Abstract

This research analyzes the legal implications related to the ownership of intellectual property rights on the CryptoKitties platform. CryptoKitties is a blockchain-based gaming platform that allows users to buy, own, and trade unique virtual cats. These cats are represented by digital assets called non-fungible tokens (NFTs), which grant exclusive ownership to their owners. This research uses a normative method with a statutory approach. Accordingly, the user acknowledges and agree that Dapper (or, as applicable, the licensor) has all legal rights, ownership, and interests in and to all other elements of the application, and all intellectual property rights therein, but the ownership of non-fungible token (NFT) intellectual property is fully owned by the user. And Dapper grants exclusive rights to the user over the digital assets representing unique virtual cats.

Abstract

Penelitian ini menganalisis implikasi hukum dari distribusi online konten berhak cipta tanpa izin. Distribusi online tanpa izin melanggar hak eksklusif pemilik hak cipta dan undang-undang hak cipta. Penelitian ini menggunakan studi kepustakaan untuk menganalisis kerangka hukum yang relevan. Hasil penelitian menunjukkan bahwa distribusi online tanpa izin melanggar hak-hak eksklusif pemilik hak cipta dan dapat menghadapi tuntutan hukum dan sanksi pidana. Penelitian ini juga membahas tantangan penegakan hak cipta di era digital dan pentingnya penegakan hukum yang efektif. Penegakan hukum yang ketat dan kesadaran akan konsekuensi hukum dapat membantu memerangi pembajakan konten digital.

Abstract

Game Tamadoge mengusung konsep Play to Earn dengan menggunakan teknologi NFT (Non-Fungible Token) di atas blockchain Ethereum dan pemilik platform menawarkan perjanjian pengguna akhir kepada pengguna, untuk itu diperlukan analisis hukum dan keamanan antar para pihak. Penelitian ini menggunakan metode normatif dengan pendekatan perundang-undangan (statute approach), dan pendekatan konseptual (conceptual approach). Hasil penelitian ini adalah perjanjian pengguna akhir yang yang ditawarkan pemilik platform dapat membantu pengguna dan pemain game untuk memahami hak dan kewajiban mereka, dari mulai kepemilikan Hak Kekayaan Intelektual atas karya Non-Fungible Token, pedoman permainan, ekonomi dalam game, dan strategi, serta perjanjian yang ditawarkan memberikan perlindungan hukum yang lebih baik dalam menggunakan platform game berbasis blockchain Ethereum.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh Fatwa MUI (Majelis Ulama Indonesia) terhadap pembuatan produk politik, salah satunya adalah Peraturan Daerah Kota Semarang Nomor 1 Tahun 2021 Tentang Produk Makanan Halal. Metode penelitian ini adalah normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian ini ditemukan Fatwa MUI No. 44/2020 berdampak pada produk politik dengan mempromosikan nilai-nilai Islam dan etika, mendorong transparansi serta kualitas program politik, serta mengingatkan pada pengawasan dan akuntabilitas. Peran masyarakat dalam pengawasan dan larangan klaim palsu dalam kampanye juga ditekankan. Secara keseluruhan, fatwa ini mengintegrasikan nilai agama, transparansi, dan partisipasi masyarakat dalam proses politik.

Abstract

AbstrakPenelitian ini bertujuan untuk menganalisis dan memahami dampak typosquatting terhadap pengguna internet serta melihat sanksi hukum yang dapat dikenakan kepada pelakunya. Hasil penelitian menunjukkan bahwa typosquatting dapat merugikan pengguna internet dengan potensi kehilangan informasi pribadi, kerugian finansial, dan kerusakan perangkat. Pelaku typosquatting dapat dikenakan sanksi hukum berat, termasuk denda dan hukuman penjara, serta pembekuan atau penghapusan situs web mereka. Oleh karena itu, pengguna internet perlu meningkatkan kesadaran, berhati-hati dalam memasukkan URL, dan menggunakan langkah-langkah keamanan seperti firewall dan antivirus guna melindungi diri dari typosquatting.Kata Kunci: Kesalahan Penulisan, Implikasi Hukum.

Abstract

This research aims to analyze the legal products related to the function of the Investment Coordinating Board (BKPM) in Indonesia and how BKPM can assist in increasing foreign investment in the country. This research uses a normative method with a statute approach. The results of this research will evaluate the applicable legal regulations, including regulations on foreign investment and investment permits, as well as the role of BKPM in providing support and coordination for foreign investors. And it will also evaluate the performance of BKPM in increasing foreign investment in Indonesia and provide recommendations for future performance improvement. The results of this analysis are expected to provide useful information for the government, foreign investors, and other parties interested in investing in Indonesia.

