonesia (CCRI) has overruled its own Decisions through judicial review. This article focuses on the CCRI’s overruling on corruption issues which are the status of the Indonesian Corruption Eradication Commission and the meaning of the phrase “may harm State’s financial” which is stated in Law No. 31 of 1999. This article argues that those Decisions are consistent with constitutional truth although the ratio decidendi of the Court of the latter issue is inadequate. A case approach and a conceptual approach are used in the analysis of this legal research.

Abstract

 This study focuses on the use of adat law as an instrument to influence the community’s behaviors in Central Sumba, particularly those concerning the performance of traditional ceremonies. Since the social cost required to perform the ceremonies could be very high and has been regarded as one of the impetus that drives poverty in the society, there was a demand to change the practice which is regarded as a reflection of wasteful lifestyle. The main issue discussed in this study is whether adat law could be used as a tool of social engineering to change the unwanted wasteful lifestyle. This study revealed that since adat norms are still strongly held in the community, adat law could be used as an instrument to change behaviors. Social engineering measures were taken by utilizing adat law to change the prodigal behavior in the form of the declaration of the Three Moral Move-ments. Keywords: adat law, Central Sumba, social engineering, traditional rites

Abstract

Tulisan ini hendak mengkaji pemanfaatan E-Government (Electronic Government) dalam penyelenggaraan pemerintahan daerah di Indonesia dengan menggunakan perspektif yuridis. berupa pengaturan yang sudah ada pada tingkat nasional atau pusat serta saran tindak bagi daerah dalam rangka mengimplementasikan E-Government, terutama pijakan awalnya berupa suatu kerangka hukum (legal framework). Tulisan ini merupakan penelitian hukum dengan menggunakan pendekatan teoretis-konseptual (conceptual approach) dan pendekatan perundang-undangan (statute approach).

Abstract

This study aims to assess and analyze the practice of monitoring the current draft legislation and regulation enactment of Law No. 32 of 2004 in conjunction with Law No. 28 of 2009, and efforts to reorganize the (reconstruction) testing system suitable draft legislation and regulations mandated by the Constitution of 1945. The method used in this research is juridical empirical data sources focusing on primary data supported secondary data. Collecting data through interviews and field observationsare supported by the literature study. Based on the results of research that reviewing local regulations and local regulation bill containproblematic, that the level of normative and practical. At thenormative level, there isa difference between setting the cancellation regulations of Law No.32 of 2004 juncto Law No. 23 of 2014by theArticle 24A of the 1945 Constitution. Inpractical level the problematic appears with regard to the scope of the evaluation of draft legislation, the standard of review, the legalform of the review results, follow-upreview, and implementation of filing and testing.Therefore, the system needs to reconstruction of reviewing local regulations and local regulations bill to complywiththe mandate of the 1945 Constitution. Reconstruction concerning the types of review of the local regulations and local regulation bill, and procedural law in local regulation review.Penelitian ini bertujuan untuk mengkaji dan menganalisis praktik pengawasan raperda dan perda saat berlakunya UU No. 32 Tahun 2004 juncto UU No. 28 Tahun 2009, dan upaya untuk mengatur kembali (rekonstruksi) sistem pengujian raperda dan perda yang sesuai amanat UUD 1945. Metode yang digunakan dalam penelitian ini adalah metode yuridis empiris dengan sumber data berfokus pada data primer yang didukung data sekunder. Pengumpulan data melalui wawancara danpengamatan lapangan yang didukung dengan studi kepustakaan. Berdasarkan hasil penelitian bahwa pengujian rancangan peraturan daerah dan peraturan daerah mengandung problematika, baik padatataran normatif dan praksis. Pada tataran normatif, ada perbedaan pengaturan pengujian dan pembatalan perda antara UU No. 32 Tahun 2004 juncto UU No. 23 Tahun 2014 dengan Pasal 24A UUD NRI 1945. Pada tataran praksis problematika berkenaan dengan ruang lingkup evaluasi raperda, batu uji, bentuk hukum hasil pengujian, tindak lanjut pengujian, dan waktu pengajuan dan pelaksanaan pengujian.Oleh karenanya dibutuhkan rekonstruksi sistem pengujian raperda dan perda agar sesuaidengan amanat UUD 1945. Rekonstruksi berkenaan dengan jenis pengujian raperda dan perda serta hukum acara pengujian.

