Abstract

Considering the potential impacts and risks arising from the lack of comprehensive regulation of fintech growth in Indonesia by the government, it is important to pay attention to and regulate consumer protection effectively within the fintech ecosystem. Two significant risks if consumer protection is neglected are privacy and data security breaches, as well as data misuse. Hence, data security and personal information issues are increasingly becoming concerns since such data may contain information involving individuals' privacy rights.The aim of this study is to understand and analyze the development of Fintech Lending in Indonesia and the Protection of Personal Data for Fintech Lending Users. The method employed is normative research, analyzing legal sources as secondary data. The research findings indicate that the current development of Fintech Lending in Indonesia involves 101 companies, comprising 94 conventional providers and 7 Sharia-compliant providers. Fintech Lending users are advised to be more vigilant in keeping pace with technological advancements and developments. Keywords: Fintech lending, Data ProtectionFintech lending, Data Protection

Abstract

Purpose – The aim of this research is to understand the forms and processes of political corruption within BUMDs based on patron-client relationships in placing people in strategic positions in the company. Method - This research uses secondary data, namely based on the results of the anti-corruption assessment carried out by TI Indonesia. Then carry out a literacy study to draw conclusions and verify. Result - The political corruption nested within BUMDs in South Sulawesi has had an impact on unsatisfactory performance and achievements, where continuous losses have been found, which is the impact of the recruitment system for BUMD directors which is only based on the politics of retaliation in the regional elections. Implication – Transparency International (TI) Indonesia in the period December 2022-January 2023 has carried out a Transparency in Corporate Reporting assessment of 47 companies or Regional Owned Enterprises (BUMD) in 5 Provinces, South Sulawesi (Sulsel) is one of the provinces assessed. The result was that five South Sulawesi BUMDs were categorized as sick and not transparent in terms of management, making them prone to corruption. Through this research, it is hoped that it can be an evaluation of the performance of BUMDs in South Sulawesi related to company management.

Abstract

Peraturan Undang-undang Agraria Indonesia memiliki implikasi penting dalam mengatur penggunaan dan pengelolaan tanah, khususnya yang berkaitan dengan tanah. Aspek sosial dan hukum dari undang-undang Agraria sangat memengaruhi keseimbangan antara kebutuhan bangsa, rakyat, dan individu dalam membuat dan menggunakan uang. Dengan menggunakan analisis literatur, penelitian ini bertujuan untuk menganalisis aspek hukum dan sosial yang terdapat dalam peraturan Agraria di Indonesia. Penelitian ini mengkaji berbagai literatur hukum dan sosial yang relevan untuk memahami hubungan antara undang-undang Agraria dan segala bentuk kebijakan pemerintah, dan dampaknya terhadap masyarakat umum. Temuan analisis menunjukkan bahwa, meskipun undang-undang Agraria di Indonesia telah mengalami sejumlah perubahan dan revisi, masih banyak masalah dengan implementasi hukum yang terkait dengan tanah sengketa, tanah hak pembagian, dan konsekuensi sosial dari kebijakan pertanian yang tidak selalu sejalan dengan kebutuhan masyarakat umum. Penelitian ini diharapkan dapat memberikan pemahaman yang lebih mendalam tentang dinamika hukum agraria di Indonesia dan mendorong reformasi kebijakan yang lebih adil dan inklusif.Kata kunci: Aspek hukum, aspek sosial, peraturan agraria, pendekatan literatur, Indonesia.
