Abstract

ABSTRAKMasalah hak waris atas harta bersama dalam perkawinan kedua menurut hukum islam Untuk menjawab masalah ini untuk lebih memudahkan siapa yang berhak cukup kita melihat siapa yang meninggal dan yang ditinggalkannya juga ada hubungan dengan yang meninggal, misalnya yang mininggal dunia katakan saja bapaknya, dari perkawianan istri pertama dan istri kedua sama – sama memiliki keturunan, maka dari anak – anak yang ada hubungan darah dari bapaknya itu dapat mewarisi harta peninggalan dari bapak yang telah meninggal, untuk itu siapa yang berhak atas harta waris tersebut anak – anak dari perkawianan pertama dan kedua juga istri kedua dari perkawinan kedua juga memiliki hak atas waris tersebut, juga termasuk hutang – hutang si yang meninggal menjadi tanggung jawab ahli waris yang di tinggalkan.        Faktor – Faktor Yang Menjadi Sebab Tidak Mendapatkan Waris pertama faktor sebab membunuh, kedua faktor sebab perbedaan agama dan yang ketiga faktor walak atau budak, faktor – faktor inilah yang menghalangi untuk dapat menerima waris sebagaimana tersebut diatas disebut Hijab Hirman bilwashfi.

Abstract

Permasalahan tentang pesangon di Indonesia masih sering terjadi, utamanya dalam hubungan pengusaha dan pekerja. Tujuan penelitian ini untuk mengkaji pelaksanaan eksekusi terhadap pengusaha belum berjalan efektif karena dalam praktiknya sebagian besar pengusaha yang tidak membayar pesangon pekerja setelah terjadi pemutusan hubungan kerja. Penelitian ini menggunakan yuridis empiris dengan menggunakan data primer dan data sekunder, dengan pendekatan secara konseptual dikaitkan dengan kasus. Hasil penelitian menunjukkan bahwa pelaksanaan eksekusi terhadap pengusaha belum berjalan efektif karena eksekusi yang dilakukan oleh ketua Pengadilan dalam praktiknya tidak semuanya berjalan dengan lancar. Pelaksanaan eksekusi sering terjadi hambatan dalam proses pelaksanaan eksekusi karena pihak pengusaha yang kalah tidak mau melaksanakan eksekusi, selain itu juga biaya eksekusi yang mahal. Efektivitas eksekusi terhadap pengusaha yang tidak membayar pesangon pekerja di perusahaan berdasarkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja bahwa pengusaha yang tidak membayar pesangon pekerja diancam sanksi pidana 4 (empat) tahun penjara. Tindakan pengusaha yang tidak membayar pesangon pekerja dianggap melakukan tindakan pidana kejahatan. Hal ini sangat membantu pekerja untuk mempercepat penyelesaian perselisihan dengan laporan Polisi agar pengusaha membayar pesangon tersebut.

Abstract

The purpose of this study is to analyze the legal protection of Foreign Workers (TKA) which is difficult to avoid due to investment activities in the context of national development and for the mastery and transfer of technology as a continuous and ongoing process so that it is possible to use TKA, in addition to the lack of Indonesian Migrant Workers (TKI) who are experts and skilled to replace TKA. The problems in this study include: Regulation of TKA in the era of globalization , and the dynamics of legal protection of Foreign Workers in the era of globalization in Indonesia . The research method uses a normative legal research type, a study that uses secondary data and primary data. The results of the study show that: First, the regulation of foreign workers in the era of globalization in Indonesia has been regulated in Government Regulation Number 34 of 2021 concerning the Use of Foreign Workers, and Law Number 6 of 2023 concerning Job Creation in licensing foreign workers made easier . Second, the dynamics of legal protection of foreign workers in the era of globalization in Indonesia Based on the work agreement, foreign workers also receive social security as regulated in Article 1 number 4 of Law Number 24 of 2011, which in essence stipulates that social security participants are every person, including foreigners who work for at least 6 (six) months in Indonesia and are required to be provided with protection through national social security. Government policy has removed several regulations that hinder investment progress through deregulation of foreign worker use policies to increase foreign investment in Indonesia.

Abstract

The impartiality of the State Civil Apparatus (ASN) is a fundamental prerequisite for ensuring free, fair, and democratic elections in Indonesia. As a complex legal topic encompassing constitutional rights, regulatory concerns, and bureaucratic politics, the goal of this study is to examine infractions of ASN neutrality. This research explores violations of ASN neutrality as a complex legal issue intersecting constitutional rights, regulatory shortcomings, and bureaucratic politicization. Employing a normative-empirical legal approach, the research draws on statutory analysis and field data from three districts Karanganyar, Boyolali, and Kendal. The findings reveal three critical legal and structural problems. First, enforcement of neutrality norms is undermined by fragmented, overlapping regulations and weak sanction mechanisms, reflecting a significant legal gap in the regulatory framework. Second, a normative conflict exists between the ASN's obligation to remain neutral and their constitutional political rights as citizens, particularly regarding passive political expression in private settings. This tension raises concerns over the proportionality and legitimacy of current restrictions. Third, the politicization of the bureaucracy by incumbent regional leaders has institutionalized patronage and structural pressure, weakening meritocracy and professional independence. The research recommends codifying ASN neutrality under a unified, enforceable legal framework; redefining the boundaries of political rights and professional duties; and strengthening institutional safeguards to protect civil servants from political coercion. Upholding both neutrality and civil liberties is essential to sustaining democratic governance and restoring public trust in the bureaucracy.

Abstract

This study examines Indonesia’s legal system for employing foreign workers, with a focus on how well it balances economic growth, protection of local workers, and national security. Using a normative juridical approach, it reviews main regulations such as the Immigration Law, the Manpower Law, and Government Regulation Number 34 of 2021. The research finds that the Foreign Worker Utilization Plan is an important tool, but its implementation is weak because of a lack of labor inspectors, poor coordination between institutions, and light sanctions. Although reforms like the Job Creation Law were introduced to make the process easier and attract investment, there are still conflicts between new and old rules, as well as limited public involvement. The study also shows that while foreign workers can support knowledge transfer, their long-term stay and work in low-skilled jobs often reduce opportunities for local workers. To solve these problems, the research suggests creating a stronger supervisory system that includes preventive, persuasive, and repressive measures, better coordination between institutions, and stricter penalties. These steps would help ensure that employing foreign workers benefits the economy while also protecting local workers and national interests.

Abstract

This study aims to describe the Government's authority in land acquisition for development for the public interest. In this study, it is related to theAvailability land for development for the public interest has not been fair in Pancasila. The problem in this study is about the urgency of the government's authority in procuring land for development for the public interest based on Pancasila justice. The research method used in this study is a normative juridical approach, which is a study that uses secondary data as the main data, while primary data as supporting data. The results of this study show that Settings land for development in the public interest carried out by the Government by revoking land rights based on the Job Creation Law to try to harmonize the arrangements in the Law Number 2 of 2012 concerning Procurement Soil For Development for the public interest with its implementation regulations. The results of the study on pAvailability land for development in the public interest has not been fair to Pancasila, this is influenced by internal factors, namely the determination of compensation is not carried out optimally. External factors, namely disputes arising in the acquisition of land owned by the community affected by infrastructure development projects, generally cause conflicts, contradictions, and disagreements regarding the amount of compensation. The urgency of the Government's authority in procuring land for development in the public interest which is fair to Pancasila by upholding basic principles including humanity and justice based on Pancasila so that it does not cause losses to parties who have lost their land rights
