Abstract

This paper is based on the author's observations in several countries as places for the implementation of Indonesian elections abroad. as a host country, of course, the foreign country has a fundamental role in the implementation of Indonesian elections in that country. The voting design in the implementation of Indonesian elections abroad has a different mechanism between at home and abroad. The handling of criminal offence that occur in the case of Indonesian elections abroad, of course, also requires relations between foreign countries, namely the country where the Indonesian elections are held. Therefore, the contribution of foreign countries cannot be separated in handling election crimes. This article provides arguments based on normative analysis with a doctrinal approach to the applicable regulations on the role of foreign countries where Indonesian elections are held. The results of the election analyze conceptually, the role of foreign countries in the enforcement of Indonesian elections abroad. The region of the country where the Indonesian General Election is held abroad certainly plays a role in helping the smoothness of the voting process. For example, by adding assistance personnel for security during the implementation of voting. However, what is lacking is the norms or rules governing the role of the country and what assistance can be provided by the country where the implementation of the Indonesian elections abroad is incomplete, so it is necessary to make changes to the regulations on the General Elections of the Republic of Indonesia Abroad including the role of the country where the Indonesian overseas elections are held. Abstrak Tulisan ini didasarkan pada pengamatan penulis di beberapa negara yang menjadi tempat pelaksanaan pemilu Indonesia di luar negeri. Sebagai negara tuan rumah, tentunya negara asing memiliki peran yang fundamental dalam pelaksanaan pemilu Indonesia di negara tersebut. Desain pemungutan suara dalam pelaksanaan pemilu Indonesia di luar negeri memiliki mekanisme yang berbeda antara di dalam dan luar negeri. Penanganan tindak pidana yang terjadi dalam kasus pemilu Indonesia di luar negeri, tentunya juga membutuhkan hubungan antar negara asing, yaitu negara tempat pelaksanaan pemilu Indonesia. Oleh karena itu, peran negara asing tidak dapat dipisahkan dalam penanganan tindak pidana pemilu. Artikel ini memberikan argumentasi berdasarkan analisis normatif dengan pendekatan doktrinal terhadap peraturan yang berlaku mengenai peran negara asing tempat penyelenggaraan pemilu Indonesia. Hasil penelitian menganalisis secara konseptual peran negara asing dalam penegakan pemilu Indonesia di luar negeri. Namun yang menjadi kkekurangan adalah norma atau aturan yang mengatur tentang peran negara tersebut dan bantuan - bantuan apa saja yang dapat diberikan oleh negara tempat pelaksanaan pemilihan Indonesia di Luar negeri belum lengkap, maka memang perlu dilakukan perubahan terhadap peraturan tentang Pemilihan Umum Republik Indoensia di Luar Negeri termasuk juga peran negara tempat dilaksanakan pemilihan umum luar negeri Indonesia.

Abstract

This article delves into the issue of bail pending extradition in Malaysia. It adopts a doctrinal legal research methodology, focusing on analysing legislation and court decisions to objectively understand how current laws and practices determine bail applications within the context of Malaysian extradition law. The study reveals that Malaysia's Extradition Act 1992 does not explicitly provide for bail pending extradition, except under limited circumstances. Malaysian courts have utilised section 44 of the Extradition Act 1992 to apply bail provisions from the Criminal Procedure Code. The study finds that Malaysian courts adopt a cautious approach when determining bail applications in extradition cases. However, this judicial approach presents challenges, particularly in extradition cases involving offences governed by specific statutes other than the Criminal Procedure Code. The findings suggest that the reliance on section 44 should be re-evaluated to address these challenges. The article concludes by recommending further research to assess the need for an explicit and comprehensive provision for bail in the Extradition Act 1992 to ensure legal consistency and a uniform application across all types of offences.

Abstract

This study examines Indonesia’s legal system for employing foreign workers, with a focus on how well it balances economic growth, protection of local workers, and national security. Using a normative juridical approach, it reviews main regulations such as the Immigration Law, the Manpower Law, and Government Regulation Number 34 of 2021. The research finds that the Foreign Worker Utilization Plan is an important tool, but its implementation is weak because of a lack of labor inspectors, poor coordination between institutions, and light sanctions. Although reforms like the Job Creation Law were introduced to make the process easier and attract investment, there are still conflicts between new and old rules, as well as limited public involvement. The study also shows that while foreign workers can support knowledge transfer, their long-term stay and work in low-skilled jobs often reduce opportunities for local workers. To solve these problems, the research suggests creating a stronger supervisory system that includes preventive, persuasive, and repressive measures, better coordination between institutions, and stricter penalties. These steps would help ensure that employing foreign workers benefits the economy while also protecting local workers and national interests.

Abstract

The application of corporal punishment to criminals is crucial for ensuring justice and legal certainty, as well as maintaining public order. However, in law enforcement regarding money laundering, there has been a shift in focus to asset recovery, based on the “follow the money” principle, which prioritizes the recovery of the proceeds of crime over punishing the perpetrator. This approach has the potential to cause disruption, as recovery of losses should only occur after the perpetrator is found guilty under criminal law. In the absence of adequate asset recovery regulations, blockchain can be a solution to strengthen the asset recovery process. This technology provides transparency and accountability in tracking asset flows and ensures data permanence. Blockchain enables more efficient and secure asset recovery, supporting a faster recovery process, and reducing the potential for compromise. Reconciling asset recovery approaches with corporal punishment is crucial for creating a balance in the justice system that goes beyond maintaining peace.