Abstract

Human rights in e-commerce demand a legal system capable of providing simultaneous and comprehensive protection to consumers. In the digital age, consumers face various risks, such as personal data theft, algorithm manipulation, and unequal access to digital services. Therefore, scientific studies on this issue are crucial in encouraging the development of responsive and inclusive policies. Bibliometric analysis of previous research aims to provide in-depth insights into the development of this theme. Additionally, this analysis can help identify the main contributions of researchers and discover research gaps that can be filled to further develop knowledge. This research aims to identify global research patterns, major themes, and new opportunities that can support the development of a more effective and adaptive legal system in the face of digital age challenges. This study employs a mixed-methods approach, utilizing quantitative methods for bibliometric analysis of lens.org search metadata and qualitative methods through comparisons with Supreme Court decisions. The results show a significant increase in the number of publications in this field since 2005, peaking in 2017. This reflects the growing attention to consumer rights issues in e-commerce. The most productive country in this research is the United Kingdom with 3,395 journals, while the institution with the largest contribution is the University of Edinburgh. Furthermore, a research gap was identified regarding the development of a global legal framework that is adaptive to the challenges of the digital age. These findings guide researchers and policymakers to direct future research and formulate comprehensive policies to protect consumer rights in e-commerce.

Abstract

The benefits of this research include improving health policies and laws that are more in line with Pancasila values and community needs. This research can also provide a better understanding of the right to health as a human right and contribute to stronger health advocacy. Thus, research on health as a human right from a philosophical perspective in health law has important relevance in ensuring the fulfillment of the right to fair, equitable and quality health for all Indonesian citizens. This research uses a multidisciplinary approach that integrates normative juridical law, specifically using a legislative approach and a philosophical perspective. Health development is a top priority with a focus on increasing health system resilience, response to crisis situations, and policies that are responsive to community needs. Thus, the implementation of the Pancasila Philosophy in the Health Law involves values such as mutual cooperation, social justice, balance, divinity and independence, which aim to realize health services that are inclusive, fair and in line with the needs of the Indonesian people.

Abstract

Unlike previous studies that generally discuss copyright ownership in User-Generated Content (UGC) platforms, this research specifically analyzes the legal implications of Kompasiana’s terms and conditions concerning copyright and economic rights. This normative legal research using a statutory and a conceptual approach. The findings reveal that Kompasiana operates as a UGC platform allowing users to create and share content, such as articles, photos, and comments, while adhering to Indonesian copyright regulations under Law No. 28 of 2014. While Kompasiana’s terms and conditions align with Indonesian laws such as the ITE Law and Copyright Law, concerns remain regarding content creators’ economic rights, particularly when their content is used for promotional purposes without compensation. Terms of use vary depending on the validity of agreements under the legal system of each country, and intellectual property rights over UGC content also differ. This research contributes to legal science by providing a comparative framework applicable to international UGC platforms, emphasizing the necessity for transparent content ownership policies, dispute resolution mechanisms, and economic rights protections. This study offers insights into how different legal systems approach UGC ownership and copyright enforcement, allowing overseas readers to better understand the global implications of digital copyright law. To ensure fairness and legal compliance, Kompasiana should clarify whether users retain full economic rights or if the platform has a non-exclusive license to repurpose content and establish clearer mechanisms for content removal and dispute resolution. This study provides valuable insights into how UGC platforms worldwide can enhance legal transparency and user rights protection.

Abstract

This study analyzes the normative conflicts surrounding the regulation of land rights duration in Indonesia’s Capital City and the legal implications of the land rights cycle in its development. The research focuses on the implementation of Presidential Regulation Number 75 of 2024 and Government Regulation Number 29 of 2024, which amends Government Regulation Number 12 of 2023. Employing a normative method, the study reveals that inconsistencies arise between the general principles of the Basic Agrarian Law (UUPA) and the more specific provisions applicable to the Capital City. The newly introduced government regulation substantially extends the durations for the Right to Cultivate (HGU), Right to Build (HGB), and Right to Use, departing from UUPA’s more restrictive agrarian policies. This discrepancy creates legal uncertainty for investors and land users, underlining the urgent need for regulatory harmonization to maintain legal coherence and stability. Moreover, the policy allowing land control for up to two cycles may lead to monopolization and exacerbate social inequality due to the prolonged periods of HGU and HGB. The regulation also broadens foreign investor access to land in the Capital City, potentially clashing with UUPA’s principles of social justice and national sovereignty. To safeguard public interest, prevent legal ambiguity, and ensure equitable land governance, it is essential to align these new regulations with the foundational values of the UUPA. The government must provide a clear and accurate interpretation of these provisions and enforce limitations on land ownership by individuals and legal entities to prevent misuse and protect national interests.