Abstract

This study brought up the problems, first, the theoretical foundation of the exchange of regional owned property (BMD) between local government and private parties. Second, the laws and regulations governing the exchange activities of BMD. Third, basic considerations in relation to the exchange of BMD. The type of the research was normative research. The results concluded that, first, theoretically, the government (local government) can do contractualization of governmentaffairs because this has become a practice (habit) in the government. The contractualisation includes exchange agreements with non-governmental parties that involve assets(land)thatare under government control (BMD). Second, juridically, the regulational basis for the exchange agreement serving as the basis for the right to transfer the assets (land) under government control (BMD) can be found in the legislation. In doing such actions, terms and conditions of legislation shall apply as the basis of the validity of the actions which includes the aspects of authority, substance and procedure. Third, another thing that determines the feasibility of government action in exchanging BMD (in the form of land) is the aspect of benefit (doelmatigheid).

Abstract

This article discusses the Supreme Court Decision Number 29 P/HUM/2019 on the Judicial Review of Article 7 and Article 9 paragraph (1) of Governor of Bali Regulation No. 97 of 2018 on Restrictions on the Generation of Single-use Plastic Waste. The Supreme Court (MA) rejected the applicant's application with a dedicendi ratio that the a quo Governor's Regulation was justifiable as it was based on the principle of decentralization and the impact of single-use plastic waste that pollutes or damages the environment. The legal issues highlighted relate to how the relationship between legal products in the form of legislation and regulations should be, as well as whether the Supreme Court's judicial considerations in its decisions are appropriate according to the law. The research method is done with conceptual and case study approaches. The results of the study that: First, legal products in the form of regulations are an elaboration of legislation, so that regulations may not create new legal norms. Second, the Supreme Court's judicial opinion is incorrect as it does not distinguish between legislation and regulation products, so there is an impression that everything can be regulated by regional legal products provided that it is in accordance with the regional conditions. In addition, the act of limiting Human Rights is only carried out through legislative products in the form of legislation (laws).

Abstract

Artikel ini mendeskripsikan bahwa Tiga Gerakan Moral (Gerakan Kembali ke Kebun, Gerakan Hidup Hemat dan Gerakan Desa Aman) yang dicanangkan oleh PemerintahDaerah bersama komponen-komponen masyarakat adat di Kabupaten Sumba Tengah merupakan hukum adat. Tiga Gerakan Moral sebagai hukum adat didasarkan pada pemenuhan unsur-unsur hukum adat yaitu adanya kaidah, masyarakat, sanksi, dan penegak sanksi. Selain itu, artikel ini juga memberikan argumentasi bahwa TigaGerakan Moral sejatinya bertujuan mencapai atau mewujudkan kesejahteraan bagi masyarakat Sumba Tengah. Hal ini disebabkan karena melalui Tiga Gerakan Moral,Pemerintah bersama masyarakat bermaksud menyelesaikan persoalan mendasar yang ada yaitu kecenderungan mengabaikan penggarapan lahan kebun, kecenderunganmenafsirkan nilai budaya secara kurang tepat sehingga bermuara pada gaya hidup hedonistik, serta gangguan keamanan yang masih cukup tinggi.This article argues that the Three Moral Movements (Back to Field Movement, the Safe Village Movement and the Frugal Lifestyle Movement) launched by the local government and prominent figures of traditional community in Central Sumba Regency meets the qualification of customary law. The categorization of the Three Moral Movements as customary law is based on the fact that the movements consist of customary norms, have been implemented among the traditional community members, and equipped with sanctions as well as the law enforcement elements. Additionally, this article also argues that the Three Moral Movements aims to achieve prosperity for the people of Central Sumba. This is because through the Three Moral Movements, the Government along with the community intends to resolve the existing fundamental problems, which are the tendency of ignoring the cultivation of idle fields, the tendency to mistakenly interpret cultural values that leads to a hedonistic lifestyle, as well as significant security issues.

Abstract

The authority of the Constitutional Court is often limited only to the judicial review of statutory products, not practice. The method used for this research is normative legal research using a conceptual approach, legislation, and comparisons. This legal research aims to examine the implementation of constitutional complaint schemes in various countries while reviewing the inherent authority of the Constitutional Court in reviewing constitutional complaint cases with the object of court decisions. The results show that the Constitutional Court of the Republic of Korea has many similarities with the Constitutional Court of the Republic of Indonesia; at the same time, the German Constitutional Court gives rights to individuals, communions, and associations to file a constitutional complaint and the United States Supreme Court establishes several criteria for legal standing for parties who make constitutional complaints. Then, the Constitutional Court has the authority to decide on constitutional objections, including court decisions, considering the court's decision is analogous to the law itself. Furthermore, based on constitutionalism, the constitutional complaint is the inherent authority of the Constitutional Court.
