Abstract

The authority of notaries in Indonesia is regulated by Law Number 2 of 2014 concerning Notary Positions (UUJN). UUJN was established to ensure that notaries carry out their professional duties by providing legal protection and certainty to the public. However, the implementation of this law has not been optimal, leading to violations that contradict its provisions. In the year 2022, 67 notaries were suspected of violating the code of ethics.Through normative legal research, it was identified that notarial code of ethics violations, such as failure to read out deeds or allowing others to sign deeds in the presence of their staff, have been on the rise. Therefore, there is a need for the optimization of sanctions against notaries who breach the code of ethics, both in civil and criminal aspects, in accordance with the severity of their offenses.Supervision of notaries aims to ensure compliance with existing regulations and the code of ethics. If proven guilty of violations, notaries should face sanctions commensurate with their transgressions. The Notarial Code of Ethics encompasses five levels of sanctions, ranging from warnings to dishonorable discharge from the Notary Association membership. Notaries are obligated to adhere to UUJN, the Notarial Code of Ethics, and maintain integrity and dignity in the execution of their profession.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan sistem pemerintahan di Indonesia dengan menggunakan teori Trias Politika yang memisahkan kekuasaan menjadi tiga cabang independen: eksekutif, legislatif, dan yudikatif. Metode penelitian yang digunakan adalah normatif yuridis dengan pendekatan case dan comparative approach, dengan sumber referensi meliputi bahan hukum primer dan sekunder. Hasil penelitian menunjukkan kesesuaian penerapan sistem pemerintahan dengan prinsip Trias Politika. Cabang eksekutif bertanggung jawabatas pelaksanaan kebijakan dan administrasi negara, legislatif membuat undang-undang dan mengawasi pemerintahan, sementara yudikatif, melalui Mahkamah Agung, menafsirkan undang-undang dan menjatuhkan putusan hukum. Meskipun terdapat tantangan dan perubahan, seperti peran awal Komisi Pemberantasan Korupsi (KPK) yang independen, prinsip pemisahan kekuasaan tetap menjadi landasan membangun pemerintahan demokratis dan berkeadilan. Penelitian ini memberikan pemahaman yang jelas mengenai penerapan sistem pemerintahan di Indonesia berdasarkan Trias Politika, diharapkan dapat memperkaya pengetahuan masyarakat, terutama pelajar dan mahasiswa, tentang pentingnya pemisahan kekuasaan dalam menjaga keadilan, transparansi, dan akuntabilitas pemerintahan.

Abstract

As a country that embraces the concept of welfare state, and implicitly can be seen in the general explanation of the 1945 Constitution. The state plays a key role in implementing or realising the protection and promotion of the economic and social welfare of its citizens. In practice, the two are often at odds or have different views and opinions, such as when the state issues regulations or issues certain policies, some citizens reject them because they are not in accordance with the will and needs of the people. In the writing process using normative juridical research methods, which are sourced entirely based on secondary data. In the process of resolving the State Administration, there are two solutions, namely administratively and a lawsuit to the court. In its implementation, the Administrative Court is still less effective because there are no firmer regulations governing the execution of the Administrative Court's decision itself, in fact the execution of the Administrative Court is still difficult to carry out due to the lack of cooperation from the Administrative Court officials.

Abstract

Indonesia as a country of law adheres to the Civil Law system where the source of Law and all rules applied in Indonesia must be based on what has been codified or written in the form of a law. The type of research used is qualitative research derived from legal materials. The research approach method used is laws and regulations and a case approach, with the method of collecting data from literature studies and data analysis using normative juridical analysis. It is divided into several legal orders, one of which we know, namely Civil Law. The problems handled in the Civil Law are individual persons, for example, the sale and purchase of land where two parties are involved in a civil bond. In buying and selling, there is a need for an agreement, then generally there is a Deed of Sale and Purchase (AJB) which is an authentic deed and plays an important role in the process of buying and selling land as a sign that there has been a legal act between the parties. However, in reality, there is still a default in the sale and purchase of land after the issuance of the AJB where the seller cannot fulfill the rights of the buyer as stated in the AJB. If a civil dispute cannot be resolved using mediation, it can be resolved by submitting it to the court. In the settlement of civil disputes in court, there is evidence where evidence must be submitted to strengthen the argument. In this case, the Deed of Sale and Purchase can be used as evidence that is classified as an authentic deed of evidence.

Abstract

The banking sector is a crucial tool for driving the Indonesian economy, maintaining balance, progress, and unity within the national economy. Naturally, the banking sector requires regulations and elements that play a crucial role in optimal economic operation. Indonesia, a country governed by the rule of law, naturally has regulations regarding banking in its implementation. Banks, as financial service institutions, are expected to maintain the trust of the public who invest their funds in them, as stipulated in banking law. The principle of bank secrecy requires banks to maintain the confidentiality of their deposits and to help protect the interests of individual customers as a guarantee for the public who will place their trust in the bank and can entrust their funds to it. The strong commitment of banks to maintaining bank secrecy as financial service providers, coupled with the development and advancement of science and technology, has given rise to a problem where banks are often used as venues for criminal acts. In the process of resolving banking crimes, many parties, such as banks, play a significant role in assisting in resolving the problem. However, in practice, the process of resolving the problem remains incomplete due to a legal vacuum in disclosing bank secrecy to perpetrators of banking crimes. Referring to the research results, Singapore is included in the category of countries with a fairly high level of bank secrecy and has special banking regulations to help resolve banking crimes specifically, making it a comparison in this research analysis.

Abstract

The Indonesian Constitution, as well as the highest legal basis, the 1945 Constitution, contains the rights of every citizen. These include the right to obtain decent work and legal protection, as stated in Article 27 paragraph (2) and Article 28D paragraph (1) and paragraph (2). The current Employment Law, as the legal basis for employment in Indonesia, still limits worker qualifications only based on work agreements as regulated by the Employment Law. In fact, the workforce population in Indonesia is currently dominated by informal workers, which has an impact on informal workers who are still far from access to legal protection due to the current legal instruments that limit worker categories. This study examines legal protection for informal workers in Indonesia. This study is a normative legal study, examining legal norms using theories including the legal protection theory put forward by Satipdjo Rahardjo. The results of the analysis indicate a legal vacuum in the protection of informal workers, so that changes are needed in the legal system and policies to create special regulations that can explain the rights and obligations of informal workers, as well as provide a clear legal status
