Abstract

Abstrak Indonesia sebagai negara Hukum yang menganut sistem Hukum Civil Law dimana sumber Hukum dan segala aturan yang diterapkan di Indonesia haruslah berdasarkan yang sudah dikodifikasi atau tertulis berbentuk Undang-Undang. Terbagi menjadi beberapa tatanan hukum yang salah satunya kita kenal yaitu Hukum Perdata. Permasalahan yang ditangani dalam Hukum Perdata yaitu orang perorangan contohnya adalah jual beli tanah dimana dua pihak terlibat dalam suatu ikatan perdata. Dalam jual beli mengharuskan adanya kesepakatan, kemudian umumnya terdapat Akta Jual Beli (AJB) yang merupakan akta otentik dan berperan penting dalam proses jual beli tanah untuk sebagai tanda bahwa telah terjadi perbuatan hukum antara pihak-pihak. Namun dalam kenyataannya bahwa masih terjadi wanprestasi dalam jual beli tanah setelah terbitnya AJB tersebut dimana pihak penjual tidak dapat memenuhi hak-hak pihak pembeli sebagaimana yang tertera di dalam AJB. Apabila suatu sengketa perdata tidak dapat diselesaikan dengan menggunakan mediasi maka dapat menyelesaikanya dengan mengajukan ke pengadilan. Dalam penyelesaian sengketa perdata di pengadilan adanya pembuktian yang dimana harus mengajukan alat bukti untuk menguatkan argumentasi. Dalam hal ini Akta Jual Beli dapat dijadikan sebagai alat bukti yang tergolong kedalam jenis alat bukti akta otentik. Kata Kunci: Akta Jual Beli, Jual Beli Tanah, Wanprestasi Abstract Indonesia as a legal country that adheres to the Civil Law legal system where the source of law and all rules applied in Indonesia must be based on codified or written laws. Divided into several legal orders, one of which we know is Civil Law. Problems handled in Civil Law are individuals, for example the sale and purchase of land where two parties are involved in a civil bond. In buying and selling requires an agreement, then generally there is a Sale and Purchase Deed (AJB) which is an authentic deed and plays an important role in the process of buying and selling land as a sign that a legal action has occurred between the parties. But in reality, there are still defaults in the sale and purchase of land after the issuance of the AJB where the seller cannot fulfill the rights of the buyer as stated in the AJB. If a civil dispute cannot be resolved using mediation, it can be resolved by submitting it to the court. In resolving civil disputes in court, there is evidence which must submit evidence to strengthen the argument. In this case, the Sale and Purchase Deed can be used as evidence which is classified as a type of authentic deed evidence. Keywords: Sale and Purchase Deed, Land Sale and Purchase, Default

Abstract

The banking sector is a crucial tool for driving the Indonesian economy, maintaining balance, progress, and unity within the national economy. Naturally, the banking sector requires regulations and elements that play a crucial role in optimal economic operation. Indonesia, a country governed by the rule of law, naturally has regulations regarding banking in its implementation. Banks, as financial service institutions, are expected to maintain the trust of the public who invest their funds in them, as stipulated in banking law. The principle of bank secrecy requires banks to maintain the confidentiality of their deposits and to help protect the interests of individual customers as a guarantee for the public who will place their trust in the bank and can entrust their funds to it. The strong commitment of banks to maintaining bank secrecy as financial service providers, coupled with the development and advancement of science and technology, has given rise to a problem where banks are often used as venues for criminal acts. In the process of resolving banking crimes, many parties, such as banks, play a significant role in assisting in resolving the problem. However, in practice, the process of resolving the problem remains incomplete due to a legal vacuum in disclosing bank secrecy to perpetrators of banking crimes. Referring to the research results, Singapore is included in the category of countries with a fairly high level of bank secrecy and has special banking regulations to help resolve banking crimes specifically, making it a comparison in this research analysis.
